On October 24, the Department of Culture, Sports and Tourism of Lam Dong province said that it had sent a document to the Legal Department, Ministry of Culture, Sports and Tourism to seek opinions and professional guidance on the draft submission and decision to promulgate the Regulations on investment and management of agricultural tourism business activities in Lam Dong province for the period 2023-2030.
According to the draft developed by departments and branches of Lam Dong province, agricultural tourism sites must have a minimum area of 5,000m2 (in Da Lat city) and 10,000m2 (in other localities).
Specifically, for agricultural land area from 5,000-7,000m2 , the land use purpose can be converted to no more than 5% of the total land area, from 7,000-10,000m2 , it can be converted to no more than 4%, and over 10,000m2 , it can be converted to no more than 3% to non-agricultural land to build covered structures (infrastructure, height of 1 floor not exceeding 7m for agricultural tourism).
For the area converted to make uncovered structures (roads, parking lots), the ratio must not exceed 50% of the proportion of covered structures. To convert, detailed planning is required; the remaining land area is only for agricultural cultivation serving agro-tourism.
Notably, individual business households with available agricultural tourism resources that do not need to be recognized as agricultural tourism destinations do not need to establish an investment project but must ensure full business conditions for each field of operation according to the provisions of law before going into operation.
