According to the regulations on extra teaching and learning being implemented under Circular 17/2012 issued by the Ministry of Education and Training, extra teaching and learning are additional teaching activities that collect money from learners, with content according to the general education program but outside the education plan of the general education program issued by the Ministry of Education and Training.
Cases in which teachers are allowed to teach extra classes
In order for extra-curricular activities to be carried out properly and effectively, the above circular stipulates that extra-curricular activities are for students who have the need to take extra-curricular activities, voluntarily take extra-curricular activities, and have their families' consent; no form of coercion may be used to force students' families and students to take extra-curricular activities.
At the same time, teachers must not organize extra classes according to regular classes; students in the same extra class must have similar academic ability; when placing students in extra classes, it must be based on the students' academic ability.

Teachers are not allowed to teach extra classes to students who are organized by the school to teach 2 sessions/day; are not allowed to teach extra classes to primary school students, except in the following cases: training in arts, physical education, life skills training; universities, colleges, vocational schools and vocational schools are not allowed to teach extra classes or study additional subjects according to the general education program.
For public school teachers, they are not allowed to organize extra classes or tutoring outside of school, but they can participate in extra classes outside of school. In addition, public school teachers are not allowed to teach extra classes outside of school with students they are teaching in their regular classes without permission from the Head of the management agency.
Similarly, teachers who teach at private or international schools, if not teaching students in their own system, may be considered legal to tutor, as long as it does not violate the employment contract.
Requirements for tutors
To participate in tutoring activities, tutors must meet the training standards for each level of education as prescribed by the Law on Education and be in good health. In addition, teachers must fully perform their civic duties and comply with the provisions of the law; and complete assigned tasks at their workplace.
Teachers participating in extra teaching activities must not be subject to disciplinary action, criminal prosecution, serving a prison sentence, non-custodial reform, probation, subject to educational measures in communes, wards, or towns, or sent to medical facilities or educational facilities; and must not be subject to disciplinary action in the form of forced dismissal.
Extra teachers must be confirmed by the head of the management agency or the Chairman of the People's Committee at the commune level on the contents specified in Clause 3 and Clause 4 of this Article (for extra teachers outside of school); and be permitted by the head of the management agency according to the provisions in Point b, Clause 4, Article 4 of this Regulation (for teachers receiving salary from the salary fund of public service units).
Currently, the Ministry of Education and Training is developing and completing a new draft circular on regulations for extra teaching and learning. Once this draft is approved and issued, it will replace Circular No. 17/2012/TT-BGDDT on extra teaching and learning currently in effect.
