On October 9, the Central Council for Coordinating the Dissemination and Education of Law organized the 2024 Business and Law Forum with the theme "Joining hands to solve legal issues, contributing to creating a favorable investment and business environment for enterprises". The forum was organized in person and online with 63 connecting points of provinces and cities.
The forum was attended and directed by Deputy Prime Minister Le Thanh Long - Chairman of the Central Council for Coordinating the Dissemination and Education of Law.
A bridge to "listen to each other's voices"
This is the second time the Forum has been held, as an activity under the Inter-sectoral Legal Support Program for Small and Medium Enterprises for the period 2021 - 2025. At the same time, the theme and content of the Forum closely follow the direction of General Secretary and President To Lam at the 10th Central Conference of the 13th tenure: "Highly unifying to determine stronger breakthroughs in development institutions, removing bottlenecks and barriers, taking people and businesses as the center".
Speaking at the opening of the Forum, Minister of Justice Nguyen Hai Ninh said that the 2024 Business and Law Forum was organized to create a bridge for competent authorities and businesses to "listen to each other's voices"; continue to jointly identify legal issues related to production and business activities in the current context and propose recommendations and solutions to improve the legal system.
At the same time, continue to affirm the commitment to always accompany and protect the legitimate rights and interests of enterprises in any circumstances; always listen, share difficulties and join hands to overcome difficulties and challenges together.
“The Central Council for Coordinating Law Dissemination, ministries, branches and localities are ready to accompany, closely follow and work with the business community to “completely resolve” the difficulties and legal issues that the business community faces, contributing to creating a truly open and favorable investment, production and business environment” - the Minister of Justice pledged.
The Business and Law Forum focused on discussing two major issues: Solving some legal issues regarding investment projects using land and legal issues regarding taxes and solutions.
Investment procedures are like a " maze "
Speaking at the Forum, Chairman of the Vietnam Association of Construction Contractors Nguyen Quoc Hiep reflected that there are currently 15 laws "intervening" in real estate. Previously, each ministry and sector drafted a law, so there was a lack of uniformity and consistency among the laws. Recently, the laws (Land Law, Real Estate Business Law, Housing Law) were revised to be consistent and to limit the lack of uniformity among the laws. However, the law drafting agency is not really close to reality.
Mr. Nguyen Quoc Hiep cited that administrative procedures for site clearance and dialogue with the people currently face many obstacles. After fully informing local organizations and authorities, investors must wait 60 days before they can have a dialogue with the people.
“Our project has 177 steps, 360 days are enough for dialogue and enforcement. Site clearance procedures are a burden that real estate businesses have to endure. Regarding administrative procedures, some projects require 38-40 seals" - Mr. Hiep stated the current situation; at the same time, he suggested that although there is a model process to resolve administrative procedures, this process needs to be re-examined because there are no sanctions, causing the procedures to be prolonged. Meanwhile, every project has to adjust the planning, many things are not important but must be completed at all levels, then the investment policy must be adjusted. Only when doing it can we see the difficult reality, the procedures are like a maze.
Discussing some questions, Deputy Minister of Planning and Investment Nguyen Thi Bich Ngoc affirmed that the investment and business environment has been reviewed and reformed a lot recently. When approving large-scale projects with spillover effects and socio-economic development, it is necessary to anticipate the impacts on the environment and society, and to consider and evaluate them carefully.
