'Over 12 million comments on the draft Land Law, how many opinions agree?'

Commenting on the draft revised Land Law on the morning of June 9, delegate Ha Sy Dong said that the Land Law is a “massive, complicated” law project that requires time to study thoroughly. However, the completed documents were sent to the delegates too late, the submission was only completed on May 29, and the review agency also completed the review report late, only 3 days ago.

He also said that the contents put forward for public opinion do not have sufficient documents for people to refer to, deeply understand, and thoroughly understand the revised and supplemented policies, thereby making realistic suggestions.

In particular, delegate Ha Sy Dong also stated that, out of 12.1 million comments, according to the report, there were 1.22 million comments related to compensation, support, and resettlement; land allocation, land lease, and land use purpose change had 1.06 million comments...

“However, the most important information, for example, out of the 1.2 million comments on compensation, support, and resettlement, how many opinions agree with the provisions of the draft? Similarly, the same goes for other contents, from which delegates will grasp the wishes of voters to consider their opinions at this session,” Mr. Dong said, and said that complaints and denunciations related to the land sector account for 70-80%, and this law amendment must reduce them.

Regarding specific contents, the Quang Tri delegation also agreed with the content of the Economic Committee's audit report, expanding the subjects receiving the transfer of agricultural land use rights, including rice land.

According to the draft law, the conversion of land use purposes for rice fields, protective forests, special-use forests, and production forests must comply with criteria and conditions set by the Government. Mr. Dong said that this provision is more specific than the previous draft that solicited public opinions, demonstrating strong decentralization to localities.

The current law strictly stipulates that the management of changing the purpose of land use (rice land, special-use forest land, protective forest land over 20 hectares, production forest land is natural forest) must be approved in writing by the Government.

"The current excessive central management does not promote local creativity and initiative, increasing social costs," Mr. Dong said, but also said that we should not think that the Central will "leave" this matter to the localities.

Sanctions need to be prescribed when compensation and resettlement are slow.

Commenting on the content of compensation and resettlement when land is recovered, delegate Tran Thi Hong Thanh (Ninh Binh delegation) said that if the payment of compensation is delayed due to the fault of the state agency, it is necessary to define responsibility and have specific sanctions.

Besides, according to Ms. Thanh, regarding the regulations on land recovery for socio-economic development, it is necessary to clearly institutionalize which cases of land recovery are for national defense and security purposes, and which cases are for socio-economic development for national and public interests.

Sharing this view, delegate Dao Chi Nghia (Can Tho delegation) also requested that the draft law explain more clearly the land recovery for socio-economic development projects, for national and public interests.

The reason, according to him, is that unclear regulations can easily lead to illegal land reclamation, ineffective use, and affect the rights of land users. In addition, corruption and negativity can easily arise, and it is difficult to get the consent of people whose land is repossessed.

The issuance of land price lists also has a profound impact, directly affecting the lives of local people and the local people. Therefore, it is necessary to supplement the basis of local socio-economic development indicators such as growth rate, land use structure, poverty rate, etc.
