According to the indictment, at around 9:00 p.m. on February 5, 2023, Nguyen Phuoc Tan was drinking with friends at his house in Village 1, Kon Dao Commune when Mr. Nguyen Phuoc Tu (Tan's biological father) returned from hanging out. Tan and his friends stopped drinking and went home, leaving only Y Kieu at Tan's house.

While Tan was cleaning, Mr. Tu yelled and scolded him for drinking alcohol and not doing his job. An argument broke out between Tan and Mr. Tu. Tan angrily went into his bedroom, grabbed a sharp knife and stabbed Mr. Tu in the left chest. Tan stepped back and continued to stab Mr. Tu with the knife again, but was stopped by Y Kieu, so Tan did not stab Mr. Tu. After being stabbed by Tan, Mr. Tu was taken to the Dak To District Medical Center for emergency treatment, then transferred to the Provincial General Hospital for treatment, with the result that Mr. Tu suffered 12% physical injury.

Based on aggravating and mitigating circumstances, the Provincial People's Court sentenced defendant Nguyen Phuoc Tan to 12 years in prison for the crime of "Murder" as prescribed in Article 123 of the Penal Code.
