Many Circulars and Decrees will be issued to smoothly implement the Land Law.

At the regular Government press conference in January 2024, Deputy Minister Le Minh Ngan provided information related to the review of legal documents and sub-law documents (Decrees, Circulars, Decisions, etc.) related to and overlapping with the amended Land Law recently passed by the National Assembly.

Accordingly, the Ministry of Natural Resources and Environment is coordinating with ministries, branches and relevant parties to review and comprehensively amend, avoiding duplication and overlap affecting the implementation of the Land Law from 2025.

According to the leader of the Ministry of Natural Resources and Environment, the revised Land Law also stipulates the content and authority of the Prime Minister, the Government, the Minister, and the Provincial People's Committees.

Due to its complexity, wide scope and impact on many other related sectors and fields, it is necessary to review laws and sub-law documents, abolish overlapping and duplicated provisions and regulations so that the revised Land Law can come into effect and be effectively implemented immediately.

"After reviewing laws and sub-law documents, it is expected that the Government will issue 9 Decrees related to the Land Law, of which the Ministry of Natural Resources and Environment will advise the Prime Minister on 6 Decrees, the Ministry of Finance will advise on the issuance of 2 Decrees, and the Ministry of Agriculture and Rural Development will advise on the issuance of 1 Decree.

In addition to the Decree, ministries, departments and branches are expected to issue 6 more Circulars, of which the Ministry of Natural Resources and Environment will issue 4 Circulars, the Ministry of Finance will issue 1 Circular and the Ministry of Home Affairs will issue 1 Circular to provide detailed guidance on articles and regulations related to the revised Land Law," Deputy Minister Le Minh Ngan informed.

Regarding the current Decree of the Government related to land, the relevant ministries and branches must also continue to review and report to the Government for amendment. In addition, Mr. Ngan said that the Land Law has 18 contents under the authority of the Provincial People's Committee to specify in detail, and 1 content under the authority of the People's Council to promulgate.

"Provinces must also review documents under their authority so as not to obstruct legal regulations," said Deputy Minister Le Minh Ngan.

Previously, to prepare for the dissemination of the basic contents of the 2024 Land Law, the leader of the Ministry of Natural Resources and Environment said that the Ministry had developed a Plan to disseminate, propagate, and guide the implementation of the Land Law, coordinating with agencies and ministries to disseminate and propagate new points; implementation instructions... to ensure feasibility in the implementation process.

The Ministry of Natural Resources and Environment also requested provincial People's Committees to focus on accelerating the progress of preparing and submitting for appraisal of provincial land use plans for the 2021-2025 period; organizing the construction, updating, management and exploitation of land databases within the locality, ensuring that by 2025, they will be connected and integrated with the national land database so that new policies when implemented will ensure consistency.

"All procedures for issuing the Decree have been completed. Up to now, Deputy Prime Minister Tran Hong Ha has directed and agreed that the Ministry of Natural Resources and Environment will coordinate with the Government Office to complete the final stages to issue the Decree as soon as possible and put it into practice," said Deputy Minister Le Minh Ngan.
