Timely removal of difficulties and problems
Chairing the meeting, Vice Chairman of the National Assembly Nguyen Khac Dinh said that the Resolution of the 7th session of the National Assembly required that the arrangement of administrative units (ADUs) at district and commune levels for the 2023-2025 period must be basically completed by September 2024, ensuring organizational stability for localities to hold Party congresses at all levels in 2025.
According to the Government's statistics, so far, only 43/54 provinces and cities with administrative units subject to reorganization in the 2023-2025 period have completed the Project on reorganization of administrative units at district and commune levels and sent it to the Government, of which 23/54 localities are facing difficulties and obstacles in completing the project dossier on reorganization of urban administrative units, focusing mainly on the content related to the requirement to ensure compliance with the planning approved by competent authorities and the completion of the review and assessment of the level of urban infrastructure development and urban classification. Therefore, it is necessary to have solutions to promptly remove the above difficulties and obstacles for localities, otherwise it will be very difficult to complete the reorganization of administrative units at district and commune levels in the 2023-2025 period according to the schedule required by the National Assembly.
Vice Chairman of the National Assembly Nguyen Khac Dinh also said that at the 33rd session (May 2024), the National Assembly Standing Committee clearly stated the requirements for the above issue, submitting the Resolution according to the shortened procedures. Therefore, the Government's dossier submitted at the session met the requirements and was within its authority.
Discussing at the meeting, delegates focused on giving opinions on the necessity of issuing the Resolution, the basic content of the draft Resolution;.. In which, they contributed comments and analyzed to clarify 03 proposed solutions. Specifically: The draft Resolution allows parallel implementation of 02 processes of establishing, appraising, and recognizing the results of evaluating criteria for urban classification, assessing the level of urban infrastructure development with the work of establishing and appraising the project for arranging administrative units instead of having to complete the process of assessing and classifying urban areas before starting to establish and appraise the project for arranging administrative units.
In addition, some existing plans approved by competent authorities may be used; In case the project to arrange district and commune-level administrative units must be submitted to the National Assembly Standing Committee but the urban classification procedures have not yet been completed, it is allowed to extend the time to complete the urban classification for towns expected to be formed after the arrangement;...
Speaking at the meeting, Vice Chairwoman of the National Assembly Nguyen Thi Thanh expressed her agreement with the necessity of issuing the Resolution based on the Government's proposal and highly appreciated the very active preparation process and responsible coordination "from early on, from afar" of the Standing Committee of the Law Committee. "This is an important issue and is also the content that many National Assembly deputies are interested in questioning during the Question and Answer Session at the 36th meeting of the National Assembly Standing Committee...", the Vice Chairwoman of the National Assembly said.
Agreeing with many proposed revisions of the Standing Committee of the Law Committee, the Vice Chairman of the National Assembly said that this resolution takes effect from the date of signing and proposed to study and supplement transitional provisions to resolve some specific cases.
Receiving the opinions of the National Assembly Standing Committee at the meeting, Minister of Construction Nguyen Thanh Nghi emphasized that regarding the upcoming work, the Ministry of Construction and the Ministry of Home Affairs will coordinate with the National Assembly's Law Committee to continue reviewing and perfecting the regulations to ensure strictness and compliance with the requirements as concluded by the National Assembly Standing Committee to soon submit for signing and promulgation of the resolution.
Reporting at the meeting, Deputy Minister of Home Affairs Nguyen Duy Thang also said that localities are currently actively implementing the arrangement of administrative units, however, urban procedures are very complicated and still have problems. Therefore, immediately after the resolution is issued, the Ministry of Home Affairs and the Ministry of Construction will notify localities to urgently implement and promptly remove current difficulties and problems.
Allows parallel implementation of 02 urban classification processes and administrative unit arrangement
Concluding the meeting, Vice Chairman of the National Assembly Nguyen Khac Dinh stated that the National Assembly Standing Committee highly appreciated the Government, especially the presiding agency - the Ministry of Home Affairs, and the examining agency - the Law Committee, for closely coordinating in implementing Notice 3691 dated May 23, 2024 of the National Assembly Standing Committee allowing the Government to submit resolutions according to the shortened process and procedures. The submitted documents ensure completeness, authority, and compliance with the requirements of the Law on Promulgation of Legal Documents.
The National Assembly Standing Committee also basically agreed on the content of the draft resolution with 4 main contents. In particular, it allows the parallel implementation of 2 processes, establishing, appraising, and recognizing the results of urban classification criteria, assessing the level of urban infrastructure development at the same time as the establishment and appraisal of the Project on administrative unit arrangement. At the same time, it is allowed to use a number of plans approved by competent authorities as a basis for assessing urban classification criteria to serve the arrangement of administrative units.
In addition, when it is time to submit to the National Assembly Standing Committee the Project on rearranging administrative units and district-level urban units but the decision on urban classification has not been signed, it is allowed to extend the time to complete the signing procedure.
The Standing Committee of the National Assembly also proposed to amend the name of the resolution as proposed by the Law Committee to make it concise, clear, and to clarify the provision on the transfer of the Government's responsibilities;...
At the meeting, with 100% of the members of the National Assembly Standing Committee voting in favor, the National Assembly Standing Committee approved the draft Resolution submitted by the Government, which was revised and completed by the Standing Committee of the Law Committee and other agencies.
Vice Chairman of the National Assembly Nguyen Khac Dinh also said that the National Assembly Standing Committee assigned the Standing Committee of the Law Committee to preside over and coordinate with relevant agencies to receive opinions from the National Assembly Standing Committee, complete the Resolution text and carry out procedures to submit to the National Assembly Chairman for consideration and signing according to regulations.
