Proposal to make the Standing Secretariat a security target

(Dan Tri) - The draft revised Law on Guards adds the following subjects to the Guard: the Standing Secretary of the Secretariat; Chief Justice of the Supreme People's Court; Chief Prosecutor of the Supreme People's Procuracy - positions that are high-ranking leaders of the Party and State.

On the afternoon of May 20, the National Assembly listened to General To Lam, Minister of Public Security, present the Report on the Draft Law amending and supplementing a number of articles of the Law on Guards. After 5 years of implementation, the Minister of Public Security said that the Law on Guards has encountered a number of problems and shortcomings that need to be amended and supplemented. The problems and shortcomings are related to the subjects of guarding; measures and regimes of guarding; tasks and powers of the Guard force.

With this draft amendment to the Law, General To Lam said that the Government proposed to add the following security subjects: Standing member of the Secretariat; Chief Justice of the Supreme People's Court; Chief Prosecutor of the Supreme People's Procuracy. These are positions that have been identified as senior leaders of the Party and State. According to the Government's explanation for this proposal, the Standing member of the Secretariat is the person in charge of and presides over the daily work of the Secretariat, holding an important role and position in the organization of the Party and State. Meanwhile, the Chief Justice of the Supreme People's Court and the Chief Prosecutor of the Supreme People's Procuracy are the heads of judicial agencies, playing a role and influencing the trial work, ensuring the strictness of the law, the rule of law, human rights, and civil rights. Chairman of the National Defense and Security Committee Le Tan Toi said that the reviewing agency agreed with the addition of security subjects as proposed by the Government. According to the inspection agency, the addition of the three above-mentioned titles and positions is consistent with the nature and importance of these positions in the political system, Mr. Toi emphasized. Reporting further on the security work, General To Lam said that this work always has many unpredictable and unpredictable factors. In addition to ensuring the security and safety of the guarded subjects, it also actively serves foreign affairs and the image of Vietnam with international friends. Therefore, depending on the security and order situation at each time and in each specific case, the Minister of Public Security will decide to apply appropriate security measures for each appropriate subject (within a certain scope and time).

To ensure a legal corridor in performing tasks, the draft regulation, based on the political security situation in each period, the Government submits to the National Assembly Standing Committee to supplement the subjects of protection and the application of protection measures and regimes in accordance with the provisions of the law. In urgent cases to protect national security, ensure social order and safety, and ensure foreign affairs, the Minister of Public Security decides to apply appropriate protection measures to subjects not covered by the provisions of this law. "This does not generate financial resources," the Minister of Public Security affirmed. The review agency also believes that assigning the Minister of Public Security to decide on the application of protection measures to a number of specific cases is necessary and appropriate. In practice, from 2018 to present, the Ministry of Public Security has deployed security work for 56 Groups that are not subject to security to promptly resolve practical requirements or at the request of ministries, departments, branches, and foreign embassies in Vietnam.
