According to some experts, the proposed legal regulations are considered a breakthrough of breakthroughs but can also be a bottleneck of bottlenecks. Because if the regulations are appropriate and practical, they will encourage and create motivation for development, on the contrary, if the regulations do not keep up with reality, they will hinder development. Therefore, the Central Government is currently focusing on directing the review and immediate removal of bottlenecks, especially regulations in the spirit of closely following real life.
Speaking at the recent working session of the Government delegation with Bac Giang province, a number of provincial delegates made appropriate recommendations and proposals. A delegate stated that in the process of building urban and residential areas in the province, many commercial and service land funds (clean land) have been formed. Many large enterprises and corporations have come to explore investment opportunities and wish to invest in Bac Giang. However, the use of these land funds to form commercial and business centers is facing difficulties due to land laws.
Specifically, the 2024 Land Law stipulates that these cases cannot apply the form of land lease with one-time payment (except when the project has land for tourism, office, or accommodation). Meanwhile, the auction of land lease with annual payment is not currently defined in this Law. Moreover, if all service land is used for tourism, office or accommodation business, it will be limited and not diversify the types of services.
To promote the development of service industries, Bac Giang proposed that the Government allow the use of clean land funds through auctions with one-time land rental payments to attract potential businesses to the area, creating a shift in service development.
In addition, in the province, there are many projects implemented in the form of agreements to transfer land use rights, but after many years, they have not been completed and put into operation because there are still some land plots in the middle of the project. It is recommended that the Ministry of Agriculture and Environment have a direction to resolve this case.
The provisions of the law are issued to create deterrence and increase strictness, but there are provisions that cause difficulties and are not suitable for practice, which will waste resources. Grasping the situation from the locality, the Government Working Group listened to and accepted the recommendations with the spirit of providing specific guidance on the contents that the law has allowed, and for those that are not yet allowed but are suitable for practice, recommendations will be made to resolve them, using one law to amend many laws. This further demonstrates the determination to build a creative, honest, effective and efficient Government.
