New regulations on commune-level officials and civil servants

Decree 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres and civil servants replaces 04 Decrees of the Government and relevant legal provisions, effective from August 1, 2023, in which, the Decree has a number of new points: Not regulating the title of Chief of Commune Police; supplementing regulations on increasing (not controlling the maximum) the number of commune-level civil servants; supplementing regulations on concurrent allowances; increasing the level of the allowance fund for non-professional workers in each commune-level administrative unit;...

Increase pensions, social insurance benefits and monthly allowances

Decree No. 42/2023/ND-CP dated June 29, 2023 of the Government adjusting pensions, social insurance benefits and monthly allowances takes effect from August 14, 2023.

According to the Decree, from July 1, 2023, the adjustments are as follows:

Increase by 12.5% on pension, social insurance benefits and monthly allowances of June 2023 for subjects regulated under Decree No. 108/2021/ND-CP adjusting pension, social insurance benefits and monthly allowances.

Increase by 20.8% on pension, social insurance benefits and monthly allowances of June 2023 for subjects not yet adjusted under Decree No. 108/2021/ND-CP adjusting pension, social insurance benefits and monthly allowances.

From July 1, 2023, people who are receiving pensions, social insurance benefits, and monthly benefits according to regulations, after adjustment, have a benefit level lower than VND 3,000,000/month, will be adjusted to increase as follows:

Increase by 300,000 VND/person/month for those with benefits below 2,700,000 VND/person/month; increase by 3,000,000 VND/person/month for those with benefits from 2,700,000 VND/person/month to under 3,000,000 VND/person/month.

Farmers Support Fund operates not for profit

Decree 37/2023/ND-CP dated June 24, 2023 of the Government on the establishment, organization and operation of the Farmers Support Fund takes effect from August 8, 2023.

The operating principles of the Farmers Support Fund are financial autonomy, not for profit, openness, transparency, capital preservation and development; limited liability within the scope of the Farmers Support Fund's equity capital; properly performing the assigned functions and tasks according to the provisions of law.

The Farmers Support Fund operates with the goal of supporting members of the Vietnam Farmers' Union to build and replicate effective production and business models, contributing to increasing income and improving farmers' lives; creating resources, conditions and tools to unite and gather farmers into the association, contributing to building the association and the farmers' movement.

Professional responsibility allowance for Inspectors

Decree 43/2023/ND-CP dated June 30, 2023 of the Government detailing a number of articles and measures to implement the Law on Inspection takes effect from August 15, 2023, which stipulates the occupational responsibility allowance regime for Inspectors.

Specifically, the Government Inspector General, Deputy Government Inspector General, and Senior Inspectors are entitled to a responsibility allowance according to the Inspectorate profession equal to 15% of the current basic salary plus the leadership position allowance and seniority allowance beyond the framework (if any).

The Chief Inspector is entitled to a responsibility allowance according to the Inspectorate profession equal to 20% of the current basic salary plus the leadership position allowance and seniority allowance beyond the framework (if any).

Inspectors are entitled to a responsibility allowance according to the Inspector profession equal to 25% of the current basic salary plus leadership position allowance and seniority allowance beyond the framework (if any).

In addition to the above provisions, Inspectors who are civil servants are entitled to the same benefits as other cadres and civil servants as prescribed by the Law on Cadres and Civil Servants; are entitled to salaries, seniority allowances and other special regimes and policies as prescribed by law.

Inspectors who are officers in the People's Army, People's Police, and people working in key positions are entitled to the regime prescribed for the armed forces and the responsibility allowance regime according to the inspection profession according to the above regulations.

Commune-level police issue certificates of eligibility for security, order and management of business establishments.

Effective from July 15, 2023, Decree 56/2023/ND-CP dated July 24, 2023 amends and supplements a number of articles of Decree 96/2016/ND-CP dated July 1, 2016 stipulating security and order conditions for a number of conditional investment and business sectors and professions.

In particular, the Decree supplements the regulation that the Commune-level Police are responsible for issuing Certificates of eligibility for security and order and managing business establishments, including: Accommodation service business establishments with a business scale of less than 10 rooms, and gas business establishments that are business households.

Driving test fee increase from August 1, 2023

From August 1, 2023, driving test fees will be applied according to new regulations in Circular No. 37/2023/TT-BTC dated June 7, 2023 of the Ministry of Finance stipulating the collection rates, collection, payment, management and use of driving test fees; fees for granting licenses and certificates to operate on various types of vehicles and fees for registration and issuance of license plates for specialized motorbikes.

Accordingly, the driving test fee for driving tests for classes A1, A2, A3, A4 includes: Theoretical test is 60,000 VND/time, an increase of 20,000 VND compared to the old level of 40,000 VND/time; practical test is 70,000 VND/time, an increase of 20,000 VND compared to the old level of 50,000 VND/time.

For the driving test for cars of class B1, B2, C, D, E, F, the theoretical test fee is 100,000 VND/time, an increase of 10,000 VND compared to the old level of 90,000 VND/time; the practical test in pictures is 350,000 VND/time, an increase of 50,000 VND compared to the old level of 300,000 VND/time; the practical test on the road is 80,000 VND/time, an increase of 20,000 VND compared to the old level of 60,000 VND/time; the driving test using software simulating traffic situations is 100,000 VND/time.

New regulations on granting and revoking registration and license plates of motor vehicles

The Ministry of Public Security issued Circular 24/2023/TT-BCA regulating the issuance and revocation of registration and license plates of motor vehicles, effective from August 15, 2023.

It stipulates that vehicle license plates are issued and managed according to the vehicle owner's identification code (hereinafter referred to as identification plate).

Identification plate is a plate with symbols, plate series, size of letters and numbers, and plate color according to the provisions of this Circular.

For vehicle owners who are Vietnamese citizens, license plates are managed according to personal identification numbers.

In case the vehicle expires, is damaged or ownership is transferred, the vehicle owner's identification plate will be revoked by the vehicle registration authority and reissued when the vehicle owner registers another vehicle under his/her ownership.

The identification number of the license plate is retained for the vehicle owner for a period of 05 years from the date of revocation; after the above period, if the vehicle owner has not registered, the identification number of the license plate will be transferred to the license plate warehouse for registration and issuance to organizations and individuals according to regulations.

In case the vehicle owner changes his/her headquarters or residence from one province or centrally-run city to another, he/she can keep the identification number plate (no need to change the vehicle number plate).
