On the afternoon of August 8, comrade Luu Van Ban, member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Hai Duong Provincial People's Committee chaired the August meeting of the Provincial People's Committee (3rd time) to review and resolve the contents and submissions reported by a number of departments and branches.
The meeting considered the draft regulations on other documents on land use rights issued before October 15, 1993, and the land area permitted to build works for agricultural production on agricultural land. The Department of Natural Resources and Environment proposed that other documents on land use rights issued before October 15, 1993 are decisions of the People's Committee of Hai Hung province to allocate land to households and individuals using land or allowing the People's Committee at the district or commune level to allocate land to households and individuals using land, and the names of land users are included in the decision or list attached to the decision or list submitted by the specialized agency to the People's Committee of the province. The conditions must be satisfied that the People's Committee at the district or commune level has not issued a decision to allocate land to households or that the competent authorities and land users have not yet retained the land allocation decision issued by the People's Committee at the district or commune level. Land users are using the land stably and in the correct location as assigned by the decision of the Provincial People's Committee, confirmed by the People's Committee of the commune where the land is located.
Regarding the regulations on the land area allowed to build works serving agricultural production on agricultural land, the Department of Natural Resources and Environment proposed that livestock barns, greenhouses, net houses and other houses serving the purpose of growing crops and raising livestock be allowed to be built on no more than 100% of the land area. Rest houses, camps for workers, laborers, agricultural product preservation, storage of pesticides, fertilizers, machinery, tools and other auxiliary works are allowed to be built on no more than 10 m2 with a land area of less than 1,000 m2 , and no more than 40 m2 for a land area of 1,000 m2 or more. Previously, the Provincial People's Committee stipulated that the construction area of the above works must not exceed 20 m2 on agricultural land.
Concluding this content, Mr. Luu Van Ban, Standing Vice Chairman of the Provincial People's Committee, said that identifying other documents on land use rights before October 15, 1993 will facilitate the determination of land origin and ensure the rights of land users. The contents of the 2024 Land Law will not be included in the regulations but will only focus on practical issues that need to be resolved.
Regarding the regulations on land area allowed to build works serving agricultural production on agricultural land, the Standing Vice Chairman of the Provincial People's Committee requested that policy-making advisory agencies should base on practical basis and related legal regulations to propose optimal solutions.
The Department of Natural Resources and Environment received comments at the meeting and coordinated research to develop regulations in the direction of not expanding the construction area on converted agricultural land. At the same time, it proposed management conditions to avoid distortion and abuse of policies for violations.
The August meeting of the Provincial People's Committee (3rd time) also considered and discussed the draft decision to promulgate regulations on land allocation limits, land use right recognition limits, agricultural land use right transfer limits; conditions for plot separation, conditions for plot consolidation, minimum area allowed for plot separation in Hai Duong province. Plan to adjust and allocate the 5-year local budget public investment plan 2021-2025 and allocate the capital plan for 2024 (6th time).
