The draft resolution of the National Assembly Standing Committee on the arrangement of administrative units stipulates that the arrangement shall not be carried out for administrative units that are isolated and have difficulty in organizing convenient traffic connections with adjacent administrative units; administrative units with especially important locations.


The Ministry of Home Affairs has just completed the draft resolution of the National Assembly Standing Committee on the arrangement of administrative units, along with the accompanying submission, and sent it to the Ministry of Justice for appraisal. Accordingly, the draft resolution stipulates the arrangement criteria for provincial and communal-level units in line with the 6 criteria that have been reviewed and agreed upon by the Politburo. These include natural area; population size; criteria on history, tradition, culture, religion, ethnicity; criteria on geo-economics (including criteria on geographical location, scale and level of economic development); criteria on geopolitics; criteria on national defense and security.

The criteria for natural area and population size are determined according to Resolution 1211/2016 of the National Assembly Standing Committee (amended and supplemented in 2022). In addition, no arrangement shall be made for administrative units that are isolated and difficult to organize convenient traffic connections with adjacent administrative units; Administrative units with particularly important locations, if arranged, will affect national defense, security and the protection of national sovereignty.

Based on the guiding views in the project, the draft resolution stipulates the principles of arrangement, including some new contents such as in the case of merging a province with a province, the new administrative unit after the arrangement is the province. In the case of merging a province with a centrally-run city, the new unit after the arrangement is the centrally-run city.

In case of rearranging wards with administrative units of the same level, the new administrative unit after the rearrangement is the ward. In case of rearranging communes and towns, the new administrative unit after the rearrangement is the commune.

In case the arrangement of commune-level administrative units changes the boundaries of district-level administrative units, it is not necessary to consider the conditions and standards and it is not necessary to follow the process and procedures for adjusting the boundaries of the district-level administrative units to which the commune-level administrative units belong.

Regarding the standards and quantity of administrative units of communes and wards after the rearrangement, the draft decree clearly states that the new commune after the rearrangement must have both a natural area and a population size reaching 300% or more of the commune standards prescribed in the Resolution of the National Assembly Standing Committee on standards of administrative units and classification of administrative units.

As for the population size standard of a commune in a mountainous area, highland area or one with a national border on land where 30% or more of the population is ethnic minorities, the minimum is 7,500 people.

The newly arranged ward has a natural area of ​​35 km2 or more; a population of 50,000 people or more; wards in mountainous and highland areas have a population of 35,000 people or more.

The draft stipulates that in case of arranging 4 or more commune-level administrative units into 1 new commune or ward, it is not necessary to evaluate the standards of natural area and population size.

In case the arrangement of administrative units is in accordance with the direction of competent authorities and ensures the provisions of this Resolution, the conditions will not be considered and other standards will not be assessed according to the provisions of the Law on Organization of Local Government and the Resolution of the National Assembly Standing Committee on standards of administrative units and classification of administrative units.

The draft also stipulates that the total number of administrative units of communes and wards after the rearrangement must be reduced by at least 70% and at most 75% compared to the total number of administrative units at the commune level before the rearrangement in the province or centrally-run city.
