Irresponsible
After nearly 3 weeks of treatment at Viet Duc Hospital (Hanoi), the health of VTKN, born in 2014 in Dong Cam Commune (Kim Thanh), has improved quite well. N. has just undergone surgery for a traumatic brain injury after a traffic accident that occurred at 8:30 p.m. on March 18 on National Highway 17B, in Dong Cam Commune. At that time, N. was walking across the street when he was hit by a motorbike with an unknown driver and license plate number. After causing the accident, the driver and his motorbike left the scene and headed towards Tam Ky Commune, in the same Kim Thanh District. To date, the driver who caused the accident is still "missing".
Mr. Vu Quoc Dung, N.’s father, was indignant: “No one wants a traffic accident, but hitting a child, throwing him several meters away, then running away and avoiding responsibility is unacceptable. I hope the police will soon find the owner of the vehicle that caused the accident so that they can handle it in accordance with the law.”
Previously, at around 20:40 on December 31, 2024, at km 7+70 of National Highway 38B in Doan Thuong Commune (Gia Loc), people discovered that Mr. PVT, born in 1995 in Le Loi Commune, Gia Loc District, had a traffic accident. After reporting to the police, people coordinated to take Mr. T. to the Hai Duong Provincial General Hospital for emergency treatment. Mr. T. suffered a traumatic brain injury and a fractured left eye socket.
According to the police, Mr. T. had an accident while walking on Highway 38B. Mr. T. is suspected of colliding with a motorbike with an unknown license plate and driver. The motorbike was traveling in the direction of Thanh Mien - Gia Loc when the accident occurred. After the accident, the owner and vehicle left the scene, leaving the seriously injured victim lying on the road.
The above are just two of many traffic accidents that occurred in Hai Duong province where the perpetrators left the scene, abandoned the victims, and evaded responsibility.
Causing an accident without stopping, not preserving the scene, not participating in first aid for the victim is a condemned act, because more than anyone else, they are the ones directly present at the scene and may be the first to assist the victim in getting to the emergency room. Driving away after causing an accident wastes the "golden" time for first aid and treatment for the victim. In many cases, the person causing the accident takes advantage of the dark night, when there are few passersby, or when the scene is chaotic to escape responsibility.
Crime
More than a year ago, at around 4:40 a.m. on March 23, 2024, at km17+500 of Provincial Road 390, in Quyet Thang Commune (Hai Duong City), a traffic accident occurred between a car and a bicycle, causing the cyclist to die on the spot. The victim was Mr. HVN, born in 1958, in Hoang Xa 1 Village, Quyet Thang Commune. The incident attracted the attention of many people and caused public outrage because the person causing the accident drove away from the scene.
After receiving the report, Hai Duong City Police conducted an investigation at the scene and collected the remaining traces. Using professional measures, the authorities determined that the vehicle that caused the accident was a 5-seat car. After causing the accident, the driver drove away in the direction of Thanh Ha town.
On March 25, 2024, Hai Duong City Police identified Pham Van Thong as the owner of the Mitsubishi Attrage car, license plate 34A-206.18, which caused the fatal accident mentioned above.
After causing the accident, Thong drove the car to garages in Hanoi and An Lao district (Hai Phong) to repair and replace the damaged tire to erase traces and conceal the crime, causing difficulties for the investigation agency. During the investigation, Pham Van Thong confessed to all the crimes.
For his actions, Thong was sentenced to 36 months in prison by the People's Court of Hai Duong City.
Lawyer Duong Duc Trong, Head of Bao Tin Law Office (Hai Duong City) said that according to the Law on Road Traffic Safety, drivers are not allowed to leave the scene after causing a traffic accident. In case they are assaulted by the victim's family, they are allowed to temporarily take refuge, but must report to the nearest police station. If they flee to avoid responsibility, it will be considered an aggravating circumstance, a crime of "Violating regulations on traffic participation" as prescribed in the Penal Code. The maximum penalty for this act is 10 years in prison.
According to Decree 168/2024/ND-CP of the Government regulating administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction of points, and restoration of driving licenses.
In Clause 8, Article 6, penalties and deduction of driving license points for drivers of cars, four-wheeled motorized passenger vehicles, four-wheeled motorized cargo vehicles and similar vehicles violating road traffic rules are imposed, and a fine of VND 16,000,000 to VND 18,000,000 will be imposed on drivers who commit traffic violations and cause traffic accidents by not immediately stopping the vehicle, not preserving the scene, not assisting the victim, not staying at the scene or not immediately reporting to the nearest police agency or People's Committee.
Driving a car causing an accident and not keeping the scene intact will result in a 6 point deduction from your driver's license.
Article 7. Penalties and deduction of driving license points for drivers of motorbikes, mopeds, and similar vehicles to motorbikes and similar vehicles to motorbikes who violate road traffic regulations. Fines from VND 8,000,000 to VND 10,000,000 shall be imposed on drivers who cause traffic accidents and do not immediately stop their vehicles, do not maintain the scene, do not assist victims, do not stay at the scene, or do not immediately report to the nearest police station or People's Committee.
Driving a motorbike causing a traffic accident and then fleeing will result in a 6 point deduction from the driver's license.
Vehicle owners who cause traffic accidents and then flee the scene may be prosecuted under Clause 72, Article 1 of the 2017 Penal Code Amendment Law with a prison sentence of 3 to 10 years.
In addition, Articles 585, 590 and 601 of the 2015 Civil Code stipulate that drivers who cause accidents and do not stop must compensate for damage to property, health and life of the accident victims.
In the first quarter of 2025, there were 131 traffic accidents and collisions in Hai Duong province, killing 60 people and injuring 92 people. Compared to the same period in 2024, there were 84 fewer cases (down 39.1%), 87 fewer injuries (down 48.6%), but 6 more deaths (11.1%). Compared to the previous 3 months, there were 43 fewer traffic accidents and collisions, 54 fewer injuries, and 10 more deaths.
