Regulations on license plates put up for auction?

According to Article 2 of Resolution 73/2022/QH15, the license plates of cars put up for auction are regulated as follows:

(i) The license plates of automobiles put up for auction are license plates with a white background and black letters and numbers, except for license plates issued to automobiles of military enterprises doing business , automobiles of projects, economic organizations in joint ventures with foreign countries, automobiles of foreign organizations and enterprises, diplomatic missions, consular missions, representative agencies of international organizations and foreigners working in foreign and international agencies and organizations operating in Vietnam.

(ii) The selection of car license plates to be auctioned is regulated as follows:

- The Ministry of Public Security and the property auction organization are responsible for publicizing the license plates of cars specified in Clause (i) that have not been registered and are expected to be newly issued on the national electronic information portal on property auctions, the electronic information portal of the Ministry of Public Security, the electronic information page of the Traffic Police Department and the online electronic information page of the property auction organization;

- Organizations and individuals are allowed to choose car license plates of provinces and centrally-run cities to register to participate in the auction;

- License plates of cars that are not selected for auction, license plates of cars that are not successfully auctioned will be immediately transferred to the vehicle registration and management system for registration according to regulations.

(iii) During the implementation of Resolution 73/2022/QH15, the Ministry of Public Security shall select an asset auction organization from among asset auction organizations with an online auction website, ensuring safety and network security conditions when connecting to the vehicle registration and management system to organize the auction of automobile license plates.

Can I resell a beautiful license plate that I won at auction?

Pursuant to Clause 2, Article 6 of Resolution 73/2022/QH15, the obligations of the person winning the auction of car license plates include:

- Pay the full amount of the auction winning price within 15 days from the date of the document approving the auction results; the auction winning price does not include the registration fee and license plate fee for the car;

- Carry out the procedure for registering the car to attach the auction winning license plate within 12 months from the date of receiving the document confirming the auction winning car license plate;

In case of force majeure or objective obstacles, this period may be extended but not more than 06 months.

After the prescribed time limit, if the auction winner does not complete the car registration procedure to attach the auction winning license plate, the auction winning license plate will be transferred to the vehicle registration and management system and the auction winner will not be refunded the auction winning amount paid;

- The license plate of the auction-winning car cannot be transferred, exchanged, given away, or inherited, except in the case of transferring, exchanging, giving away, or inheriting the car with the auction-winning license plate.

Thus, according to the above regulations, the owner of a car that wins the auction for a beautiful license plate is not allowed to transfer, exchange, give away, or inherit the license plate of the car that won the auction, but is only allowed to transfer, exchange, give away, or inherit the car with the license plate that won the auction.

If I win the auction for a nice license plate but don't pay the full amount, will I be fined?

Article 19 of Decree 39/2023/ND-CP stipulates the cases of auction result cancellation as follows:

- Auction results are canceled in cases specified in the Law on Property Auction 2016.

- The auction winner who does not confirm the auction minutes is considered to not accept the contract for the sale of the auctioned property.

- The announcement of auction results and the document confirming the license plate number of the auctioned car will be canceled in the following cases:

+ The auction winner does not pay the full auction winning amount within 15 days from the date of announcement of the auction result;

+ The auction winner does not complete the procedure to register the license plate of the auction-winning car within 12 months from the date of receiving the document confirming the license plate of the auction-winning car;

In case of force majeure or objective obstacles, this period may be extended but not more than 06 months.

+ The auction winner violated the honesty of the auction registration documents.

- The license plate of the car winning the auction will be put up for auction again; the deposit and the winning bid that the auction winner has paid will not be refunded and will be paid into the state budget in the cases as prescribed above.

Thus, in case the person who wins the auction for a beautiful license plate does not pay the full amount as prescribed above, the auction will be canceled, and the deposit of the auction winning amount that the auction winner has paid will not be refunded and will be paid into the state budget.

Accordingly, currently, there is no regulation that stipulates that the person who wins the license plate auction but does not pay the full amount will be punished. Therefore, in the case that the person who wins the license plate auction does not pay the full amount of the auction within the prescribed time limit, he/she will only lose the deposit and the auction winning amount paid.
