The Investigation Police Agency has just proposed to prosecute Ms. Nguyen Thi Thanh Nhan (Chairwoman of AIC) for violating bidding regulations causing serious consequences.
The Investigation Police Agency (Ministry of Public Security) has just completed the investigation conclusion of the case of Violating bidding regulations causing serious consequences occurring at the Vietnam Computer Emergency Response Center, International Progress Joint Stock Company and related units. The investigation agency proposed to prosecute 13 defendants for many crimes.
Among those prosecuted are Ms. Nguyen Thi Thanh Nhan (Chairwoman of the Board of Directors of Tien Bo International Joint Stock Company - AIC), Nguyen Trong Duong (former director of the Vietnam Computer Emergency Response Center - VNCERT), Mai Phuong Nam (Deputy Director of Khang Phat Trading and Service Company Limited; Nguyen Vu Cuong (Director of Khang Phat Company)...
The case involves a project to purchase equipment and hire technical services to monitor, analyze incidents and network security attacks on a number of international internet connection channels.
According to the investigation conclusion, Ms. Nguyen Thi Thanh Nhan established and operated AIC Company and companies in the ecosystem including Mopha Company, High-Tech Consulting Joint Stock Company, International Knowledge and High-Tech Joint Stock Company.
Right from the stage when VNCERT built the list of equipment and software for the project, Ms. Nguyen Thi Thanh Nhan directed Mr. Nguyen Van The (Head of KT7 Department of AIC Company) to coordinate with VNCERT to introduce products to sales companies, determine the purchasing needs of the investor to negotiate the output price with the sales companies to agree on the estimated price with the investor.
According to the investigation agency, this was to ensure that AIC Company received a 40% profit and was oriented to be the winning bidder for equipment supply. After the investor implemented the approval procedures, legalizing the consulting steps based on the list and equipment price agreed between AIC Company and the investor, Ms. Nhan continued to direct Mr. Do Van Son, Head of Project Management Board 2, to set up a "blue team - red team" to bid with the purpose of AIC Company winning package No. 8.
The investigation agency determined that Ms. Nhan's actions caused damage to the State of more than 17.2 billion VND, violating bidding regulations with serious consequences.
In this case, the Investigation Police Agency identified Mr. Nguyen Trong Duong, former director of VNCERT, as the investor's representative. During the implementation of package No. 8, Mr. Duong directed his subordinates to create conditions for AIC Company to participate in all stages to agree in advance on the list and price of software equipment in the project approval decision, the investor selection plan, and the preparation of bidding documents, creating conditions for AIC Company to win package No. 8...
After the bidding, Mr. Duong received 1 billion VND from AIC Company, used 200 million VND for personal use, and spent the rest on Tet holiday money for employees and for the general operations of the center. During the investigation, Mr. Duong recovered 600 million VND. In addition, Mr. Duong was also recognized by the Investigation Police as having mitigating circumstances.
