Many businesses in Quang Nam reported that they continue to fall into a "vortex" of procedures and that resolving these procedures takes a lot of time, greatly affecting the progress of investment projects.

After that, the Quang Nam Provincial Business Association continued to petition the Quang Nam Provincial Government about a series of other difficulties and problems. According to Mr. Tran Quoc Bao, Chairman of the Quang Nam Provincial Business Association, regarding the policy of allocating "leopard skin" land, the Provincial People's Committee has directed in Official Dispatch No. 3021/UBND-KTN dated April 26, 2021 for land areas that have not been cleared before, but have now been completed, allowing land allocation to synchronize the project site.

According to the investment plan of the Curtain Fabric Factory Project, Phase III and Phase IV, with an area of ​​about 21 hectares, in the expanded Tam Thang Industrial Park, Phase III (area of ​​14 hectares) will be put into operation from July 2023. However, it has been more than 2 years since the time of granting the adjusted investment registration certificate, we have not been able to put the Project into operation, due to land-related procedures, such as compensation and land sub-lease unit prices.

However, in reality, almost no projects have been implemented according to this policy, or if there are, they are only applied to a small part of the land area that does not collect land use fees, so it is not in accordance with the province's direction.

Regarding investment phasing, Mr. Bao said that in order to remove difficulties in allocating land for the entire project at once according to the investment policy and orienting project phasing according to the site clearance progress, the Provincial People's Committee has issued a document directing the Department of Planning and Investment to guide investors to divide real estate projects into phases in accordance with the land allocation progress.

But in reality, as of August 8, 2024, very few projects have been phased according to the approved 1/500 detailed planning (in each phase of synchronizing technical infrastructure), phased according to the progress of site clearance and land allocation, while this is the main reason for the multiple allocation of land in the projects. Therefore, this difficulty has not been resolved yet...

Regarding the issuance of certificates by lot (block) and issuance of sub-certificates for each land lot, according to Mr. Bao, based on Official Dispatch No. 3021/UBND-KTN dated April 26, 2024, the Provincial People's Committee has directed that for projects that have been allocated land, completed financial obligations, and constructed basic technical infrastructure, they will be considered for issuance of certificates by lot. However, the delay in determining financial obligations and land use fees as mentioned above, even if all the conditions are met according to regulations, the project still cannot be granted a red book. In addition, the lack of detailed regulations on the conditions for issuing red books by lot for real estate projects also causes many difficulties in the process of accepting technical infrastructure.

“Currently, businesses that pay taxes have fulfilled their financial obligations and basically completed their technical infrastructure, but are not allowed to separate plots, transfer, or register changes to issue sub-books, which greatly affects the business's operations,” Mr. Bao reported to the Quang Nam provincial government.

Not to mention, the annual land rental price is calculated too high compared to the general level of the locality and region. Enterprises do not agree with the price, have not signed the land rental contract, and have complained to redo the price, but are still charged with tax arrears, have their invoices and accounts seized. The Provincial People's Committee has issued a document directing the Department of Natural Resources and Environment and the Department of Finance to review and resolve the issue, but so far there has been no progress.

According to Mr. Le Van Dung, Chairman of the People's Committee of Quang Nam province, the recommendations of the Provincial Business Association have been resolved by the Provincial People's Committee at a meeting. Accordingly, the Provincial People's Committee assigned the departments, branches, sectors and localities to focus on implementing the policy of removing difficulties for enterprises and investors in the spirit of Notice No. 757-TB/TU dated April 24, 2024 of the Standing Committee of the Provincial Party Committee and documents guiding support and specific removal for each project and each investor in the past time.

“The Provincial People's Committee pledges to continue to be responsible for accompanying the business community, focusing on resolving administrative procedures, not adding administrative procedures that are not prescribed by law; strictly handling cases of harassment that cause difficulties for businesses, creating an open and transparent investment and business environment,” said Mr. Dung.

The Provincial People's Committee assigned the Department of Natural Resources and Environment to study, urgently report and propose, advise the Provincial People's Committee to consider, report to the Party Committee of the Provincial People's Committee, submit to the Standing Committee of the Provincial Party Committee for consideration, and give specific instructions on the contents related to the issuance of land use right certificates by lot according to the provisions of the 2024 Land Law, relevant legal documents and current practical situation, in order to contribute to solving difficulties and problems of real estate businesses.

Investment project "stopped" due to procedural problems

Recently, Hyosung Quang Nam Co., Ltd. sent a petition to the People's Committee of Quang Nam province regarding a series of difficulties and obstacles when investing in the locality. According to Mr. Park Chan, General Director of Hyosung Quang Nam Co., Ltd., currently, the implementation time of the Curtain Fabric Factory Project according to the progress registered in the Investment Certificate No. 6554563424 issued on April 28, 2022, adjusted on August 24, 2024 (to complete phase III by the end of the fourth quarter of 2024) is approaching.

However, at present, there is still no report on additional investment attraction industries, land allocation proposals, and the construction and issuance of specific land rental prices for the expanded Tam Thang Industrial Park.

Mr. Park Chan proposed that the Provincial Party Committee and the Provincial People's Committee consider quickly allocating land and issuing specific rental prices for the expanded Tam Thang Industrial Park so that Chu Lai Industrial Park Infrastructure Development Company Limited (CIZIDCO) can sign a land sublease contract for Phase III - Curtain Fabric Factory Project with the Company this year.

In addition, Mr. Park Chan said that compensation work also has many problems related to the handling of public land (5%) and compensation policies for land and assets on land cultivated by people but not eligible for compensation. This makes it impossible for Hyosung Company Limited to sign land lease contracts and carry out other legal procedures, greatly affecting the investment progress.

Regarding the above recommendations, the People's Committee of Quang Nam province has just requested the Management Board of Economic Zones and Industrial Parks of the province, the Department of Natural Resources and Environment, the Provincial Tax Department, and Chu Lai Industrial Park Infrastructure Development Company Limited (the investor of the infrastructure of the expanded Tam Thang Industrial Park) to urgently implement the instructions of the Provincial People's Committee in Notice No. 208/TB-UBND dated July 2, 2024.

Specifically, in the above Notice, Vice Chairman of the Provincial People's Committee Ho Quang Buu assigned the Provincial Economic Zones and Industrial Parks Management Board to preside over and coordinate with relevant agencies and units to review, inspect, and consider adjusting the contents of the Investment Registration Certificate for Phase III and Phase IV for the Curtain Fabric Factory Investment Project as requested by Hyosung Company, creating favorable conditions for investors to enjoy benefits in accordance with regulations.

Regarding compensation for site clearance, the Provincial People's Committee assigned CIZIDCO to preside over and coordinate with the People's Committee of Thang Binh district to urgently focus on resolving site clearance for phase III and phase IV of the project to invest in the curtain fabric factory, ensuring conditions for Hyosung Company to soon deploy and put the project into official operation; promptly report to the Provincial People's Committee for consideration and handling of arising situations and problems (if any).

Regarding the determination of specific land prices, the Provincial People's Committee assigned the Department of Natural Resources and Environment to coordinate with the Provincial Economic Zones and Industrial Parks Management Board to urgently advise and propose to competent authorities to determine and approve specific land prices of the expanded Tam Thang Industrial Park as a basis for implementing land allocation and leasing.

At the same time, the Provincial People's Committee requested relevant departments, branches and units to continue reviewing the latest recommendations of Hyosung Quang Nam Company Limited to promptly coordinate to remove and resolve difficulties in investment projects under their authority or report and advise the Provincial People's Committee to direct and resolve in accordance with regulations.

According to Mr. Buu, the planning for the expanded Tam Thang Industrial Park and the environmental impact assessment report approved by the competent authority do not include the industry group that Hyosung Company is planning a new project for, which is a factory producing interiors for the automobile industry.

Therefore, Mr. Buu suggested that CIZIDCO review and supplement the planning of industries to attract investment in the expanded Tam Thang Industrial Park in accordance with the development situation in the coming time and update the industries that Hyosung Company plans to invest in the expanded Tam Thang Industrial Park to submit to the competent authority for approval and carry out related environmental procedures.
