At the conference on transferring the Market Management Department (QLTT) of provinces and centrally-run cities to local management, on the afternoon of March 17, Mr. Tran Huu Linh, Director of the Department of Domestic Market Management and Development (Ministry of Industry and Trade) said that currently 62/63 provinces and cities nationwide have signed the transfer.
Decree 40/2025/ND-CP stipulates that the Ministry of Industry and Trade performs the function of state management of industry and trade, including market management. Accordingly, the market management force has the function of inspecting and providing direct guidance; presiding over and coordinating with ministries, branches and localities in the fight against counterfeit goods; and has the function and task of directing, supervising and inspecting forces nationwide.
The responsibility of the Market Management remains unchanged.
Director Tran Huu Linh noted that changing the model requires avoiding localization, ensuring connectivity and coordination between localities and the Ministry of Industry and Trade in the fight against counterfeit goods, smuggling and trade fraud.
He also pointed out that violations are becoming increasingly sophisticated and complicated; counterfeit goods and goods infringing on industrial property rights and intellectual property rights are increasing. In addition to the acts taking place in the traditional environment, e-commerce is also posing many challenges for market management forces.
"There is a change in the organizational model but the color and responsibility of the Market Management Department has not changed. There needs to be closer coordination between the People's Committees of the provinces and the Department of Domestic Market Management and Development as well as the Ministry of Industry and Trade," Mr. Linh emphasized.
At the conference, Minister of Industry and Trade Nguyen Hong Dien said that after 68 years of construction and development, the Market Management Department has become the main force in the fight against smuggling, trade fraud and counterfeit goods in the domestic market. Along with that, the force has affirmed its important role in contributing to stabilizing the market, protecting domestic production and consumption.
However, Minister Nguyen Hong Dien also pointed out that market management and local market management forces still have limitations that need to be improved and lessons learned to perform assigned functions and tasks in the new period.
To meet the requirements of national development in the new era - the era of national development, the Party and the State have had important policies on continuing to innovate, arrange and consolidate the organization of the political system, ensuring streamlining, effective and efficient operations. In particular, directing the termination of the organizational model of the General Department of Market Management and transferring local Market Management Departments to the People's Committees of provinces and cities for management. This aims to enhance proactiveness, flexibility, closely grasp the market situation, and be able to respond more quickly and effectively to local market fluctuations.
On February 26, the Government issued Decree No. 40 on the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade. Accordingly, the Ministry of Industry and Trade is assigned by the Government to perform state management of market management. The market management force continues to carry out the tasks of market inspection and control, combating smuggling, trade fraud, counterfeit goods and protecting consumer rights.
Therefore, the transfer will not change the core mission of the Market Management Force. However, the transition to a new operating model will require the Market Management Force to adapt quickly and be ready to innovate working methods to suit the new mission.
Localities need to coordinate closely with the Ministry of Industry and Trade.
Therefore, the Minister requested the People's Committees and Steering Committees 389 of provinces and cities to continue to closely coordinate with the Ministry of Industry and Trade in advising, promulgating or amending and supplementing current legal regulations and policy mechanisms in domestic market management.
Focus on handling issues related to the handover of financial management, budget, public assets and the transfer of public investment project management from the Market Management Departments to local management; at the same time, promptly complete the organizational structure and personnel work so that the Market Management Sub-Departments can stabilize their apparatus and not let their market inspection and control work be affected or interrupted.
In addition, it is necessary to direct local departments, agencies and functional branches to pay attention to and coordinate with market management forces to promote the full strength of the units to perform well the assigned tasks, especially the issue of effective use of assets and finance.
"I believe that with good traditions, efforts and sense of responsibility, in the new period, the Market Management force will continue to inherit and promote the achievements, become the core force in Market Management, build a healthy business environment, protect consumer rights and promote the development of production and business in the country," Minister Nguyen Hong Dien expected.
