Proposal to buy motorbike insurance should not be mandatory, only voluntary

According to the petition of voters of Ho Chi Minh City, Motorcycle insurance is still a mandatory document required when people participate in traffic by motorbike.

However, many people now buy this insurance product just to deal with traffic police, instead of caring about their rights.

Therefore, voters recommend adjusting regulations on purchasing motorbike insurance so that it should be voluntary, not mandatory for people.

In a response document, the Ministry of Finance said it received a petition from voters in Ho Chi Minh City sent by the People's Aspirations Committee of the National Assembly Standing Committee.

The Ministry of Finance responded that the Law on Insurance Business, which will take effect from January 1, 2023, stipulates that compulsory insurance includes compulsory civil liability insurance for motor vehicle owners and assigns the Government to specify in detail the insurance conditions, insurance premiums, and minimum insurance amounts for compulsory insurance.

On September 6, 2023, the Government issued Decree No. 67 on compulsory insurance, including compulsory civil liability insurance for motor vehicle owners. Accordingly, the insurance certificate must include the name, address, and hotline number of the insurance company.

This Decree also stipulates the responsibility of insurance companies to resolve customer benefits, such as establishing and maintaining a 24/7 hotline to promptly receive accident information, provide guidance and answers to vehicle owners. Calls to the hotline must be recorded to ensure vehicle owners' rights.

Upon receiving notification of an accident, within one hour the insurance company must instruct the vehicle owner on the documents and procedures. claim; within 24 hours the loss assessment organization determines the cause and extent of loss as a basis for settling insurance claims.

Within 3 working days from the date of receipt of the vehicle owner's notice of the accident, the insurance company must make an advance payment for compensation for damage to health and life, including cases where it has not been determined that the accident is within the scope of compensation for damages.

In addition, current regulations also simplify compensation procedures such as compensation assessment is done by the insurance company, only in cases of death do police records are required.

In the coming time, the Ministry of Finance said it will closely monitor compliance with the above regulations to ensure the objectives of the insurance regime. At the same time, the Ministry of Finance will summarize, evaluate and report to competent authorities to adjust policies if necessary.

Buying is easy, paying compensation is difficult

Regarding civil liability insurance for motorbikes, in a document recently sent to the National Assembly, the Quang Tri Provincial Delegation said that voters in this province reported that the implementation of the civil liability insurance policy for motor vehicle owners still has many shortcomings and problems .

Many people believe that purchasing civil liability insurance for motorbike owners is mandatory, but when a traffic accident occurs, people have difficulty accessing the policy of this type of insurance. interest Insurance participants are not fully implemented, insurance claim procedures are very difficult and cumbersome.

In fact, the rate of payment for compulsory civil liability insurance for motorbikes when accidents occur is still very low. Therefore, voters request the Ministry of Finance to direct and guide insurance companies to simplify procedures, creating favorable conditions for people in settling civil liability insurance compensation for motor vehicle owners when risks occur.

According to the National Assembly Delegation of Nghe An Province, voters in this province also reported the widespread sale of auto and motorbike insurance while the compensation payment procedures were very difficult and complicated. Therefore, voters recommended simplifying insurance compensation procedures and preventing the widespread sale of insurance certificates.

Also related to compulsory insurance for cars and motorbikes, voters in Lang Son province requested that the authorities direct the handling of motor vehicle insurance procedures after an accident occurs. Currently, handling insurance-related issues is difficult, and procedures cause frustration for the people.
