National Assembly Delegation of Ha Tinh contributed many comments on the draft Law on Water Resources

Deputy Head of the Ha Tinh National Assembly Delegation Tran Dinh Gia proposed many important contents related to the draft Law on Water Resources (amended).

Continuing the 6th Session, on the morning of October 26, at the National Assembly House, under the chairmanship of National Assembly Chairman Vuong Dinh Hue, the National Assembly discussed the draft Law on Water Resources (amended). Expressing his agreement with the comments that have been received, explained and adjusted in this draft law, Deputy Head of the Ha Tinh National Assembly Delegation Tran Dinh Gia proposed adding the responsibility for protecting water resources according to specialized laws; the regulation on minimum flow only applies to projects of lakes and dams that are repaired, upgraded and newly built; and developing regulations on coordinating the operation of dams and reservoirs on rivers and streams.

Member of the Standing Committee of the National Assembly, Chairman of the Economic Committee of the National Assembly Vu Hong Thanh presented a report explaining, accepting and revising the draft Law on Water Resources (amended).

Discussing the water source protection corridor in Article 23, Deputy Head of the Ha Tinh National Assembly Delegation Tran Dinh Gia proposed adding a provision on the responsibility of "State agencies at all levels, according to their authority, shall handle and protect the legitimate rights and interests of organizations and individuals in the water source protection corridor according to specialized laws, ensuring that they do not violate the prohibitions prescribed in Article 8 of this Law".

Because it is related to the water source protection corridor, it is necessary to ensure the rights and obligations of organizations, communities, households and individuals in the water source protection corridor according to the provisions of specialized laws. The delegate gave an example that the owners of objects located in the land area belonging to the water source protection corridor and existing before the time of establishing the water source protection corridor are guaranteed rights and obligations according to the provisions of specialized laws.

Regarding the minimum flow in Article 24, the Deputy Head of the Ha Tinh National Assembly Delegation proposed to add a regulation that the minimum flow only applies to projects of lakes and dams that are being repaired, upgraded, or newly built. For lakes and dams that are in use and do not have facilities to discharge environmental flows, when the project is upgraded or repaired, additional facilities must be added to ensure the minimum flow.

Discussing the process of operating reservoirs and inter-reservoirs, in Clause 8, Article 38, delegate Tran Dinh Gia proposed to consider the regulation of assigning the provincial People's Committee to organize the development of regulations on coordination of operations between dams and reservoirs on rivers and streams. In reality, the current human resources and water resources management resources in the locality are still lacking and weak, not ensuring the implementation of this content. At the same time, in order for the regulations on coordination of operations between dams and reservoirs on rivers and streams to be suitable to actual conditions, the project owner/operation management unit shall establish them, and the competent authority shall review and approve them.

Minister of Natural Resources and Environment Dang Quoc Khanh spoke to receive and clarify the opinions of National Assembly deputies raised at the discussion session.

Regarding declaration, registration, licensing of exploration, exploitation and use of water resources (Article 52), the Deputy Head of the Delegation proposed clarifying the concepts of "medium scale" and "small scale" so that agencies and units have a basis for implementation.
