The Ministry of Public Security has issued Circular 66/2023/TT-BCA amending and supplementing a number of articles of Circular No. 55/2021/TT-BCA dated May 15, 2021 of the Minister of Public Security detailing a number of articles and measures to implement the Law on Residence; Circular No. 56/2021/TT-BCA dated May 15, 2021 of the Minister of Public Security stipulating forms in residence registration and management; Circular No. 57/2021/TT-BCA dated May 15, 2021 of the Minister of Public Security stipulating the residence registration process. Circular 66/2023/TT-BCA takes effect from January 1, 2024.
Register for residence directly or online via the public service portal
Accordingly, the Circular stipulates that the receipt of residence registration dossiers is carried out directly at the residence registration agency or online via the public service portal, VNeID application, and other online public services as prescribed by law.
In case of submitting the application directly at the residence registration agency, the person requesting residence registration may submit a certified copy of the original document or a copy of the document issued from the original book (hereinafter referred to as a copy) or a scan or photocopied copy with the original document for comparison.
In case the person requesting residence registration submits a scan or photocopy with the original document for comparison, the recipient is responsible for checking, comparing the scan or photocopy with the original and signing the confirmation, and is not allowed to request to submit a copy of that document.
In case of online residence registration, the person requesting residence registration declares information according to the provided electronic form, uploads a scan or photocopied copy of valid papers and documents (not required to be notarized, certified, digitally signed or authenticated in other forms) or cites the source of documents from the Electronic Data Management Warehouse of the organization or individual; pays the fee through the online payment function or by other means as prescribed by law. After completing the application submission, the person requesting online residence registration is given 01 administrative procedure file code to monitor and look up the progress of the application or receive information to supplement and complete the application when requested by the residence registration agency.
In case a citizen uploads a scan or photocopied document or paper without a digital signature or other authentication, when the residence registration authority conducts an inspection or verification to resolve residence procedures; the citizen is responsible for presenting the uploaded document or paper for the residence registration authority to inspect, compare and record the accuracy in the verification record. The residence registration authority does not require the citizen to submit such document for storage.
Confirmation of residence information is valid for one year from the date of issue.
Circular 66/2023/TT-BCA amends and supplements Article 17 confirming information on residence of Circular No. 55/2021/TT-BCA.
Accordingly, citizens can request the residence registration agency nationwide, regardless of their place of residence, to confirm their residence information by requesting directly at the residence registration agency's headquarters or requesting via the public service portal, VNeID application or other online public services as prescribed by law.
The content of confirmation of information on residence includes information on current residence, previous residences, time of residence at each residence, form of residence registration and other information on residence available in the Residence Database and National Population Database.
Confirmation of residence information is valid for one year from the date of issue.
In case the information on a citizen's residence is changed, adjusted and updated in the Residence Database, the confirmation of residence information will be invalid from the time of change or adjustment.
The residence registration authority is responsible for confirming residence information upon request of citizens.
In case the information requiring confirmation of residence is already in the National Population Database, the processing time shall not exceed 1/2 working day.
In case the requested confirmation content is not in the National Population Database or Residence Database, the processing time shall not exceed 03 working days.
Supplementing regulations on temporary residence registration
Circular 66/2023/TT-BCA adds Clause 3 to Article 13 on temporary residence registration of Circular No. 55/2021/TT-BCA:
1- Citizens who change their place of residence outside of their registered temporary residence are responsible for registering a new temporary residence.
In case the accommodation is within the commune-level administrative unit where permanent residence is registered, the provisions in Clause 3, Article 6 of this Circular shall apply.
2- Pupils, students, and trainees living in dormitories and student housing areas; workers living in worker housing areas; children, disabled people, and homeless people who are adopted and living in religious establishments; and people who are cared for, raised, and assisted at social assistance facilities can register for temporary residence through the agency or organization directly managing that accommodation.
The direct management agency or organization is responsible for making a list of temporary residents, along with the Declaration of change of residence information of each person, a request for temporary residence registration clearly stating information about legal residence and the residence registration agency updating information about temporary residence in the Residence Database.
The list includes basic information of each person: last name, middle name and first name; date of birth; gender; personal identification number and temporary residence period.
3- In case the documents proving legal residence for temporary residence registration are documents for renting, lending, or allowing temporary residence of a house or other house of an individual or organization, such documents are not required to be notarized or certified.
