Many projects are slow to implement due to lack of land.

Workers of Construction and Trading Company No. 6 construct the Dynamic Road Project.

The Traffic Road Project connecting key economic areas in the dynamic economic zone along National Highway 279 and National Highway 12 (referred to as the Dynamic Road Project) is invested by the Provincial Traffic Works Project Management Board; implementation period is from 2021 - 2024. The project is implemented in Dien Bien Phu City and Dien Bien District, with a total of more than 1,600 households (mainly in Dien Bien District) whose land and assets on the land must be recovered, compensated, and cleared. The project is divided into 11 construction packages. After nearly 2 years of starting construction (January 2022), many packages have not been able to be constructed due to lack of land. According to the plan, the project construction period is only more than 1 year to be completed, but the progress is slow. From June 2023 to now, almost all bidding packages cannot be constructed due to lack of land.

Accordingly, packages 4, 5 and 6 (NT2+NT3+NT4+NT5 routes in the central political administrative area of ​​the province and NT6 Pom La route) currently do not have construction sites (package 6 alone has about 10% of the site but is interrupted, not synchronized, and cannot move machinery and equipment into construction). Construction contractors have basically completed the production of precast concrete components such as: curbs, culvert bases, pipes, box trenches, technical trenches... but cannot construct because the site has not been handed over. From package 7 to package 10, a part of the site has been cleared but it is interrupted and insignificant, so the contractor has not implemented construction.

There are many reasons, but mainly because the verification of land origin is difficult due to the history of land management. Determining the origin of land use is very complicated such as: Land user, land type, land use boundary, land plot shape compared to the certificate (wrongly issued certificate, land registry book is not entered correctly so it must be adjusted, corrected), land disputes. Therefore, when implementing the completion of land records and implementing in accordance with regulations, there are many difficulties and it takes a lot of time. The amount of work transferred to the People's Committees of wards and communes is very large, while there are few or newly transferred land officers who need time to take over the work, leading to very slow progress in making plans. In addition, some households have not cooperated, some households have moved back to their hometowns, causing difficulties in consolidating legal records. Many households have not agreed with the compensation plan when reclaiming land.

Lack of land is also the main reason why the Nam Thanh B New Urban Area and Commercial Service Project has not been able to start construction yet, despite the adjustment of the detailed planning at a scale of 1/500 for the area along Vo Nguyen Giap Street to Nam Rom River in Nam Thanh Ward, Dien Bien Phu City and the area west of Nam Rom River in Thanh Hung Commune, Dien Bien District. The compensation and site clearance work of this project is according to the detailed planning approved by the province in the investment policy in Decision No. 3394/QD-UBND dated December 31, 2021 (in which, the scale of compensation, support and resettlement on an area of ​​more than 4.88 hectares in Nam Thanh Ward, Dien Bien Phu City, with a total investment of more than 30.8 billion VND, with implementation progress in 2022).

To speed up the progress of land acquisition, the Department of Natural Resources and Environment has contracted the Land Management Center of Dien Bien Phu City to carry out compensation for land acquisition, and regularly coordinate and urge the implementation of land acquisition. Up to now (early September 2023), the compensation, support and resettlement plan of 57/66 households and individuals, with an area of ​​4.26ha/4.88ha, with a value of 18.6 billion VND, has been approved. The compensation and support payment has been coordinated with the amount of 6.39 billion VND/9.35 billion VND. The remaining 9 households with an area of ​​more than 0.32ha are currently completing the draft plan to seek opinions from specialized departments and offices of Dien Bien Phu City.

The reason is that the origin of land use and the time of property creation (housing) are not correct compared to the ownership map through the periods. There are still 41 households that have not received money and handed over the land. For households (15 households) that have recovered over 1,000m2 of land and are households that directly produce agriculture (cultivate, use, and have the main source of income from the recovered land), the State is requested to allocate 1 resettlement land plot to stabilize their lives. At the same time, increase the compensation unit price; recalculate compensation for the affected property (outside the landmark), the renovated and leveled land of the people; the property (housing, architectural works) that has been partially recovered for the A1 - C4 Road Project, the remaining part is self-built and renovated by the people to live in, and it is requested to consider compensation for the people. To speed up the progress of site clearance for this project, the Department of Natural Resources and Environment has coordinated with the Department of Construction, the People's Committee of Dien Bien Phu City, and Nam Thanh Ward to organize a meeting to remove difficulties and obstacles and agree on a solution. At the same time, it is recommended to adjust the detailed planning of the new urban residential area and commercial services Nam Thanh B according to regulations and review the land fund of the project to build a resettlement area for households on the 15m road from A1 bridge to C4 bridge to arrange resettlement, and allocate land with payment to a number of households in the Nam Thanh B project.

Along with the above two projects, currently in the province there are many projects that are behind schedule or have not been implemented due to land issues.

The delay in project progress causes waste of budget, especially in some projects with long-term capital sources, if not implemented soon, there is a risk of having to pay back the capital. In addition, slow-implementation projects have a significant impact on socio-economic development, land resources and the lives of people in the project area, especially for projects with many households and individuals whose land has been recovered.
