Quang Nam Provincial People's Committee has just announced the conclusion of Vice Chairman of the Provincial People's Committee Tran Anh Tuan at the meeting with citizens about the projects of Bach Dat An Joint Stock Company.
Accordingly, a group of citizens representing households who bought land in three projects: Urban Area 7B expansion, Bach Dat Urban Area and Hera Complex Riverside Urban Area invested by Bach Dat An Joint Stock Company reported that the investor was procrastinating, deliberately not implementing the project, and not fulfilling financial obligations to the State for the area of land that had been allocated. Thereby, they requested that the authorities take effective measures and sanctions to force Bach Dat An Joint Stock Company to pay taxes.
According to representatives of households who bought land at 3 projects of Bach Dat An Joint Stock Company, the investor has been procrastinating and deliberately not implementing the project.
According to representatives of the households, Bach Dat An Joint Stock Company has signs of dispersing and selling assets (transferring land use rights at the An Cu 1 Residential Area project). The group of citizens requested the Provincial People's Committee to direct measures and sanctions to seize assets and land use rights at the An Cu 1 Residential Area project of Bach Dat An Joint Stock Company to fulfill financial obligations to the State and enforce judgments.
After listening to the citizens' presentations and the opinions of the members attending the meeting, Vice Chairman of the Quang Nam Provincial People's Committee Tran Anh Tuan concluded: The Provincial People's Committee and the provincial authorities always focus on directing the project and hope that it will be implemented and completed so that the people's rights can be resolved. However, the investor's lack of active cooperation and coordination with the authorities and parties in the process of preparing documents, procedures, and resolving related issues has led to the project being prolonged, affecting the people's rights.
"The State has the responsibility to protect the legitimate rights and interests of the people and direct the implementation of the project in accordance with the provisions of law. When the investor and the parties do not actively and voluntarily cooperate in resolving rights and implementing the project, the government has the responsibility to apply sanctions and professional measures to force the investor to implement the project or revoke the project in accordance with the provisions of law.
Regarding Bach Dat An Joint Stock Company's delay in paying taxes for the Bach Dat Urban Area project, the provincial Tax Department has applied tax enforcement measures according to the law; however, the investor has not yet implemented them. Therefore, it is necessary to consider and apply strong, tough, and strict measures for the investor to implement them" - excerpt from the conclusion notice.
The leaders of Quang Nam province assigned the Department of Planning and Investment to preside over and coordinate with the Provincial Tax Department, the Department of Natural Resources and Environment, the Provincial Civil Judgment Enforcement Department, and relevant departments and branches to study and propose to the Provincial People's Committee specific measures to direct and handle the tax debt of Bach Dat An Joint Stock Company in early June 2023; it is necessary to advise the Provincial People's Committee to establish a working group to direct, monitor, and urge the handling of the company's tax debt and seek opinions from superior agencies to apply appropriate handling measures.
Also according to the Vice Chairman of the Quang Nam Provincial People's Committee, currently, the projects invested by Bach Dat An Joint Stock Company have run out of progress, so the People's Committee of Dien Ban Town and the Dien Ban Town Land Fund Development Center have temporarily suspended the payment of compensation and site clearance. The provincial leaders requested the People's Committee of Dien Ban Town to direct the Town Land Fund Development Center to proactively plan and develop specific solutions to accelerate the payment of compensation and site clearance according to the approved plan as well as carry out compensation and site clearance for the remaining area when the projects are extended or with the direction and agreement of competent authorities.
In addition, Mr. Tran Anh Tuan directed the Department of Planning and Investment to urgently preside over and coordinate with relevant sectors to guide investors to carry out procedures according to regulations to extend and apply measures, sanctions, and urge investors to ensure conditions for extending projects; at the same time, report and advise the Provincial People's Committee to consider and extend the progress to have a basis for carrying out the next procedures.
Representatives of households who bought land plots expressed their anger towards the investor, Bach Dat An Joint Stock Company.
Notably, Mr. Tran Anh Tuan requested the provincial Civil Judgment Enforcement Department to continue to coordinate and contact the General Department of Judgment Enforcement for guidance and direction on issues related to the enforcement of judgments.
Regarding the transfer of land use rights by Bach Dat An Joint Stock Company at the An Cu 1 Residential Area project, the leaders of Quang Nam province assigned the Provincial Tax Department to preside over and coordinate with the Department of Natural Resources and Environment, Dien Ban Town People's Committee, and the Provincial Civil Judgment Enforcement Department to inspect and review the seizure of assets at the An Cu 1 Residential Area project to fulfill tax obligations to the State and enforce judgments according to the provisions of law.
As VTC News has reported many times, 3 projects in Dien Ban town including: Urban Area 7B expansion, Bach Dat urban area and Hera Complex Riverside urban area have a dispute between Bach Dat An Joint Stock Company (investor) and Hoang Nhat Nam Investment Joint Stock Company (broker). This is considered the largest real estate dispute in the Central region with about 1,100 plots of land sold, earning about 700 billion VND.
After many trials from the first instance to the appeal, the People's Courts at all levels rejected the lawsuit of Bach Dat An Joint Stock Company, forcing this enterprise to continue to perform the contract, quickly implement the projects, and hand over land and red books to the people. However, to date, the investor has not yet handed over land and land use right certificates to customers who bought land at the project.
