By the fourth quarter , the city will completely resolve the problem of granting pink books - certificates of house ownership - for 81,000 houses.
According to the Department of Natural Resources and Environment of Ho Chi Minh City, about 81,000 real estate files waiting for pink books are divided by the city into 6 groups with specific solutions to resolve typical problems.
The first group of nearly 8,200 units has no legal problems, just waiting for confirmation of completion of financial obligations. In May, the Department of Natural Resources and Environment worked directly with the City Tax Department, Tax Departments of districts, Thu Duc City and project enterprises to fulfill financial obligations.
Group 2 has more than 30,000 apartments due to project enterprises delaying the submission of application documents for certificates. For this group, the Department of Natural Resources and Environment will organize direct work with project enterprises to clarify the causes and difficulties in the delay in submitting documents.
The Department said that units that have not submitted their documents without a valid reason will be punished according to the law and their list will be published on the Department of Natural Resources and Environment's electronic information portal for people and businesses to know.
Group 3 includes more than 10,000 units in 29 projects that have not been granted certificates because they fall into a new type of real estate that is not yet regulated by law. Currently, this group includes officetels and shophouses that have been guided by the central government on the process of granting pink books. The Department will organize a training session with the participation of the Ministry of Natural Resources and Environment as a reporter to provide guidance related to the work of granting certificates for these types.
The Department expects to complete the issuance of certificates for the remaining number of apartments in projects with construction works used for tourist accommodation purposes by the end of the third quarter in accordance with the law on tourism on commercial and service land.

Group 4 has nearly 20,000 apartments in 39 projects that must supplement financial obligations. Currently, 23 of these projects are being appraised by consulting units. The remaining projects are stuck, and will be studied to determine difficulties and shortcomings to have appropriate handling measures. In cases beyond authority, they will be reported to higher levels.
Accordingly, from the second quarter to the fourth quarter, the Department of Natural Resources and Environment will submit 23/39 projects to the City Land Valuation Council. Propose solutions and directions for the remaining 16/39 projects.
Group 5 includes nearly 4,700 apartments in 6 projects that have not yet been granted certificates due to other problems. The city's Department of Natural Resources and Environment will consider issuing pink books from the second to third quarter.
The last group has more than 8,200 apartments that are under inspection, examination, and investigation. The Department will have a written exchange with these agencies about the possibility of continuing to carry out administrative procedures for granting certificates for each specific project. The implementation period is from the second quarter to the end of the third quarter.
The problem of granting pink books for houses has existed for a long time. The reason for the delay in granting these books was also stated by the City Land Registration Office in a report to the Urban Committee of the Ho Chi Minh City People's Council.
First of all, this agency believes that the time for applying the book issuance process is too short. According to regulations, the time to process a file is no more than 15 working days from the date of receiving valid files. However, in reality, organizations and businesses often submit files in large numbers (on average from 50 to 300 files for one submission) but the appointment time for returning results is still 15 days.
In addition, equipment and personnel as well as machinery and information technology installed since 2005 are still in use, so the computer infrastructure, equipment and information technology are all old. Weak computer configurations cause many difficulties in operations, affecting the progress and time of processing records, and cannot meet the requirements for managing, updating and exploiting cadastral databases.
Besides, the volume of records and documents of all kinds that the City Land Registration Office receives is very large while the staff in the specialized department is still thin, so it is difficult to ensure the progress of handling records according to the set goals and plans.
According to the land law, for projects that have additional financial obligations, the Land Registration Office must also suspend the processing of certificates for home buyers until there is an opinion from a competent state agency confirming that the investor has fulfilled its financial obligations. In fact, the determination of additional financial obligations has been slow, affecting the progress of granting certificates to home buyers in these projects.
Finally, the Department believes that because the legal documents on land do not have provisions on the transition in granting certificates to home buyers over time, it causes confusion for the City Land Registration Office in receiving and processing records. In addition, new types of real estate that are not regulated for the granting of certificates also prolong the time to process records for granting pink books.
