The number of defendants prosecuted for the correct crime reached 99.9%.

On November 26, the National Assembly listened to the 2024 work report of the Chief Justice of the Supreme People's Procuracy.

Timely prosecution reached 100%

Reporting at the meeting, Chief Justice of the Supreme People's Procuracy Nguyen Huy Tien said that in exercising the right to prosecute, he supervised the reception and handling of 165,377 sources of information about crimes (reaching 100%); directly supervised the handling of 1,877 sources of information about crimes at the Investigation Agency; requested to prosecute 961 cases (an increase of 21.6%); requested to cancel 20 decisions to prosecute cases (an increase of 66.7%) due to not ensuring legal basis; directly issued 21 decisions to prosecute cases and requested the Investigation Agency to conduct investigations according to the provisions of law.

Regarding the practice of the right to prosecute and investigate, according to Mr. Tien, there were 142,946 cases/231,614 defendants (an increase of 6.3% in the number of cases and 10.7% in the number of defendants); 100% of criminal cases were prosecuted right from the time of initiation; 102,584 investigation requests were issued (an increase of 3.5%). 521 orders and decisions to apply preventive measures were not approved; 494 decisions to temporarily detain were cancelled; 24 decisions to temporarily suspend or discontinue the case were cancelled and the Investigation Agency was requested to handle the case in accordance with the provisions of law.

Notably, Mr. Tien informed that the number of cases prosecuted on time reached 100% (exceeding 10%) and the number of defendants prosecuted on the correct charges reached 99.9% (exceeding 4.9%). Through the work of trial supervision, violations were detected and 697 appeal protests were issued, accepted by the Trial Council at a rate of 83.2% (exceeding 13.2%); 95 appeals for final judgment and retrial were issued, accepted by the Trial Council at a rate of 82.5% (exceeding 7.5%).

The work of the Supreme People's Procuracy's Investigation Agency continued to achieve and exceed the targets set by the National Assembly. Accordingly, the rate of investigation and discovery of crimes against judicial activities and corruption in judicial activities reached 92.4% (exceeding 22.4%); the rate of investigation and discovery of very serious and especially serious crimes reached 100% (exceeding 10%); the rate of asset recovery in corruption cases reached 89.2% (up 4.5% and exceeding 29.2%).

Apply security measures to recover more than VND 26,215 billion

The Procuracy also said that it has strengthened coordination with the Ministry of Public Security and the Supreme People's Court to speed up the investigation, prosecution and strict trial of many major corruption and economic cases, cases under the supervision and direction of the Central Steering Committee on Anti-Corruption and Negative Practices. During the investigation, prosecution and trial, measures have been applied to ensure the recovery of more than VND 26,215 billion.

In addition, continue to strengthen the work of supervising temporary detention, temporary detention, execution of criminal sentences, supervising the settlement of administrative cases, civil cases, civil judgment enforcement, and the work of handling complaints and denunciations in judicial activities. Supervise the acceptance and settlement of 12,958 administrative cases under first instance, appeal, review and retrial procedures (up 6.6%); 498,304 civil, business, commercial and labor cases (up 6.3%). Issue 1,653 appeals of civil cases accepted by the Trial Council, 83.3% of which were accepted (exceeding 13.3%); 7 appeals of review and retrial of administrative cases, accepted by the Trial Council, reaching a rate of 77.8% (exceeding 2.8%); issue 18,495 appeals and recommendations to request the correction and prevention of violations and crimes (up 3.8%); The rate of accepted recommendations reached 99.9% (exceeding 19.9%).

However, Mr. Tien assessed that there were still work targets that had not been met according to the requirements of the National Assembly, such as: the rate of appeals for administrative judgments and appeals for final judgments of civil cases; the rate of handling denunciations, reports of crimes, and recommendations for prosecution by the Investigation Agency of the Supreme People's Procuracy; the rate of asset recovery in corruption, position-related economic cases.

On that basis, Mr. Tien recommended that the Government direct ministries and branches to study and synthesize the causes and conditions leading to the increase in crimes, complicated developments, and negative impacts on social order and safety; strengthen inspection and review work to detect and overcome loopholes and shortcomings in State management in all areas; the work of appraisal and asset valuation still has many shortcomings that do not meet the requirements in the fight against criminal cases. From there, build a comprehensive program on crime prevention and combat for local authorities and judicial agencies to strengthen international cooperation to coordinate the application of crime prevention measures in general and high-tech crimes in particular.

In addition, the leader of the Procuracy also proposed that the National Assembly direct the implementation of connecting criminal case data between the Police, the Procuracy, and the Court (it may consider piloting in some localities before officially implementing) and provide funding for purchasing technical equipment and renting software services and transmission lines for effective implementation.
