13 illegal constructions exist at Thien Ma Madagui horse racing track project

As Thanh Nien reported, the Thien Ma Madagui horse racing project - Polo and horse performance club is invested by Thien Ma - Madagui horse racing joint stock company (village 4, Da Oai commune, Da Huoai district), implemented on a total area of ​​over 69 hectares, with a total investment of 1,002 billion VND. The construction area of ​​covered architectural works is 40,807 ^m2 , accounting for 5.83%; the construction area of ​​uncovered works is 173,165 ^m2 , accounting for 24.75%.

The competent authority inspected and discovered that the investor had built 16 works and construction items, with a total construction area of ​​6,429 ^m2 without changing the land use purpose (LUP) and without any construction permit being issued. Of these, 13/16 construction items, with a total construction area and impact of 6,320 ^m2 , were located and had basic construction areas in accordance with the approved planning; the remaining 3/16 construction items, with a total construction area and impact of 109 ^m2, were not included in the approved planning.

The main structures are made of iron, steel, and cement floors.

According to the company's explanation, since 2016, it has imported over 100 racing horses from abroad to prepare for the pilot racing activities. Then, according to the policy of the Provincial People's Committee in Document 1202/UBND-VX2 dated March 3, 2017 on approving the policy for this company to organize a pilot horse racing with prizes and horse riding performance on the occasion of the project opening, to ensure sufficient facilities for the pilot organization of horse racing with prizes, the investor has leveled the ground and constructed a number of the above-mentioned construction items. Most of the works are made of box steel frames, shaped steel, cement floors, corrugated iron roofs, partially brick walls, steel frames, etc. After organizing 15 races, on May 7, 2018, the company announced the temporary suspension of organizing betting on prizes at this racetrack.

Horses are raised at the project.

On October 7, the People's Committee of Da Huoai District announced that it had issued a decision to administratively fine Thien Ma - Madagui Horse Racing Joint Stock Company VND80 million. The reason was that this company converted perennial land to non-agricultural land in rural areas without permission from competent state agencies with a total area of ​​6,429 ^m2.

At the same time, the company is required to restore the original condition of the land before the violation of 3 constructions (109 ^m2 ) that are not in accordance with the planning (specifically: demolishing and relocating the infrastructure construction on agricultural land for perennial crops). Meanwhile, the decision also requires Thien Ma - Madagui Horse Racing Joint Stock Company to carry out procedures for transferring land use rights according to legal regulations for 13 constructions (area of ​​6,320 ^m2 ) that are in accordance with the planning (no demolition - PV).

Constructions that comply with planning are allowed to exist.

Currently the investor is carry out related procedures to adjust the project into: Thien Ma Madagui Horse and Dog Racing Track - Polo and Horse Show Club (with betting business) with a total adjusted investment capital of more than 1,548 billion VND. At the same time, the company is also contacting the authorities to carry out procedures to transfer land use rights and apply for a construction permit for this horse racing track project.
