(MPI) - According to the 2024 Work Summary Report and the key directions and tasks for 2025 of the National Steering Committee on Collective Economy, the Steering Committee has proactively and actively advised the Government and the Prime Minister on many policies and solutions to remove difficulties and promote production and business; documents guiding the implementation of the 2023 Law on Cooperatives have been fully issued, creating a synchronous and favorable legal corridor to help the collective economy and cooperative sector develop quickly and sustainably.

2024 is the first year of implementing the Law on Cooperatives 2023. Pursuant to Decision No. 857/QD-TTg dated July 18, 2023 of the Prime Minister, the Ministry of Planning and Investment has issued or submitted to competent authorities for issuance of documents guiding the implementation of the Law on Cooperatives 2023: Decree No. 113/2024/ND-CP dated September 12, 2024 detailing a number of articles of the Law on Cooperatives; Decree No. 92/2024/ND-CP dated July 18, 2024 on registration of cooperative groups, cooperatives, and cooperative unions; Circular No. 09/2024/TT-BKHĐT dated May 16, 2024 promulgating forms for performing procedures for registering cooperative groups, cooperatives, and cooperative unions and regulations on information content, updating, exploitation and management of the National Information System on Cooperatives. The Ministry of Finance issued Circular No. 71/2024/TT-BTC dated October 7, 2024 on guidance on the accounting regime for cooperatives and cooperative unions.
Thus, up to now, the legal system of guiding documents according to the requirements of the Law on Cooperatives 2023 has been issued in accordance with regulations, contributing to bringing the policies and regulations of the Law into life.
Immediately after the Law on Cooperatives 2023 was promulgated in June 2023, the work of disseminating and popularizing the Law was organized and implemented nationwide by the Ministry of Planning and Investment in coordination with relevant agencies and localities, while integrating with the work of soliciting opinions on the draft Decree detailing a number of articles of the Law on Cooperatives. After Decree No. 113/2024/ND-CP dated September 12, 2024 of the Government detailing a number of articles of the Law on Cooperatives was promulgated, the Ministry of Planning and Investment issued Official Dispatch No. 7682/BKHĐT-KTHT dated September 23, 2024 to ministries, branches and localities to disseminate and implement the Decree synchronously and promptly.
Implementing Resolution No. 20-NQ/TW, the Ministry of Planning and Investment has presided over and coordinated with ministries, branches and localities to develop, advise and submit to the Government for promulgation Resolution No. 09/NQ-CP dated February 2, 2023 on the Government's Action Program to implement Resolution No. 20-NQ/TW. The Government's Action Program has developed specific tasks and solutions closely following the tasks and solutions in Resolution No. 20-NQ/TW. On that basis, the Program proposes 5 groups of solutions with 48 main projects and tasks to implement Resolution No. 20-NQ/TW.
Implementing Resolution No. 09/NQ-CP dated February 2, 2023 of the Government, ministries, branches and local People's Committees have developed action programs, with diverse forms of propaganda, dissemination and implementation of the Resolution and assigned tasks to agencies and units according to the principle of clear people, clear work, clear responsibilities and clear products.
Regarding the implementation of the 5-year Plan for the period 2021-2025 and the Strategy for Developing the Cooperative Economy for the period 2021-2030, implementing Decision No. 340/QD-TTg dated March 12, 2021 and Decision No. 1318/QD-TTg dated July 22, 2021 of the Prime Minister: localities have developed and issued plans for developing the cooperative economy of the province and city with tasks and solutions to achieve the highest results in meeting the set goals. However, due to the impact of the complicated developments in the world situation in the 2021-2025 period, the Covid-19 pandemic, climate change, and unusual natural disasters, according to the estimates of the Ministry of Planning and Investment, by the end of 2025, many key targets of the 5-year plan are expected to not reach the targets approved by the Prime Minister in Decision No. 1318/QD-TTg.
Implementing the Program to support the development of collective economy and cooperatives for the period 2021-2025 issued together with Decision No. 1804/QD-TTg dated November 13, 2020 of the Prime Minister, the Ministry of Planning and Investment has sent a document to ministries, branches and localities to urge the implementation of the contents of the Program.
In Resolution No. 09/NQ-CP dated February 2, 2023, the Government also assigned the Ministry of Planning and Investment, the Ministry of Finance, the National Target Program owners and localities to be responsible for arranging the medium-term and annual state budget to support the development of collective economy and cooperatives.
According to Decision No. 1535/QD-TTg dated September 15, 2021 of the Prime Minister on assigning the medium-term public investment capital plan for the period 2021-2025, there are 02 projects using capital from the Cooperative Support sector according to the Law on Cooperatives with a total assigned medium-term capital of 734.5 billion VND; 01 investment task is to supplement the charter capital for the Cooperative Support Fund with a total capital of 550 billion VND.
In general, the medium-term capital to support cooperatives is not much (VND 1,284.5 billion), no locality has been recorded to allocate capital to support cooperatives from the medium-term public investment plan for the period 2021-2030 (except for capital from the national target program). However, so far, only the task of supplementing charter capital for the Cooperative Support Fund has been completed; the project by the Ministry of Agriculture and Rural Development is expected to be completed in 2025; the project invested by the Vietnam Cooperative Alliance has not been completed, still in the investment preparation stage.
Implementing Decision No. 167/QD-TTg dated February 2, 2021 of the Prime Minister approving the Project "Selecting, perfecting, and replicating effective new-style cooperative models in localities across the country in the period of 2021-2025", localities have basically completed phase 1 (approving the list of cooperatives participating in the project). However, some localities such as Ba Ria - Vung Tau could not select cooperatives to participate in the Project because they did not have cooperatives meeting the conditions and criteria as prescribed.
In general, cooperatives participating in the Project have received attention and support from local authorities to improve production and business efficiency, continue to improve to become pilot models, and serve as a basis for replication. However, most localities and cooperatives are still confused in implementing phase 2 of the Project (approving the Decision on the plan to complete selected cooperative models; or approving but not having funding sources to implement support...).
Implementing Decision No. 854/QD-TTg dated July 19, 2022 of the Prime Minister approving the "Project to improve climate change adaptation capacity of agricultural cooperatives in the Mekong Delta, period 2021-2025", the Ministry of Agriculture and Rural Development issued Decision No. 1949/QD-BNN-KTHT dated May 18, 2023 promulgating the Implementation Plan of the Ministry of Agriculture and Rural Development to carry out assigned tasks.
Implementing Decision No. 01/QD-TTg dated January 3, 2023 of the Prime Minister approving the Project "Supporting Cooperatives managed by women, creating jobs for female workers by 2030", the Central Women's Union issued Plan No. 436/KH-BDH dated January 30, 2024 on the activities of the Project's Steering Committee in 2024.
The Central Committee of the Vietnam Women's Union has actively coordinated with relevant ministries and branches in the implementation of the Project. At the same time, the Central Committee of the Union also directed all levels of the Union to proactively develop plans, specify the contents of the Project, and strengthen coordination with local departments and branches in implementing the Project in localities.
Implementing Decision No. 182/QD-TTg dated February 20, 2024 of the Prime Minister approving the Project "Vietnam Farmers' Union participates in developing collective economy in agriculture for the period 2022-2030", the Central Committee of the Vietnam Farmers' Union issued Plan No. 16-KH/HNDTW dated March 8, 2024; organized a conference to disseminate to all officials of the Central Committee of the Union and Farmers' Unions of 63 provinces and cities; organized the signing of a coordination program with the Vietnam Cooperative Alliance on participating in developing collective economy in agriculture for the period 2024-2030.
The Ministry of Planning and Investment has issued a document urging localities to thoroughly handle cooperatives that have ceased operations and are awaiting dissolution in their localities according to the new regulations of the 2023 Law on Cooperatives. It is expected that in 2025, localities will organize the dissolution of cooperatives according to the new regulations mentioned above. Based on the review and synthesis of the dissolution of cooperatives that have ceased operations and difficulties in dissolution, the Ministry of Planning and Investment will study and propose appropriate solutions to thoroughly handle the model of cooperatives that have ceased operations for a long time, improving the environment and creating room for newly established cooperatives.
The Ministry of Planning and Investment has advised the Government to issue documents guiding the implementation of the Law on Cooperatives in 2023: Decree No. 113/2024/ND-CP dated September 12, 2024 of the Government detailing a number of articles of the Law on Cooperatives; Decree No. 92/2024/ND-CP dated July 18, 2024 of the Government on registration of cooperative groups, cooperatives, and cooperative unions; promulgation of Circular No. 09/2024/TT-BKHĐT dated May 16, 2024 on forms for carrying out procedures for registration of cooperative groups, cooperatives, and cooperative unions.
Pursuant to the Prime Minister's direction in Official Dispatch No. 2521/VPCP-NN, the Minister of Planning and Investment, authorized by the Prime Minister, signed on behalf of the Government a report to the National Assembly Standing Committee on the implementation of 03 tasks assigned by the National Assembly Standing Committee (Report No. 179/BC-CP dated April 25, 2024 of the Government). In particular, the Government has proposed a specific implementation plan for the 03 tasks. Immediately after receiving comments from the National Assembly Standing Committee, the Ministry of Planning and Investment will continue to implement according to the plan.
Review, systematize, and codify legal documents: The Ministry of Planning and Investment has presided over and coordinated with relevant ministries and branches to codify the topic of cooperatives in accordance with regulations. On September 19, 2024, the Government issued Resolution No. 146/NQ-CP on approving the results of codifying the system of legal documents on the topic of cooperatives.
The Ministry of Planning and Investment organized the 2024 Cooperative Economic Forum chaired by the Prime Minister with the theme "Improving the State's support policies according to Resolution No. 20-NQ/TW dated June 16, 2022 - Driving force to promote the development of collective economy and cooperatives in the new period". Based on the Prime Minister's conclusion at the Forum, the Ministry of Planning and Investment coordinated with the Government Office to submit and issue Notice No. 132/TB-VPCP dated April 1, 2024 on the Conclusion of Prime Minister Pham Minh Chinh at the 2024 Cooperative Economic Forum; issued Document No. 6569/BKHĐT-KTHT in response to local recommendations at the 2024 Cooperative Economic Forum.
Advise on the implementation of the consolidation of the National Steering Committee on Collective Economy; develop and promulgate the 2024 Collective Economy and Cooperative Development Plan; promulgate the 2024 Cooperative White Book; promulgate the Postgraduate Training Program on Collective Economy (under the Academy of Development Policy)... Overall assessment, according to the assignment of the Government in Resolution 09/NQ-CP, the Ministry of Planning and Investment has completed 13/18 assigned tasks; 05/18 tasks are being implemented. The basic tasks were completed on schedule and the quality was ensured according to regulations./.
