Mr. Le Thai Binh requested to cancel Notice No. 296 dated April 16, 2024 of Tam Ky City People's Committee and accept to resolve the complaint against Decision No. 5203/QD-UBND dated November 1, 2023 of Tam Ky City People's Committee on approving specific land prices for land compensation for his household.
The complaint of Mr. Le Thai Binh (authorized representative of Mr. Le Van Dung and Mr. Le Thai Hoa, both residing in Block 1, An Son Ward, Tam Ky City; Ms. Le Thi Lien, residing in Tam My Village, Tam Xuan 1 Commune, Nui Thanh District and Mr. Le Van Tam, residing in Tan Tien Village, Ea Yong Commune, Krong Pac District, Dak Lak Province) was resolved by the Chairman of Tam Ky City People's Committee for the first time in Decision No. 2832/QD-UBND dated July 4, 2024. In this decision, the Chairman of Tam Ky City People's Committee did not recognize the content of his complaint.
Not agreeing with the complaint resolution of Tam Ky City People's Committee, Mr. Le Thai Binh continued to complain to the Chairman of Quang Nam Provincial People's Committee.
Implementing the Housing Construction Project of the Northwest Residential - Resettlement Area, Thanh Hoa Street (Phase 1), in An Son Ward, Tam Ky City People's Committee issued Decision No. 7579 dated December 29, 2023 on land recovery of the household of Mr. Le Thai Hue (deceased) - Mr. Le Van Dung, authorized representative of the co-heirs at land plot No. 74, map sheet No. 30, located in Group 3, Block 1 (An Son Ward) with an area of 1,265m2 , including 500m2 of urban residential land (ODT) and 765m2 of perennial land (originating from garden land).
Tam Ky City People's Committee issued Decision No. 452 dated January 17, 2024 on compensation and support for the household of Mr. Le Thai Hue (deceased) - Mr. Le Van Dung, authorized representative of the co-heirs, to implement the Residential Area - Resettlement Project Northwest Thanh Hoa Road (Phase 1) in An Son Ward, with a total amount of nearly 6 billion VND. However, up to now, Mr. Binh's household has not agreed to receive compensation and support and has not received resettlement land.
From the verification results, the Provincial Inspectorate believes that Decision No. 5203 dated November 1, 2023 of the People's Committee of Tam Ky City on approving specific land prices for compensation and support when the State reclaims land to implement the Residential Area - Resettlement Project Northwest of Thanh Hoa Road (Phase 1) is a decision approving specific land prices to calculate the general compensation and support value for the entire project, not to apply to one or several specific subjects.
On the other hand, Decision No. 5203 of Tam Ky City People's Committee on approving specific land prices does not directly affect the legitimate rights and interests of land users, specifically the household of Mr. Le Thai Hue (deceased).
Pursuant to Clause 8, Article 2 of the 2011 Law on Complaints, the issuance of Notice No. 296 dated April 16, 2024 by the People's Committee of Tam Ky City on not accepting to resolve complaints regarding Decision No. 5203 dated November 1, 2023 of the People's Committee of Tam Ky City on approving specific land prices for compensation and support when the State recovers land to implement the above project is in accordance with legal regulations. Decision on resolving complaints No. 2832/QD-UBND dated July 4, 2024 of the Chairman of the People's Committee of Tam Ky City is in accordance with legal regulations.
From the verification results, Mr. Huynh Ngoc Tien - Deputy Chief Inspector of the province said that he will propose that the Chairman of the Provincial People's Committee resolve the complaint by not recognizing the content of Mr. Le Thai Binh's complaint regarding Notice No. 296/TB-UBND dated April 16, 2024 on not accepting to resolve the complaint for the first time.
