Perfecting institutions to realize 'Harmonized benefits, shared risks' in the investment sector

This is the content presented at the Information Conference on the International Workshop "Improving institutions to realize the principle of "Harmonious benefits, shared risks" in the investment field" organized by Vietnam Law Newspaper in collaboration with Law and Development Magazine (Vietnam Lawyers Association) on the afternoon of March 28.

At the Conference, Dr. Vu Hoai Nam, Editor-in-Chief of Vietnam Law Newspaper, Head of the Organizing Committee of the Conference, said that the Conference was organized to identify the promoting values ​​and barriers in the current institutions on direct investment towards realizing the principle of "Harmonious benefits, shared risks" in the context of investment activities being regulated by many new laws including the Investment Law 2020, the Public Investment Law 2019, the Law on Investment under the Public-Private Partnership (PPP) 2020, the Bidding Law 2023, the Land Law 2024...

From discovering shortcomings and limitations in positive laws as well as practical implementation, the Workshop proposed solutions to promote the principle of "harmonized benefits, shared risks, and institutional improvement" to attract domestic and foreign investors for the next strong development stage of the country, the strategy to bring the country into a new era, the era of national growth as the Party's policy emphasized by General Secretary To Lam.

The workshop was held on the occasion of the 40th anniversary of the founding of Vietnam Law Newspaper (July 10, 1985 - July 10, 2025), on April 5, 2025, helping the Newspaper mark its 40th anniversary with many meaningful scientific activities.

According to Prof. Dr. Le Hong Hanh, Editor-in-Chief of Law and Development Magazine - Deputy Head of the Organizing Committee, the Workshop is especially relevant and valuable in promoting development at the present time.

In particular, institutional changes are being carried out comprehensively in all areas, greatly affecting the contents of the Investment Law, aiming at a legal system capable of ensuring the country's development through many solutions, in which investment attraction plays a decisive role.

Institutions, especially the legal element, must ensure the realization of the principle of "harmonized benefits and shared risks" for the purpose of attracting investment.

The workshop will be held on April 5, 2025, in Ha Long City, Quang Ninh Province. It is expected that about 150 delegates from state management agencies, international organizations, investors, and domestic and foreign enterprises will attend the workshop.

At the Workshop, delegates will discuss 3 thematic groups with more than 30 discussion topics including: Overview of institutions and principles of "Harmonious benefits, shared risks"; Principles of "Harmonious benefits, shared risks" in specific fields; Role of State management and dispute resolution.

In addition, delegates will listen, exchange and discuss issues surrounding the determination of the content and value of the principle of "Harmonious benefits, shared risks" in attracting investment for national development in the context of many fluctuations in domestic and international investment activities; opportunities and challenges, especially from unfavorable external and internal factors that have lasted for many years in current Vietnamese law, especially in the Investment Law, Public Investment Law, Law on Investment under the form of public-private partnership, and Bidding Law.

The workshop also sought to identify international universal requirements and specific requirements in the Vietnamese context that the principle of "Harmonious benefits, shared risks" poses in relation to current institutions and future improvements, identifying solutions that can promote the principle of "Harmonious benefits, shared risks" to become a driving force to attract investment for the country's development.
