Removing obstacles for businesses in protecting intellectual property rights and copyrights

In the era of rapidly developing digital technology, businesses are facing major challenges in protecting intellectual property rights in general and copyright in particular.

On the occasion of the 20th anniversary of Vietnam's accession to the Berne Convention for the Protection of Literary, Artistic and Scientific Works (October 26, 2004 - October 26, 2024) and to support businesses in raising awareness and implementing measures to protect copyright in particular and intellectual property rights in general, on October 25, in Hanoi, the Vietnam Copyright and Creativity Association (VCCA) organized a Business Forum on Copyright and Knowledge Protection in Vietnam.

The forum is an opportunity for experts, managers, and business representatives to discuss, share experiences and solutions in protecting intellectual property rights in the modern business environment. This is also an opportunity for businesses to expand relationships, connect and raise awareness of the importance of copyright and knowledge.

The past 20 years, since Vietnam joined the Berne Convention, have been a journey, the first step in the journey to protect and develop the country's intellectual property. In the context of the strong development of the 4.0 Industrial Revolution, copyright protection, especially in the digital environment, has become more important than ever. Protecting intellectual property rights in general, and copyright (copyright and related rights) in particular, has been and is a mandatory condition in the international economic integration of each country.

To negotiate and sign trade agreements, Vietnam has negotiated and signed to join multilateral international treaties on copyright and related rights: Signing a bilateral agreement with the United States on establishing copyright relations in 1998, with Switzerland on intellectual property in 1999 and the Vietnam - United States Trade Agreement in 2000.

In particular, Vietnam joined the Berne Convention for the Protection of Literary and Artistic Works in 2004; the Convention for the Protection of Producers of Phonograms Against Unauthorized Duplication of Their Phonograms in 2005; the Convention for the Protection of Satellite Programme-Carrying Signals in 2006; the Convention for the Protection of Producers of Phonograms, Performers and Broadcasting Programmes in 2007; the WIPO Copyright Treaty in 2022; the Treaty for the Protection of Performers and Producers of Phonograms in 2022; and the Marrakesh Treaty for Facilitating Access to Published Works for the Blind and Other Visually Impaired in 2023.

Signing free trade agreements with content on copyright and related rights, including the TRIPS Agreement (WTO); Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP); Vietnam-EU Free Trade Agreement (EVFTA); Regional Comprehensive Economic Partnership Agreement ( RCEP) ...

The implementation of bilateral and multilateral international treaties on copyright and related rights signed and participated in aims to protect the legitimate rights of Vietnamese citizens and legal entities in member countries and at the same time fulfill legal obligations to member countries.

Vietnam has made many efforts to gradually promulgate, amend and supplement legal regulations on intellectual property: promulgating the Law on Intellectual Property in 2005, amended and supplemented in 2009, 2022...

However, copyright and related rights infringements still occur, in some places and at some times, seriously, especially in the digital environment and the internet. This has caused significant damage to creative investors and is a challenge for the development of the country's creative and cultural industries.

Mr. Bui Nguyen Hung, Chairman of VCCA, commented: “The digital age and the internet bring many opportunities to access literary and artistic works, audio and video recordings, and broadcast programs anywhere and anytime, but at the same time, they also pose great challenges in protecting copyright and encouraging the development of creative industries and cultural industries.”

According to Ms. Lam Thi Oanh, Director of the Center for Creative Technology and Copyright Development of Vietnam, the digital content market is developing strongly, creating opportunities but also bringing great challenges. Data from the Vietnam Digital Communications Association shows that the estimated number of consumers of pirated video content in 2022 is 15.5 million people, by 2017 it is estimated to increase to more than 19 million, causing a loss of more than 450 million USD.

Mr. Pham Hoang Hai, Director of the Center for Radio, Television and Electronic Information Measurement, Department of Radio, Television and Electronic Information, Ministry of Information and Communications, said that in Vietnam there are about more than 200 pirated movie websites attracting about 120 views/month and about 70 copyright-infringing football websites with more than 1.5 billion views.
