Building an entire building illegally: 'Tycoon' Le Thanh Than appears in court
At noon on August 10, after more than half an hour of questioning Mr. Le Thanh Than (Chairman of the Board of Directors, General Director of Bemes Company) and a number of victims at the trial of the customer fraud case, the Hanoi People's Court suddenly announced to return the case file for further investigation.
"Due to some issues that could not be clarified in court, the panel of judges requested additional investigation," the presiding judge said, and asked those involved to continue providing evidence to the prosecution agency to serve the additional investigation process.
Previously, at the trial, the presiding judge questioned a number of victims. Ms. Dinh Thi N (in CT6C building) recounted that when she went to the transaction office to sign the contract, she was introduced to the building. Legally, at that time, the investor said and stated in the contract that when the house was handed over, the investor would support the procedures for issuing the red book.
However, when people went to request a certificate, the Hanoi Department of Natural Resources and Environment replied that the building was not granted a certificate because it was built illegally.
Defendant Le Thanh Than in court.
"I see that the defendant has caused us a lot of difficulties. We bought a house more than 10 years ago without confirmation of property ownership, we cannot register our household registration or make birth certificates for our children," Ms. N. stated.
According to the female victim, since 2011, they have not been able to buy another apartment to ensure their livelihood. Residents have also spent effort to claim their rights for the past 10 years without results, which is a loss.
"I request that the panel of judges consider resolving the civil issue right in this trial, not separating it into another case so that we do not have to file a lawsuit again," Ms. N. requested and requested compensation according to the current actual value of the apartment.
In case the victim's requests are not resolved by the defendant, Ms. N. hopes that the court of first instance will consider aggravating circumstances for the defendant.
For her part, Ms. N. wants to be compensated according to the current market value of the apartment in that area, which is about more than 25 million VND/m2. In addition, the victim also requested compensation for interior design costs and mental damage.
Unlike Ms. N., a resident requested the defendant to compensate at a higher price, 34 million VND/m2. This person said that the CT6C building is located in Ha Dong district, more beautiful than other buildings, so the compensation must be higher.
Another person who bought a house at CT6C said that in 2017, he bought an apartment at CT6C Kien Hung for more than one billion VND. In court, this victim asked the defendant to compensate him for the amount he received for transferring the house.
In response to the above requests, the presiding judge asked Mr. Than to state his views. Standing before the court, the "plow tycoon" promised to continue negotiating with residents a fair and reasonable compensation level.
