The newly appointed Party Executive Committee operates until the end of the 2020-2025 term.

Accordingly, the Party Committee in the new administrative unit will be established on the basis of merging and consolidating the Party Committees in the old administrative unit. The name of the new Party Committee will be taken from the name of the new administrative unit. The term of the new Party Committee will be implemented according to Point 12, Section 12, Instruction No. 01-HD/TW, dated September 28, 2021.

The number of party cells under the party committee in the new administrative unit is the total number of party cells in villages, residential areas, and schools under the party committees in the old administrative unit and the party cells merged from the police, military, and medical party cells of the old administrative units.

In the 2020-2025 term, the maximum number of members of the Executive Committee, Standing Committee, and Inspection Committee of the new Party Committee shall not exceed the total number of members of the Party organizations at the same level before the arrangement minus the number of comrades who have reached retirement age, retired from work, or transferred to another job. The maximum number of Deputy Secretaries of the Party Committee of the new Party Committee shall not exceed the total number of current Deputy Secretaries of the Party Committee and the number of Party Secretaries of the Party organizations at the same level before the arrangement who are assigned as Deputy Secretaries but not assigned as Party Secretaries of the new Party Organization minus the number of comrades who have reached retirement age, retired from work, or transferred to another job.

Similarly, the maximum number of Vice Chairmen of the Inspection Committee of the new Party Committee shall not exceed the total number of Vice Chairmen of the existing Inspection Committee of the Party Committee minus those who have reached retirement age, retired from work or transferred to another job.

For the 2025 - 2030 term, the number of executive committee members, standing committee members, deputy secretaries of party committees; inspection committee members, deputy heads of inspection committees of party committees in new administrative units will be implemented according to the Politburo's directive and the Central Committee's guidance...

The People's Council in the new administrative unit operates until the new People's Council for the 2026-2031 term is elected.

The instructions of the Provincial Party Committee's Organizing Committee clearly state that the term of office of the People's Council in the administrative unit formed after the rearrangement is determined as follows:

In case an administrative unit is formed on the basis of merging administrative units of the same level and has a name different from the name of the merged administrative unit, the term of the People's Council in the administrative unit formed after the rearrangement shall be recalculated from the beginning (term I) from the time of establishment.

In case an administrative unit is formed on the basis of merging or adjusting the boundaries of administrative units of the same level or keeping the name and type of one of the merged or adjusted administrative units, the term of the People's Council in the administrative unit formed after the merging or adjustment continues to be calculated according to the term of the People's Council in the administrative unit that retains the same name.

The People's Council delegates of the new administrative unit include the total number of People's Council delegates of the old administrative units that are arranged and operate until the end of the 2021 - 2026 term. The Standing Committee of the People's Council in the new administrative unit formed after the arrangement includes the Chairman and no more than 2 Vice Chairmen of the People's Council.

The term of office of the People's Committee in the administrative unit formed after the rearrangement is the same as the term of the People's Council. The leadership of the People's Committee in the newly formed administrative unit after the rearrangement includes the Chairman and no more than 2 Vice Chairmen of the People's Committee. In case the Chairman of the old commune-level People's Committee is not arranged to be the Chairman of the new commune-level People's Committee but is arranged to be the Vice Chairman of the People's Committee, there will be no more than 3 Vice Chairmen of the People's Committee until the end of the 2021-2026 term. The 2026-2031 term shall be implemented in accordance with the provisions of the Law on Organization of Local Government.

When the Resolution of the National Assembly Standing Committee on the arrangement of commune-level administrative units for Hai Duong province comes into effect, the People's Council in the new administrative unit will hold its first session (for administrative units with new names); the next session of the People's Council of the administrative unit that retains the old name (for units that retain the old name of one of the two administrative units being arranged) will be held to elect the positions of the People's Council and People's Committee according to the provisions of Article 83 of the Law on Organization of Local Government. The People's Council in the new administrative unit will operate until the new People's Council for the 2026-2031 term is elected.

Mobilizing officials and civil servants who do not meet standards and conditions to take leave from work

According to the instructions of the Provincial Party Committee's Organizing Committee, the assigned and arranged commune-level cadres must still meet the age requirements to be able to be re-elected to the Party Committee for the 2025-2030 term, and the leadership positions of the People's Council and People's Committee at the commune level for the 2026-2031 term; for those who do not meet the age requirements for re-election, they must be encouraged to retire immediately or arranged to hold suitable positions so that when the commune-level congress is held, they can retire and enjoy benefits according to current regulations.

Commune-level cadres who meet the conditions and standards can be considered for transfer to district-level civil servants and assigned to jobs suitable to their positions if the district-level People's Committee still has staffing quotas or can be considered for assignment to other commune-level administrative units in the same district that currently have vacant positions. Commune-level cadres who are Chairmen of the Fatherland Front, heads of socio-political organizations who have worked as commune-level cadres for 5 years or more and meet the standards and conditions can be recruited and accepted as commune-level civil servants in other communes, wards and towns in the same district if there are staffing quotas.

In case of recruitment and admission of civil servants whose professional qualifications are not suitable for the job position being recruited or accepted, within 5 years from the effective date of the Resolution of the National Assembly Standing Committee on the arrangement of commune-level administrative units in the province, they must have professional qualifications suitable for the job position of the civil servant.

Officials in the old administrative unit who do not meet the standards and conditions according to regulations or cannot be arranged will be encouraged to retire and enjoy policies and regimes according to current regulations.

For civil servants, the new administrative unit established from the rearrangement of 2 old administrative units, each position shall not exceed 3 people. For the military commander position, there shall be 1 person, and for finance and accounting, there shall be no more than 2 people. No later than 5 years from the effective date of the Resolution of the National Assembly Standing Committee on the rearrangement of commune-level administrative units in the province, the number of positions must be arranged in accordance with current regulations.

The arrangement and assignment of surplus civil servants is carried out according to the principle that civil servants who meet the standards and conditions can be considered for transfer and proposed to be accepted as district-level civil servants suitable for the job position if the district-level People's Committee still has staffing quotas. Civil servants from this commune-level administrative unit can be transferred and assigned to work in other communes, wards and towns in the same district-level area that still have staffing.

In case of arrangement, if the civil servant has professional qualifications that are not suitable for the assigned job position, within 5 years from the time of arrangement to the administrative unit, the assigned civil servant must have professional qualifications suitable for the job position. In case the civil servant wishes to resign or retire before the age, it will be resolved according to the current regulations.

For non-professional workers, the arrangement is in accordance with the number prescribed in Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at commune, village and residential group levels.

In addition, the Provincial Party Committee's Organizing Committee also provides specific guidance on the process of preparing personnel to participate in the Party Committee, the Party Committee's leadership positions, the Standing Committee of the People's Council, the People's Committee, the Vietnam Fatherland Front and socio-political organizations; implementing policies for cadres, civil servants, and non-professional workers who are redundant due to the rearrangement of commune-level administrative units...
