E-commerce is becoming an important distribution channel, supporting businesses to sell products, meeting people's needs and contributing to the development of financial services and electronic payment services. However, the rapid development of this activity is also posing challenges to the management of goods quality, especially in preventing tax losses.
Business establishments sign a commitment to comply with the law with Market Management Team No. 13.
According to statistics from the National Competition Commission (Ministry of Industry and Trade), e-commerce currently ranks second among 22 groups of goods with the most complaints from consumers due to goods not being as described; businesses not resolving complaints satisfactorily or being taken advantage of by sellers to appropriate property. In 2023 alone, the market management force (QLTT) nationwide inspected and handled up to 764 cases of e-commerce violations, imposing fines of 12 billion VND.
According to the provincial Market Management Department, implementing the plan to inspect and handle websites with signs of violating the law, since the beginning of the year, the unit has directed Market Management Team No. 10 to coordinate with relevant agencies to deploy professional measures, urgently organize inspections of websites for strict handling. The results of the verification and examination showed that 8/9 websites violated; of which, 1 website no longer exists on the internet system; 1 website has no basis to determine the actual address and the website owner or the person residing at the verified address does not know the website and the phone number listed on the website. The authorities have fined the violating individuals and organizations a total of 127.5 million VND.
Typically, Market Management Team No. 10 issued a decision to impose an administrative fine of VND 15 million on Ms. Cao Thi Thuy, residing in Truong Son Ward, Sam Son City, for not notifying the e-commerce website or sales application to the competent State management agency as prescribed. In addition, Ms. Thuy did not register to establish a business profile in cases where business registration is required at Thanh Huyen Cosmetics business establishment, located at No. 1 Nguyen Trai, Truong Son Ward, Sam Son City. This behavior was fined VND 7.5 million by Market Management Team No. 10, forcing her to establish a business household as prescribed. The total amount Ms. Thuy was fined for the two violations was VND 22.5 million.
On June 12, Market Management Team No. 10 also issued a decision to administratively sanction the business household Tamed, located at Lot 831, Planning Area 530, Dong Ve Ward, Thanh Hoa City, for not notifying the e-commerce website to the competent State management agency as prescribed before selling. The location of the violation is at the website: https://thietbiytethanhhoa.com. Based on the violation, the business household Tamed was fined 15 million VND.
Also in the first 9 months of this year, with the support of the inspection and supervision agencies and the State Bank of Vietnam in providing data arising from e-commerce business activities, the Thanh Hoa tax sector has processed and collected billions of VND from a number of individuals involved in e-commerce business activities. A representative of the provincial Tax Department said that they have strengthened connections with relevant ministries and branches, coordinated with the police to use personal identification codes to verify information, and conducted reviews of e-commerce business activities in the area. However, the review and collection work still faces many difficulties due to lack of information as well as not keeping up with technology.
Many opinions say that, for e-commerce to operate healthily, transparently and to prevent tax losses, it is necessary to share more data between sectors. Along with that, it is necessary to have a legal corridor that always keeps up with the development of the market; increase the addition of equipment and training, improve the professional skills of officers performing the tasks. Inspection and examination work also needs to be carried out more promptly to detect violations to make the e-commerce market transparent.
