On December 3, on the Ministry of Public Security's Information Portal, the Ministry provided information to help people better understand the regulations on installing journey monitoring devices for specialized motor vehicles in the Draft Law on Road Traffic Order and Safety.
Accordingly, at the press conference announcing the results of the 6th session of the 15th National Assembly on the morning of November 29, 2023, Lieutenant General Nguyen Minh Duc, Deputy Chairman of the National Assembly's Committee on National Defense and Security, said: this is the initial draft, National Assembly deputies are giving their opinions, and there will be surveys and discussions to evaluate from many perspectives; the reviewing agency is responsible for coordinating with the drafting agency and relevant agencies to assess the impact of the policy in accordance with the actual conditions of the Vietnamese people to regulate to ensure social management and serve the interests of the people.
However, in recent days on social networking forums, many people have not understood correctly, have not distinguished between the draft law and legal regulations; between specialized motor vehicles and personal vehicles. Some people have even deliberately distorted information, "led" and "manipulated" public opinion in the direction that state management agencies are "making things difficult" for people.
To clarify this issue, Major General Nguyen Van Minh, Deputy Director of the Traffic Police Department, said: The draft Law on Road Traffic Order and Safety does not stipulate mandatory installation of journey monitoring devices for motorbikes, scooters and private cars.
Major General Nguyen Van Minh said that motorbikes, scooters and private cars are not required to install journey monitoring devices. However, the draft law encourages the installation of journey monitoring devices for private cars.
Because, the journey monitoring device creates favorable conditions for people and businesses in the process of participating in road traffic and strengthens state management of social order and safety, traffic order and safety: supports safe driving as well as avoiding unfortunate risks that may occur; supports solving legal issues arising when collisions and traffic accidents occur, records images and incidents occurring on the road; vehicle drivers can prove right or wrong in unexpected situations on the road, save evidence when criminals invade their vehicle or that of others; Provide to authorities for handling, contributing to protecting the health and safety of drivers and others.
Clause 4, Article 33 of the draft Law, the Government issued a Decree providing detailed instructions, in the direction of mandatory application for certain types of vehicles such as transport business vehicles, contract vehicles, school buses, vehicles exceeding the road size limit, overloaded vehicles, vehicles transporting dangerous goods... to install journey monitoring devices.
The issue of monitoring the journey of commercial transport vehicles: Commercial transport vehicles, especially passenger transport vehicles, need to be considered a special subject in ensuring traffic order and safety, because if traffic accidents occur with these vehicles, they will cause particularly serious consequences for people's lives.
According to statistics from the Ministry of Public Security, traffic accidents involving commercial transport vehicles account for nearly 40% of the total number of cases, of which many accidents involving commercial passenger transport vehicles cause major casualties (the most recent example is the passenger bus accident on September 30, 2023 in Dong Nai that killed 4 people and injured 5 people; the passenger bus accident on October 31, 2023 in Lang Son that killed 5 people and injured 9 people...), we cannot be indifferent to this extremely heartbreaking situation.
The Government and sectors have implemented many solutions to limit accidents involving passenger vehicles; we have also identified the main causes of these accidents (according to the analysis of the Ministry of Public Security, more than 70% are related to speeding violations) and have also had specific solutions. One of the important solutions is that these types of vehicles are required to install journey monitoring devices (according to the provisions of Decree No. 10/2020/ND-CP dated January 17, 2020) to monitor violations by drivers, violations by passengers and violations of road transport.
However, the current problem is that the journey monitoring data has not been used effectively due to the separation and lack of data connection with the force directly ensuring traffic safety and order, so many bus companies have violated the law many times in a short period of time, in some cases speeding more than 300 times/month but have not been handled or prevented in time. If there had been real-time monitoring of transport vehicles, we believe that many tragic accidents involving passenger cars like the recent ones could have been prevented.
Major General Nguyen Van Minh highly agreed on the necessity of regulating transport business vehicles to ensure the conditions of having journey monitoring equipment in the draft Law on Road Traffic Order and Safety. This monitoring is assigned to the agency responsible for ensuring traffic order and safety to conduct actual monitoring to promptly suspend and immediately handle violations that occur, drivers who violate the law and may cause accidents to passengers or other road users; at the same time, promptly handle other violations.
