The United States has just issued preliminary conclusions on the anti-subsidy investigation into hard capsule shell products imported from Vietnam.
According to the Department of Trade Defense, on March 25, 2025, the US Department of Commerce (DOC) issued a preliminary conclusion of the anti-subsidy investigation into hard capsule shell products (HS codes 9602.00.1040 and 9602.00.5010) imported from Vietnam.
This case was initiated by the US Department of Commerce on November 20, 2024 at the request of US domestic producers. In this case, DOC selected 2 mandatory respondents. However, 1 mandatory respondent provided information about not exporting the investigated product to the US during the investigation period, so there is only 1 mandatory respondent in this case.

According to the preliminary conclusion just issued, the provisional anti-subsidy tax rate is as follows: The sole defendant company in the case is 2.15%. The remaining Vietnamese companies are 2.15% according to the tax rate of the sole defendant company.
It is expected that the US Department of Commerce will conduct on-site inspections to verify the information provided by Vietnamese enterprises. This is one of the bases for the US Department of Commerce to issue the final conclusion, giving official tax rates for Vietnamese enterprises.
Interested parties may also submit comments on the case no later than 7 days after the date the final examination report is issued. Rebuttals to comments from other parties must be submitted no later than 5 days after the deadline for submitting comments.
The US Department of Commerce may then hold a hearing if requested by the parties and issue a final determination (expected on August 5, 2025 if not extended).
The Trade Remedies Authority recommends that relevant businesses prepare and cooperate well with the US Department of Commerce in the upcoming review as well as send comments with the US Department of Commerce's preliminary conclusions if necessary.
