The proposal to streamline some cases of commune-level officials and civil servants has been included by the Ministry of Home Affairs in the draft Law on Civil Servants (amended) which is being consulted by the Ministry of Home Affairs.

The revised Law on Cadres and Civil Servants drafted by the Ministry of Home Affairs will be submitted to the National Assembly at its upcoming 9th session. The draft law was developed according to Conclusion No. 127 of the Politburo, the Secretariat and the direction of the Party Secretary and the Prime Minister.
Compared to the current Law on Cadres and Civil Servants, the draft law removes one chapter on commune-level cadres and civil servants, and amends regulations related to cadres and civil servants when organizing two-level local governments, including provincial and grassroots levels.
The draft sets out four principles for civil servant recruitment, including: publicity, transparency, objectivity and compliance with the law; ensuring competitiveness; selection according to job position requirements; prioritizing the selection of talented people, people with contributions to the country, and ethnic minorities.
In addition, assessment and testing are also regulated to implement the mechanism of screening the team according to the principle of competition, with entry and exit, promotion and reduction. Regular testing aims to ensure the ability to filter and select a team that is proficient, qualified, virtuous and talented enough to serve the task; at the same time, to resolve the situation of avoidance, pushing, procrastination, and the mentality that once in the State, it is safe due to the elimination mechanism not being strong enough.
Notably, the draft law also stipulates transitional provisions, stating that commune-level cadres and civil servants according to the provisions of the 2008 Law on Cadres and Civil Servants (amended and supplemented by the law amending and supplementing a number of articles of the Law on Cadres and Civil Servants and the Law on Public Employees in 2019) from the effective date of this law are on the payroll of the province or centrally-run city; their salaries are arranged according to the salary scale and grade corresponding to the assigned job position if they meet the standards and conditions required by the job position.
Recruitment, use and management of commune-level cadres and civil servants shall comply with Government regulations on recruitment, use and management of civil servants.
In case of not meeting the standards and conditions required by the job position, the competent authority shall consider and decide on streamlining according to the provisions of law at the time of streamlining.
The Ministry of Home Affairs proposed that the Government develop a roadmap and issue regulations to gradually transform the management of civil servants according to job positions within 5 years from the effective date of this law.
During the 5-year period, the management of staff, recruitment, management and use of civil servants will continue to be implemented according to Government regulations.
