(NLDO) – The leader of the People's Committee of Son Tra district, Da Nang city requested the Management Board of Hyori building not to do the work of the State management agency.
Regarding the case of Viet Nhat Kindergarten (Hioyri Building, Vo Van Kiet Street, Son Tra District, Da Nang City) asking for help because the building's Management Board (MB) obstructed educational activities and prevented the completion of fire prevention and fighting items, recently the authorities held a meeting to clarify many contents.
The meeting included competent authorities of Da Nang City: Department of Construction, Economic Security Department of Da Nang City Police, Fire Prevention and Rescue Police Department of Da Nang City Police, Son Tra District People's Committee, Son Tra District Police, An Hai Dong Ward People's Committee, representatives of the building investor, members of the building management board.
The Viet Nhat Kindergarten was prevented by the Hyori Building Management Board from completing the fire prevention and fighting project despite the prior directive from the Da Nang City Police.
At the meeting, Mr. Vo Kim Hoang - Deputy of the building's Board of Directors still maintained his opinion, saying that Viet Nhat Kindergarten must stop teaching and not continue to renovate because its operations are not in accordance with the approved design.
Expressing his opinion, Mr. Tran Dinh Khanh - Head of Housing and Real Estate Market Management Department - Da Nang Department of Construction said that the building's Management Board operates under the model of the Board of Directors of a Joint Stock Company. Therefore, it is recommended that the building's Management Board perform its duties in accordance with the 2023 Housing Law and Circular 05/2024/TT-BXD dated July 31, 2024 of the Ministry of Construction.
Mr. Khanh also affirmed that the common and private use areas have been stipulated in legal documents and contracts. "The Department of Construction has previously agreed on the policy of adjusting the kindergarten area. In case the apartment buyers have any problems, they will bring it to the Court or Commercial Arbitration for resolution. The issue of ownership in the apartment building is the responsibility of each individual, not the responsibility of the building management board" - Mr. Khanh stated his opinion.
Lieutenant Colonel Tran Le Minh Dung - Deputy Head of the Fire Prevention and Rescue Police Department - Da Nang City Police said that the investor has coordinated with the Fire Prevention and Rescue Police Department to carry out procedures for fire prevention and control approval. "The investor needs to coordinate with relevant agencies to deploy the installation according to the approval documents to be accepted for fire prevention and control" - Lieutenant Colonel Dung said.
Meanwhile, Mr. Hoang Cong Thanh - Vice Chairman of Son Tra District People's Committee said that according to the working regulations of the Management Board, the Management Board needs to coordinate with local authorities to ensure security and order. However, the Ward People's Committee has invited the Management Board to work many times but the Management Board has not cooperated.
"If the investor makes any mistakes, citizens have the right to petition the state management agency for consideration and handling, requesting that the Management Board not do the work of the state management agency. Requesting that the police inspect and consider handling the behavior of individuals who cause disorder in the locality" - Mr. Thanh emphasized.
Also at the meeting, Lieutenant Colonel Nguyen Nho Chinh - Head of the Economic Security Department of Da Nang City Police said that the construction of fire prevention and fighting is to ensure the safety of all people and property in the apartment building, so it needs to be done. Legal procedures will continue to be carried out according to regulations.
At the end of the meeting, the meeting chair requested the Board of Directors to properly perform the functions and tasks of the Board of Directors as prescribed in the 2023 Housing Law (Articles 147, 148) and Circular No. 05/2024/TT-BXD.
At the same time, request the People's Committee of Son Tra district to inspect the activities of the building management board to ensure compliance with legal regulations, and make recommendations to handle the building management board in accordance with regulations.
In addition, the Department of Construction and the City Police are requested to base on their functions and tasks to advise the City People's Committee on other issues related to construction permits and fire safety regulations for buildings. When there are citizen requests, the Department of Construction will also organize meetings with citizens to clarify related information.
