Who can buy social housing?
Deputy Minister of Construction Nguyen Van Sinh said that the 2014 Housing Law clearly stipulates the subjects and conditions for purchasing social housing: people with revolutionary contributions according to the law on preferential treatment for people with revolutionary contributions; low-income people, poor and near-poor households in urban areas; workers working at enterprises inside and outside industrial parks.
Officers, professional non-commissioned officers, technical non-commissioned officers, professional soldiers, workers in agencies and units of the People's Public Security and the People's Army; cadres, civil servants and public employees as prescribed by law on cadres, civil servants and public employees; subjects who have returned official housing; households and individuals subject to land recovery and must clear and demolish houses as prescribed by law but have not yet received compensation from the State in the form of housing and residential land.
Regarding the conditions for purchasing social housing: the above subjects must meet all housing conditions (no housing or housing but the average area is less than 10 m2 /person); residence (must have permanent residence registration or temporary residence registration confirmation and social insurance payment confirmation for 1 year or more in the province or centrally-run city where the social housing construction investment project is located); income (not subject to personal income tax, i.e. income is less than or equal to 11 million VND, after family deduction of 4.4 million VND/person). Each household or individual is only eligible for support to purchase social housing once.
According to Mr. Sinh, depending on each subject, the housing law has specific regulations on the confirmation of subjects, housing conditions, residence conditions, income conditions for the People's Committees at district and commune levels, public housing management agencies, training institutions and relevant agencies. The investor is responsible for receiving documents, making a list of people expected to buy social housing and sending it to the Department of Construction.
Next, the Department of Construction is responsible for coordinating with relevant agencies (District People's Committee, tax, natural resources) to check the list of subjects expected to be resolved to buy, rent, or hire-purchase social housing.
At the same time, the Department of Construction is responsible for updating the list of subjects eligible to buy, rent, or lease-purchase social housing on the electronic information portal of the Department of Construction and the Ministry of Construction, so that relevant agencies can check and monitor the subjects and conditions as well as ensure that each subject is only supported with social housing once.
Wrong subjects buying social housing must be recovered
Deputy Minister of Construction Nguyen Van Sinh also said that recently, the media has reported the phenomenon of some intermediaries and "brokers" taking advantage of social housing policies to buy and sell for profit.
To rectify the above situation and ensure that the purchase and sale of social housing comply with the law, the Ministry of Construction has sent a document to a number of localities (such as Hanoi, Bac Ninh, Bac Giang, etc.), requesting the provincial People's Committees to direct competent agencies to organize inspections and clarify negative information reported by the press and media; strictly handle violations within their authority and send a report on the results of the settlement to the Ministry of Construction.
In the coming time, the Ministry of Construction will continue to coordinate with localities to strengthen inspection and examination, gradually rectify the implementation of legal regulations on housing, including social housing.
The Ministry of Construction also requested that local authorities should specify and publicly announce the standards, subjects and conditions for purchasing social housing; organize management and closely monitor the purchase and sale; organize inspection, examination, supervision and handling of violations related to the purchase and sale of social housing in the area; impose penalties for violations in selling, leasing, and leasing-purchasing social housing to the wrong subjects, not ensuring the prescribed conditions (fine from 40 to 60 million VND).
Timely measures to remedy the consequences are to force the repossession of social housing and force the buyer and lessee to return the money for buying, renting, or leasing social housing according to the provisions of Decree No. 16/2022/ND-CP dated January 28, 2022 of the Government on regulations on administrative sanctions for violations in the construction sector.
The Deputy Minister of Construction requested that enterprises comply with legal regulations in the purchase and sale of social housing, and sell at the correct price approved by competent authorities. In case of receiving incorrect information about the purchase and sale of social housing in their project, the investor must have an official announcement on the project, the unit's information page or on mass media.
For the people, Mr. Sinh recommends that the current housing law stipulates that the signing of social housing purchase contracts is carried out directly with the investor. Therefore, to have official and authentic information, people are recommended to contact the investor directly or access the information portal of the Department of Construction to grasp official information and receive instructions on how to complete the procedures for buying and selling social housing.
