After discovering violations at the Hoang Hao Housing Project and the Hoa Lan Housing Project (Vinh Long Province), the Government Inspectorate (GIA) requested the Ministry of Public Security to receive information and documents to review, investigate, and handle violations of the law in accordance with the law.


According to information from the Government Inspectorate, the Government Inspectorate has requested the Ministry of Public Security to receive information and documents to review, investigate and handle according to the provisions of law violations of the law, regarding the Hoang Hao Housing Project in Long Hung Hamlet, Thanh Son Hamlet, Thanh Duc Commune, Long Ho District, which has violations of the law on land use management in allowing the change of land use purpose contrary to the land use planning and land use plan, the use of land not in accordance with the planning approved by competent authorities and the determination of land financial obligations not in accordance with the provisions of law, with the risk of causing loss to the state budget.

At the same time, the Government Inspectorate also requested the Ministry of Public Security to receive information and documents to review, investigate and handle according to regulations for the Hoa Lan Housing Project, Ward 8, Vinh Long City, which has violated the law on land use management in allowing the change of land use purpose in violation of the law through the act of continuing to separate 33 plots with an area of ​​11,188.6 square meters, allowing the change of land use purpose not in accordance with the planning and granting the Certificate of land use rights for residential land, on traffic land, green land according to the planning approved by competent authorities and determining land financial obligations not in accordance with the law, with the risk of causing loss to the state budget.

Previously, through inspection work, the Government Inspectorate discovered that the People's Committee of Vinh Long province allowed the establishment of a detailed construction plan of 1/500 for Hoang Hao Residential Area (Long Ho district) when the investor did not have legal land use rights, which was not in accordance with the provisions of Decree 90/2006/NDCP of the Government; approved the detailed construction plan of 1/500 and decided to change the land use purpose to carry out investment in construction of Hoang Hao Residential Area (commercial housing project) right on the land planned as industrial land, which was not in accordance with the general planning, land use plan 2006-2010, land use plan until 2020 and land use plan 2011-2015 approved by Long Ho district, which was contrary to the Land Law No. 13/2003/QH11.

According to TTCP, the People's Committee of Vinh Long province has allowed the implementation of a number of housing development projects that are not included in the approved housing development plan, which is not in accordance with the 2014 Housing Law (Hoang Hao Housing Area, Hoa Lan Housing Area...).

TTCP also discovered that the Department of Natural Resources and Environment allowed the separation of 33 plots of land with an area of ​​11,188.6 m2 on land that had been approved by the Department of Construction for the overall project plan, including traffic land (10,601.3 m2) and trees (587.3 m2) for the investor of the Hoa Lan Housing Project (Ward 8, Vinh Long City) to transfer before building infrastructure for households, which was not in accordance with the provisions of Decree 43/2014/ND-CP of the Government. After receiving the transfer, the people built solid houses (without a construction permit), and were allowed by the Department of Natural Resources and Environment to change the land use purpose and granted a Land Use Right Certificate for the purpose of use as residential land, which was not in accordance with the overall plan approved by the Department of Construction in Document No. 675/SXD-KTQH dated September 25, 2012.

TTCP determined that the People's Committee of Vinh Long province issued decisions allowing the change of land use purpose for the Hoa Lan Housing Project (3 decisions in 2016) and the Bach Dan Housing Project (1 decision in 2016 and 2 decisions in 2017), on that basis applying the land price adjustment coefficient method to calculate land use fees while the total area of ​​land use purpose change of each project calculated according to the land unit price in the land price list issued by the Provincial People's Committee has a value of over 20 billion VND, which is not in accordance with the provisions of the law in the Land Law and Decree 44/2014/ND-CP of the Government and applying land location to calculate land use fees is not accurate.
