Removing obstacles for people in the planning area

To resolve the problem, Hanoi City directed departments, branches, districts and towns to take drastic measures to solve urgent problems for people's lives.

Infrastructure is both lacking and weak

It is a fact that the demand for land use of localities in Hanoi for the purpose of social security and socio-economic development is very large. Especially in the inner city districts, having more land for the above-mentioned purposes is the desire of the people as well as the authorities at all levels. Meanwhile, a large area of ​​land located outside the Red River dike in these districts has not yet been fully exploited.

Although, with Decision 429/QD-TTg dated April 21, 2023 (amending and supplementing a number of articles in Decision 257/QD-TTg dated February 18, 2016) has opened up, as well as contributed to partly relieving the need for existing concentrated residential areas according to regulations to exist and be protected.

Specifically, according to Decision No. 429/QD-TTg: localities are allowed to use an additional part of the riverbank to arrange resettlement areas for households scattered near the area with an area not exceeding 5% of the existing residential area.

However, according to Mr. Hoang Hoai Dung, Deputy Secretary of the Party Cell, Head of the Front Committee of Residential Area No. 5, Thanh Tri Ward, Hoang Mai District, the land fund demand allowed to be expanded as above only meets part of the people's wishes. Due to the natural and mechanical population growth rate (including many people from provinces and cities moving to the inner city to live), social welfare works such as residential cultural houses, kindergartens, primary schools, parking lots, markets, shopping centers, etc. need to be expanded further to meet the people's needs.

This is also the desire of the people living in the Red River urban planning area. Accordingly, from 2016 to now, nearly a decade has passed due to the lack of detailed planning 1/500, many social welfare projects have not been invested in and built.

In particular, many sections of the road infrastructure have been damaged. Because the road system outside the dike was invested more than 10 years ago with most of it being concrete, while constantly having to bear the load of many vehicles such as cars, motorbikes, especially trucks carrying goods and materials coming in and out regularly, the roads are increasingly degraded...

Find a solution to the problem

In addition to the lack of social welfare works and degraded transport infrastructure, people living in the alluvial land also suffer many disadvantages when their houses are cramped and degraded but they are not allowed to build new ones or renovate. Sharing about this content, Mr. Tran Quoc Dat, an expert of the Urban Management Department of Hoang Mai District, said that in order to partly remove obstacles and gradually solve urgent problems for people, the Hanoi People's Committee has promptly issued instructions to related departments, branches, districts and towns.

Specifically, the City People's Committee issued Document No. 1407/UBND-DT dated May 9, 2024, assigning the Department of Construction to review and finalize the issuance of documents guiding the People's Committees of districts. Based on the approved Red River Urban Zoning Plan, it is agreed to grant construction permits to meet the needs of construction, renovation and repair of people's houses in areas outside the dike. Implementing the direction of the City, the Hanoi Department of Construction issued Document No. 4336/SXD-CP dated June 5, 2024, guiding the implementation of construction permits for new construction, renovation and repair of individual houses in existing concentrated residential areas on the riverbank.

Specifically, the document classifies the subjects that are granted official, time-limited, repaired, renovated in the original state or relocated into 3 groups. In which, group 2 is individual houses that are eligible for a time-limited construction permit, including: located in an area with approved zoning plans, on the list of existing concentrated residential areas on the riverbank that are protected according to Decision 257/QD-TTg dated February 18, 2016 (amended and supplemented by Decision 429/QD-TTg dated April 21, 2023) in accordance with the orientation of developing a flood prevention and control plan for the dike river in the Capital Planning, meeting the conditions for granting time-limited construction permits as prescribed in Article 94 of the Construction Law...

Along with that, the 2024 Land Law, which will take effect from August 1, will also be a solution to remove obstacles for people in the planning area. The Law has supplemented and completed regulations on the implementation of land users' rights in the planning area. Compared to the 2013 Land Law, the provisions of the new Law are clearer and more detailed. Specifically: Land users are allowed to build under a construction permit with a term, renovate and repair existing houses and works according to the provisions of the law on construction and related laws.

Regarding the issue of detailed planning at a scale of 1/500 for the Red River urban subdivision in Hoang Mai district, Mr. Tran Quoc Dat said that after studying the documents and conducting field inspections, the Department of Agriculture and Rural Development sent a document to the District People's Committee. Accordingly, the Department of Agriculture and Rural Development basically agreed on the boundaries of the existing concentrated residential areas in the Red River bank area, Hoang Mai district located in Appendix III - Decision 257/QD-TTg, corresponding to K72+384 to K80+100 of the Red River right dike, including 3 concentrated residential areas in 3 wards: Thanh Tri, Linh Nam, Tran Phu with a total area of ​​99.87 hectares and a population of 13,667 people (Appendix III - Decision 257/QD-TTg: area of ​​135.75 hectares and a population of 10,698 people)...

In addition, the Department of Planning and Investment also sent a document to the District People's Committee, providing comments on the dossier of the detailed planning task at a scale of 1/500 of the existing residential area to protect the area outside the Red River dike in the district. In which, comments were given on a number of specific issues such as: the planning boundary of roads and land plots; architectural planning indicators, land use needs, social infrastructure, technical infrastructure; investment projects within the planning study boundary; population size, etc.

According to Mr. Tran Quoc Dat, based on the written comments of the two Departments, the People's Committee of Hoang Mai District will continue to complete the detailed planning project to submit to the Appraisal Council for approval. After the detailed planning at a scale of 1/500 is approved, the People's Committee of the District will immediately start investing in the construction of infrastructure in areas outside the Red River dike. In particular, the work of investing, renovating and repairing urgent residential roads, along with other essential social welfare works to serve the people's lives.
