On the afternoon of May 27, at the 5th Session of the 15th National Assembly, the National Assembly Delegation of Thanh Hoa province discussed in groups and gave opinions on the Draft Law on amending and supplementing a number of articles of the Law on People's Public Security; Draft Law on amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam.
The National Assembly Delegation of Thanh Hoa Province highly agreed on the necessity of promulgating the Law amending and supplementing a number of articles of the Law on the People's Public Security. National Assembly Delegate Mai Van Hai, member of the Provincial Party Committee, Deputy Head of the Provincial National Assembly Delegation, suggested that it is necessary to review and strictly regulate Point b, Article 25, which stipulates that there are no more than 7 Senior Lieutenant Generals, including: Deputy Ministers of Public Security, the number is no more than 6; Seconded People's Public Security officers are approved to hold the position of Chairman of the National Assembly's Committee on National Defense and Security. Delegate Mai Van Hai also suggested that it is necessary to study, have a specific roadmap and classify each subject to regulate the age limit for public security workers, non-commissioned officers, and People's Public Security officers.
The timing of increasing the service age of police officers, non-commissioned officers, and officers of the People's Public Security from January 1, 2021 is inappropriate and must be reviewed from the time this law comes into effect.
Regarding the regulation that Lieutenants, Majors, Lieutenant Colonels, and Senior Colonels who are good at their profession, have good health, and volunteer can extend their service age according to the regulations of the Minister of Public Security, but not more than 62 years old for men and not more than 60 years old for women, delegate Mai Van Hai suggested that the service age should not be extended according to the regulations of the Minister of Public Security, because these regulations are based on very qualitative factors.
Discussing the Draft Law amending and supplementing a number of articles of the Law on People's Public Security, National Assembly Delegate Pham Thi Xuan, Secretary of the People's Court of Quan Hoa district, said: In Clause 2, Article 1 amending and supplementing Clause 1, Article 23 of the Law on People's Public Security, it is necessary to carefully consider reviewing the criteria and standards for establishing outstanding achievements, clarifying the concept of work to avoid duplication; consider removing the "study" criterion to ensure feasibility for the main functions and tasks of the people's public security force as stipulated in Article 3 of the Law on People's Public Security 2018.
In addition, along with assigning the Government to specify the above criteria and standards, it is recommended to consider assigning the Minister of Public Security to specify the criteria and standards for early promotion to the rank of lieutenant and colonel to ensure consistency and unity in the implementation of policies and regimes of the entire People's Public Security force.
Regarding Clause 4, Article 1 amending and supplementing Article 30 of the Law on People's Public Security, delegate Pham Thi Xuan also said: Raising the service age of people's public security, non-commissioned officers, and police officers according to the retirement age increase process as prescribed by the Labor Code is necessary. However, it is recommended to carefully consider the service age to suit the special nature of the armed forces' work. Clarify the regulation on the time of increasing the maximum service age from January 1, 2021 - the time before the Law on People's Public Security (amended) this time takes effect to ensure consistency with Article 152 of the current Law on Promulgation of Legal Normative Documents (QPPL). Because the Law on Promulgation of Legal Documents clearly stipulates the retroactive effect of legal documents as follows: "Only in cases where it is absolutely necessary to ensure the common interests of society in implementing the rights and interests of organizations and individuals as prescribed in laws and resolutions of the National Assembly, legal documents of central agencies are retroactively prescribed."
At Point C, Clause 4, Article 1 amending and supplementing Clause 3, Article 30 of the Law on People's Public Security, delegate Pham Thi Xuan proposed to consider and clarify the provisions in Clause 3, Article 30 on special cases. Specifically, what is special here? How many years is the maximum extension of 62 years for men and 60 years for women? Which level has the authority to decide on the extension to serve as a basis for implementing the law when it comes into effect?
National Assembly Deputy Cao Manh Linh, full-time member of the National Assembly's Judicial Committee, suggested that the drafting agency should clarify the amendment to Article 23 on early promotion and promotion beyond the prescribed rank. It is suggested that the Minister of Public Security should consider specifying the criteria and standards for early promotion for lieutenants and colonels to ensure consistency and unity in the implementation of policies and regimes of the entire People's Public Security force...
Commenting on the Draft Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam, the National Assembly Delegation of Thanh Hoa Province highly agreed on the necessity of promulgating this law. Delegate Mai Van Hai suggested that it is necessary to strictly regulate the issuance of ordinary passports according to the simplified procedure in Clause 2, Article 18. It is recommended that there should not be a regulation that the passport be canceled after 48 hours when a citizen loses his/her passport, but only a regulation that the passport be canceled when the citizen reports the loss of the passport.
