Tighter regulations
Accordingly, Decree 61 stipulates more clearly the conditions for individuals to be considered for the title, including: individuals working in cultural and artistic activities at public cultural and artistic units; individuals working in cultural and artistic activities at non-public cultural and artistic units; individuals working in teaching or management in the field of culture and art but still participating in professional cultural and artistic performances, and individuals working in freelance professional cultural and artistic activities.

This regulation helps the grassroots Council to receive applications for individual titles in accordance with reality. At the same time, the subjects "Filming of films combining many types; "Musicians composing musical works" and "Photographers" are added. The addition of subjects is to suit the reality of cultural and artistic activities in some fields and to ensure the rights of individuals working in cultural and artistic activities in considering titles.
The Decree also provides more detailed and specific regulations on how to calculate the time of cultural and artistic activities of individuals performing arts and individuals creating cultural and artistic works to fully cover the conditions for cultural and artistic activities of individuals, especially for individuals working professionally and freelance in cultural and artistic activities.
Regarding the criteria for awarding titles (stipulated in Articles 7 and 8 of the Decree): Regulations on the criteria for awarding the titles "People's Artist" and "Meritorious Artist" according to the provisions of the Law on Emulation and Commendation 2022; detailed regulations on how to calculate achievements and time of each subject.
Accordingly, for individuals considered according to the provisions at Point a, b, Clause 4, Article 7 and Point a, b, c, Clause 4, Article 8 (considered according to the award criteria): Add more specific regulations on the Gold Prize of an individual must be the National Gold Prize "... in which there is 1 National Gold Prize for an individual" (Decree No. 40/2021/ND-CP stipulates: in which there is 1 Gold Prize for an individual ), with such specific regulations, it helps the Councils at all levels have a unified understanding and a clearer basis in assessing the talent of individuals through the awards that the individual has achieved.
For musical works and photographic works specified in Point c, Clause 4, Article 7 and Point d, Clause 4, Article 8: the work must have at least 2 National Gold Awards.
For individuals considered according to the provisions in Point d, Clause 4, Article 7 and Point d, Clause 4, Article 8: Add individuals working in the following genres: chamber symphony, ballet, musical drama, considered according to the criteria of "having outstanding contributions, having outstanding artistic talent, not meeting the criteria for awards according to regulations" (for consideration of the title of People's Artist) or "having outstanding contributions, having outstanding artistic talent not meeting the criteria for awards according to regulations" (for consideration of the title of Meritorious Artist) because these art forms, although considered "scholarly music", rarely organize competitions so individuals do not have awards. This regulation will avoid missing out on honoring artists working in this art form.
The Decree also provides more specific regulations for elderly individuals; individuals who are lecturers at cultural and artistic training schools... who have made many outstanding contributions in art forms and professions... and are still actively participating in professional performing arts activities at the provincial and national levels.
For individuals who are lecturers, it is clearly stipulated that they directly train 3 students who won Gold prizes at national and international art competitions (People's Artist standard) or directly train 3 students, including 2 students who won Gold prizes and 1 student who won Silver prizes at national and international art competitions (Meritorious Artist standard). Those lecturers who are still actively participating in performing arts activities will be eligible for the title "People's Artist" or "Meritorious Artist".

Specific regulations on the working principles of the Title Review Council
Regarding the Council for awarding the titles of "People's Artist" and "Meritorious Artist" (stipulated in Articles 10, 11, and 12 of the Decree), Decree 61 also specifically stipulates the working principles of each level of the Council, clearly stating the responsibilities of each level of the Council.
For the grassroots Council: At Point d, Clause 3, Article 10 stipulates: The Council considers the process and duration of continuous or cumulative professional activities in the field of culture and arts; evaluates the reputation, expertise, and influence of each individual with a dossier proposing to be considered for the title of "People's Artist" or "Meritorious Artist" according to the criteria prescribed in Article 7 or Article 8 of this Decree.
Clearly defining such responsibilities will ensure the quality of the documents submitted to the Council at higher levels. No one can properly and "standardly" evaluate the artistic talent and artistic process of the artist as much as those who live and work in the same environment and profession. In addition, for documents considered according to Point d, Clause 4, Article 7 or Point d, Clause 4, Article 8, the Council at the grassroots level must have a comprehensive review and evaluation of the 4 criteria for awarding the title of "People's Artist" or "Meritorious Artist", in which the professional performing arts activities are specifically stated: the scale of the art programs; programs serving the political tasks in which the artist participates. This is the basis for the Council at higher levels to consider these cases.
For the Council at the ministerial and provincial levels: Point d, Clause 3, Article 11 stipulates: The Council reviews the records, procedures, and awarding procedures of the grassroots Council; evaluates the prestige, expertise, and influence of each individual with a record of application for the title of "People's Artist" or "Meritorious Artist" according to the criteria specified in Article 7 or Article 8 of this Decree.
For the State-level specialized council: At point c, clause 1, Article 12 stipulates: The council reviews the dossier, order, and procedures for awarding the title of the Ministerial Council or Provincial Council; evaluates the prestige, expertise, and influence of each individual with a dossier proposing the award of the title of "People's Artist" or "Meritorious Artist" according to the criteria prescribed in Article 7 or Article 8 of this Decree.
For the State-level Council: At Point c, Clause 2, Article 12 stipulates: The Council reviews the dossier, order, and procedures for considering and awarding titles of the State-level specialized Council; evaluates the prestige, expertise, and influence of each individual with a dossier proposing to be considered for the title of "People's Artist" or "Meritorious Artist" according to the criteria prescribed in Article 7 or Article 8 of this Decree.

Specific instructions for submitting application
Regarding the dossier, order and procedures for considering the award of the title "People's Artist" and "Meritorious Artist" (stipulated in Articles 13, 14, 15 and 16 of the Decree). Accordingly, Article 13 of the Decree specifically guides the route for submitting dossiers of each individual as prescribed in Clause 2, Article 1.
Articles 14, 15 and 16 specifically stipulate the time after the end of the meeting of the Council at all levels, the standing body of the Council is responsible for notifying in writing the results of the consideration for the title "People's Artist" and "Meritorious Artist" to the lower-level Council; specifically stipulate the time when the lower-level Council receives the written notification of the results from the higher-level Council, it must be responsible for notifying in writing to individuals with application files for the title "People's Artist" and "Meritorious Artist". These regulations create favorable conditions for each level of consideration, especially at the provincial Council level; ensuring transparency, convenience, science and consistency at each level of consideration.
Regarding the conversion of awards stipulated in Appendix 2 issued with the draft Decree, it is added to convert the award of the work to calculate the achievements for some components participating in the work such as: Musicians (musicians in the stage orchestra), Sound workers, Lighting workers, etc. These are indispensable components in programs and plays, contributing a lot to the success of the play but have not been converted into awards and in the award structure of professional art festivals, individual awards are rarely given to this group of subjects. The addition of the conversion of awards is to avoid disadvantages for artists.
The Appendix also supplements the Conversion Table of Awards for Musical Works and Photographic Works, which is the basis for calculating the achievements of the authors of the works in considering the award of the titles "People's Artist" and "Meritorious Artist".
