Registering to receive citizens, Ms. Nguyen Thi Nhu Phuong (Thinh My block, Cam An ward, Hoi An city) reflected her wish for the competent authority to consider dividing the land plot to build a house. The family's land location is in the planning of the Green Tree Trail of DT603B road (Lac Long Quan road, Cam An ward), but since 2017, this project has not been implemented. The family is very upset about the housing needs.

Regarding citizens' feedback, according to the report of Hoi An City People's Committee, the locality has worked with related investors (Le Phan Resort Joint Stock Company and Hoi An - Pacific Investment Joint Stock Company) to coordinate and support site clearance to implement the Green Tree Trail planning along DT603B road in front of the projects for early implementation.

Specifically, on July 19, 2024, the departments and the People's Committee of Hoi An City worked with Le Phan Resort Joint Stock Company under the direction of the Provincial People's Committee. At the meeting, the company said that the current funding source for implementation is not guaranteed in coordination with state agencies to support the clearance of households affected by the planning of the Green Tree Trail on Lac Long Quan Street (DT603B, before the company's project).

Hoi An City People's Committee said that investors do not have enough funds to implement the Green Tree Trail planning along DT603B Road and the city also does not have enough funds to clear out all households.

At the meeting with the public, the professional sector said that the Green Tree Trail planning along DT603B road has been extended until the end of October 2024. If the enterprise does not implement it, it will be revoked according to the provisions of law.

Taking note of the citizen's feedback, Chairman of the Provincial People's Committee Le Van Dung said that regarding this incident, the Provincial People's Committee agrees with the proposal of the Hoi An City People's Committee in Report No. 259 dated August 2, 2024. In the direction that while the planning has not been implemented, it is agreed to allow people to have the right to repair and upgrade their houses to ensure their lives. If by the prescribed time (the end of October 2024), this project is not implemented in accordance with the planning, Hoi An will consider and propose to the competent authority to divide the land plots and grant land to the people.

*Also this morning, reflecting at the meeting, the authorized representative of Ms. Nguyen Thi Keo's household (residing at 232 Nguyen Duy Hieu, Cam Chau ward, Hoi An city) stated: In May 2018, Ms. Keo submitted a dossier to correct the change but the dossier was returned despite the Notice No. 663 dated July 20, 2018 agreeing to correct the change in area reduction and recognizing the urban residential land area with an area of ^​​421m2 (plot No. 1547, map sheet No. 04, Land use right certificate No. E0109875).

Regarding this case, the court ruled that both the first instance and the appeal court recognized the rights of Ms. Nguyen Thi Keo. Hoi An City People's Committee has completed the execution of the judgment, however, when carrying out the procedure to issue and change the Certificate of Land Use Rights, it was not resolved even though it had agreed to donate 139m2 ^of residential land to open Nguyen Duy Hieu Street. We request the Provincial People's Committee to intervene to resolve this.

Based on the citizen's feedback and the statement of the representative of the Quang Nam Land Registration Office, Chairman of the Provincial People's Committee Le Van Dung said that the Land Registration Office has not fulfilled its responsibility in resolving the issue. Hoi An City People's Committee confirmed the origin of the land since October 2023, but refused to resolve it, now stating that it must apply the new Land Law.

According to the provisions of the 2024 Land Law, the issuance and exchange of Land Use Right Certificates is under the authority of the People's Committee of Hoi An City. Accordingly, the Chairman of the Provincial People's Committee assigned the People's Committee of Hoi An City to proceed with the issuance and exchange of this certificate in accordance with regulations, in the fastest time, meeting the wishes of citizen Nguyen Thi Keo.

The announcement of the conclusion of the reception also clearly stated that the responsibility of the Quang Nam Land Registration Office is to guide, direct and urge its subordinate offices to uphold their sense of responsibility in advising the People's Committees at the same level to resolve procedures related to the issuance of Land Use Right Certificates to individuals and organizations.
