Currently, many apartment projects in Ho Chi Minh City, although people have lived in them for a long time, have not yet been granted pink books. With the goal of solving the urgent housing needs of the people, recently the government has paid attention to solving legal issues and granting pink books.

Currently, many apartment projects in Ho Chi Minh City, although people have lived in them for a long time, have not yet been granted pink books. With the goal of solving the urgent housing needs of the people, recently the government has paid attention to solving legal issues and granting pink books.

"Difficult situation" of residents and real estate businesses

According to a report from the Department of Natural Resources and Environment, Ho Chi Minh City has more than 81,000 houses in 335 projects that are eligible but have not been able to complete the issuance of land use rights certificates and property ownership certificates attached to land (pink books) due to arising problems.

However, by December 2024, the city had completed the legal procedures and issued pink books for about 43,100 apartments, reaching a rate of 53%. It is expected that by 2025, the city will complete the procedures and issue pink books for the remaining 38,000 apartments.

According to records, in 2024, in Ho Chi Minh City, only a few real estate projects will be granted pink books thanks to clear and standard legal documents. For example, projects such as Lumiere Riverside, SOHO townhouses in The Global City urban area, Lake tower in the Grand Marina Saigon luxury apartment complex of Mastersie Homes; Vinhomes Grand Park project of Vinhomes; Victoria Village project, Sunrise Riverside of Novaland...

In particular, some projects of Masterise Homes residents are granted pink books within a short time after receiving the house. This is considered the effort of this real estate developer in realizing its commitment as well as ensuring the highest benefits for customers.

The reputation of real estate businesses in supporting the issuance of pink books for residents is always a top priority, along with location and amenities.

In fact, to be granted a pink book within 1 year, in addition to the legal factors of the project, it also depends on the capacity and reputation of the project developer; the close combination between the enterprise, residents and state agencies.

Recently, the issue of issuing pink books has been continuously mentioned. Many housing projects have not been issued with red books even though they have been handed over for many years. In fact, this is a "difficult situation" for both residents and real estate businesses. Many real estate businesses really want to carry out procedures to hand over red books to residents, but the issuance of pink books depends a lot on state agencies. It is worth mentioning that even the delay in paying land use fees is not due to the businesses being sluggish or shirking responsibility, but paradoxically, the businesses cannot pay even if they want to.

“Many residents think that investors are indifferent to issuing pink books to people, but in reality, “necessity makes wisdom”, many real estate businesses are in a difficult position because issuing pink books depends on the competent authority”, a real estate business once shared.

It can be seen that the procedure for granting land use/housing right certificates to people is delayed partly because of the process related to calculating land use fees; the land price and financial obligations of the investor cannot be determined; partly because the workload at state agencies is high, causing the process of granting pink books to be delayed.

The parties "look forward" to the determination of the state agencies.

To address the delay in issuing pink books, Ho Chi Minh City has implemented a series of specific solutions. Most notably, the Ho Chi Minh City People's Committee has established a special task force tasked with reviewing, compiling statistics and classifying problems into specific groups. This task force focuses on handling outstanding issues, coordinating with departments and investors to speed up the process of issuing certificates.

Pink book ensures the highest legal rights of residents

In 2025, Ho Chi Minh City will continue to direct relevant departments to closely coordinate with investors to quickly resolve documents. Promote the application of technology; strengthen progress monitoring, closely monitor project groups, and ensure that the issuance of pink books is carried out according to the set roadmap.

The issuance of pink books not only ensures the legitimate rights of the people but also contributes to building trust in the real estate market. This is an important step to promote the sustainable development of the commercial housing sector in the city.

Mr. Le Hoang Chau, Chairman of the Ho Chi Minh City Real Estate Association (HoREA), said that currently, a number of issues have been added and included in the new Land Law and Housing Law, so there is a basis for state agencies to handle problems related to the issuance of pink books.

“The establishment of a team to resolve issues related to the issuance of pink books is necessary and urgent because these issues are mostly related to many departments and branches. I also hope that the team will be able to resolve issues for projects and issue ownership papers to people quickly in the near future,” Mr. Chau shared.

Mr. Nguyen Toan Thang, Director of the Department of Natural Resources and Environment of Ho Chi Minh City, said that the Department of Natural Resources and Environment of Ho Chi Minh City is focusing on resolving administrative procedures for people and businesses, not leaving any backlog. The Department will try to resolve the issuance of pink books to investors and projects in the coming time. The Department of Natural Resources and Environment will proactively work with the City Land Valuation Council to speed up the appraisal work, submit to the City People's Committee for approval of financial obligations, additional financial obligations for housing projects. Complete and develop the application of information technology in the work of receiving, processing and returning results of records.

Professor Dang Hung Vo, former Deputy Minister of Natural Resources and Environment, said that people who have spent money to buy and live in houses but are still not recognized by the government are at a disadvantage. Accordingly, the important issue now is that the city must be more drastic and decisive. Removing difficulties to grant pink books to people must be done thoroughly, as quickly as possible.

Most real estate businesses hope that with upcoming solutions and a policy of determination to restore the general economy, state agencies will speed up the process of issuing Certificates to help residents feel secure in living and working.
