Prime Minister urges implementation of key tasks after Lunar New Year holiday 2025

Prime Minister Pham Minh Chinh signed Directive No. 03/CT-TTg February 4, 2025, urging the implementation of key tasks after the Lunar New Year holiday of At Ty 2025.

The Directive requires relevant ministries, agencies, localities, organizations and individuals, according to their assigned functions, tasks and powers, after the Lunar New Year holiday, to immediately focus on handling work, especially unfinished work in 2024, unfinished work due to the Tet holiday, not to delay affecting production, business activities, socio-economic development, ensuring national defense, security, social order and safety; continue to urgently, seriously, synchronously and effectively implement projects, tasks and solutions stated in resolutions and conclusions of the Central Committee, the National Assembly and the Government, especially the Supplementary Project on socio-economic development in 2025 with a growth target of 8% or more.

The Prime Minister requested to practice a civilized, safe and economical lifestyle during the Spring Festival 2025.

Prime Minister Pham Minh Chinh signed Official Dispatch No. 09/CD-TTg On February 3, 2025, the Ministry of Finance requested ministries, branches and localities to ensure the implementation of civilized, safe and economical lifestyles in festival activities after the Lunar New Year and the Spring Festival in 2025.

The telegram requests the Minister of Culture, Sports and Tourism to preside over and coordinate with ministries, agencies and localities to step up propaganda, mobilization, raising awareness and responsibility of all levels, sectors, localities, people and tourists, especially for cadres, civil servants, public employees and party members to strictly implement legal regulations on organizing and participating in festivals; absolutely not to organize and participate in widespread and wasteful festivals; especially taking advantage of them to influence, engage in superstitious activities, etc.

Prime Minister directs to strengthen secondary and high school enrollment and management of extra teaching and learning

Prime Minister Pham Minh Chinh signed Official Dispatch No. 10/CD-TTg February 7, 2025 on strengthening the direction of junior high school enrollment, high school enrollment and management of extra teaching and learning activities.

The telegram requires localities to complete the announcement of junior high school and high school enrollment plans for the 2025-2026 school year in February 2025; at the same time, direct general education institutions in the area to strictly implement regulations on extra teaching and learning; and strictly handle violations of regulations.

The Prime Minister urged ministries, branches and localities to review and remove investment projects with difficulties and long-standing backlogs.

Prime Minister Pham Minh Chinh signed Official Dispatch No. 13/CD-TTg On February 8, 2025, ministries, branches and localities were requested to urgently review and fully report on investment projects with difficulties, obstacles and long-term backlogs to promptly resolve and immediately implement the projects.

The dispatch clearly states: Ministers, Heads of ministerial-level agencies, Government agencies, Chairmen of People's Committees of provinces and centrally-run cities urgently review carefully and fully summarize projects with difficulties, problems, and backlogs for a long time according to the forms and contents requested by the Ministry of Planning and Investment in Document 10339/BKHĐT-TTr dated December 16, 2024, and send them to the Prime Minister and the Ministry of Planning and Investment no later than February 15, 2025.

After February 15, 2025, if ministries, agencies and localities have not yet sent reports on reviewing and removing difficulties and obstacles related to projects to the Prime Minister and the Ministry of Planning and Investment, the Prime Minister will assign the Government Inspectorate to conduct inspections to consider responsibilities and strictly handle them according to the regulations of the Central Steering Committee for Anti-Corruption, Wastefulness and Negativity.

Government members' working delegation works with localities to promote production and business, striving to achieve the 2025 growth target

Prime Minister Pham Minh Chinh signed Official Dispatch No. 14/CD-TTg dated February 11, 2025 on organizing a working delegation of Government members to work with localities to promote production and business, public investment, import and export, national target programs, striving to achieve and exceed the growth target for 2025.

The telegram requests that Deputy Prime Ministers, Ministers, and Heads of ministerial-level agencies periodically organize working delegations with localities every quarter (or when necessary), focusing on urging the implementation of growth scenarios for each locality in 2025 assigned in Resolution No. 25/NQ-CP of the Government to successfully achieve the national growth target of 8% or more in 2025, creating a solid foundation to achieve double-digit growth rates in the period 2026 - 2030. Prime Minister requests proactive response to peak saltwater intrusion in the Mekong Delta and Ho Chi Minh City

Prime Minister Pham Minh Chinh signed Official Dispatch No. 15/CD-TTg February 17, 2025 on proactively responding to peak saltwater intrusion in the Mekong Delta and Ho Chi Minh City.

Prime Minister urges to promote allocation and disbursement of public investment capital in 2025

Prime Minister Pham Minh Chinh signed Official Dispatch No. 16/CD-TTg February 18, 2025, urging ministries, branches and localities to promote the allocation and disbursement of public investment capital in 2025.

The telegram requires ministries, central and local agencies to urgently allocate in detail the entire state budget capital investment plan for 2025 in the first quarter of 2025 in accordance with regulations, not to continue to delay, if by the end of the first quarter of 2025 it is not completed, the Government will recover it to allocate to other projects that need capital to complete; the detailed allocation of the capital plan must ensure focus, key points, not spread out, fragmented, consistent with the implementation capacity, disbursement and in accordance with legal regulations on public investment; strengthen discipline, discipline, strictly handle according to regulations investors, project management boards, organizations and individuals who intentionally delay the progress of allocation and disbursement of public investment capital; promptly replace cadres, civil servants and public employees who are weak in capacity, slow, causing harassment and trouble, resolutely handle negative and corrupt behaviors in public investment management.

Prime Minister Pham Minh Chinh signed Official Dispatch No. 17/CD-TTg February 20, 2025 on actively and proactively implementing solutions to promote circular economy, sustainable production and consumption, and sustainable trade in response to the green policies of the European Union.

The Prime Minister requested the Ministry of Industry and Trade to focus on providing technical support for green transformation to promote businesses to switch to sustainable production and business models; apply cleaner production solutions and efficient use of resources, use energy economically and efficiently, encourage the use of recycled materials and renewable energy; support businesses in applying innovative product design solutions to upgrade, repair, maintain, reuse and recycle, and extend product life cycles.

Prime Minister directs to strengthen implementation of solutions to reduce interest rates

Prime Minister Pham Minh Chinh signed Official Dispatch No. 19/CD-TTg dated February 24, 2025 to the Governor of the State Bank of Vietnam on strengthening the implementation of solutions to reduce interest rates. The dispatch requests the State Bank of Vietnam to preside over and coordinate with relevant agencies to immediately inspect and examine commercial banks that have adjusted their mobilization interest rates upward in the past; promptly and strictly handle violations, especially credit institutions that compete unfairly on interest rates, not in accordance with regulations (including mobilization interest rates and lending interest rates).

At the same time, the State Bank of Vietnam directed credit institutions to be willing to share part of their profits to reduce lending interest rates to support people and businesses in accessing bank credit capital, promoting production and business development, and creating livelihoods for people.

The Prime Minister directed the implementation of Resolution 190/2025/QH15 on handling a number of issues related to the reorganization of the state apparatus.

Deputy Prime Minister Le Thanh Long signed Official Dispatch No. 20/CD-TTg dated February 26, 2025 of the Prime Minister on the implementation of Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly regulating the handling of a number of issues related to the reorganization of the state apparatus.

The telegram requests ministries, branches and localities to urgently organize the full and serious dissemination of the contents of Resolution No. 190/2025/QH15 and issue and organize the implementation of the plan to implement Resolution No. 190/2025/QH15 at their ministries, agencies and localities before March 3, 2025; Carefully study the contents related to the functions, tasks and powers of their agencies after arranging the organizational apparatus to receive, respond, guide and answer questions related to the functions, tasks and powers of their agencies when receiving requests and recommendations from individuals and organizations.

The Government issued a Resolution setting growth targets for industries, sectors and localities to reach 8% or more by 2025.

The Government issued Resolution No. 25/NQ-CP February 5, 2025 on growth targets for industries, sectors and localities to ensure the national growth target in 2025 reaches 8% or more.

In order to successfully achieve the national growth target of 8% or more in 2025, creating a solid foundation to achieve double-digit growth in the 2026-2030 period, the Government requires ministries, branches and localities to urgently develop growth scenarios for sectors and fields on a monthly and quarterly basis; for the GRDP growth target, direct specialized agencies to closely coordinate with statistical agencies, based on the published GRDP data in 2024, review and develop GRDP growth scenarios by sector level 01 and 03 economic sectors and product taxes minus product subsidies on a quarterly basis to serve leadership, direction and administration.

Directive of the Prime Minister on submitting to the Government draft laws, ordinances and resolutions

On February 25, 2025, Prime Minister Pham Minh Chinh signed Directive No. 04/CT-TTg on submitting to the Government draft laws, ordinances and resolutions.

To further improve the quality of law-making work, the Prime Minister requires that the draft law dossier must be submitted to the Government at least 15 days before the date of the monthly Government meeting on law-making. Draft laws submitted to the Government at the meeting must be carefully prepared, with full participation of relevant ministries and agencies;..

For draft laws to be amended or supplemented, the dossier submitted to the Government must clearly state: (1) Content to be omitted, (2) Content to be amended or completed, (3) New content to be added; why?, (4) Issues with different opinions that require the Government's opinion and proposed solutions.

New functions, tasks and organizational structures of ministries, ministerial-level agencies and government agencies

In February, the Government issued a series of Decrees stipulating the functions, tasks, powers and organizational structures of ministries, ministerial-level agencies and government agencies. Specifically:

According to Decree No. 25/2025/ND-CP February 21, 2025, the Ministry of Home Affairs is a Government agency performing the state management function in the following sectors and fields: State administrative and career organizations; local government organizations; cadres, civil servants, public employees and public services; labor, wages, social insurance; employment; occupational safety and hygiene; associations, social funds, charity funds, non-governmental organizations; meritorious people; youth; gender equality; state documents and archives; emulation, rewards and state management of public services in the sectors and fields under the Ministry's state management according to the provisions of law. The Ministry of Home Affairs has 22 units.

Decree No. 26/2025/ND-CP dated February 24, 2025, the State Bank of Vietnam is a ministerial-level agency of the Government, the Central Bank of the Socialist Republic of Vietnam; performs the function of state management of currency, banking and foreign exchange activities and public services under the management of the State Bank; performs the function of the Central Bank in issuing money, banking of credit institutions and providing monetary services to the Government. The State Bank has 20 units.

According to Decree No. 27/2025/ND-CP February 24, 2025, Vietnam News Agency is a government agency, a national news agency, a key multimedia media agency, performing the function of publishing and broadcasting information and official documents of the Party and State; providing information to serve the leadership requirements of the Party and the management of the State; disseminating information to serve mass media agencies, the public and other subjects at home and abroad. Vietnam News Agency has 22 units.

According to Decree No. 28/2025/ND-CP dated February 24, 2025, the Ministry of Foreign Affairs is a Government agency, performing the function of unified state management of foreign affairs in the political system, including: Diplomatic affairs, borders, national territory, work on the Vietnamese community abroad, international treaties, international agreements, management of representative agencies of the Socialist Republic of Vietnam abroad (Vietnamese representative agencies abroad) and activities of foreign representative agencies in Vietnam; state management of public services in areas under the state management of the Ministry of Foreign Affairs according to the provisions of law; advising on strategic orientations and organizing the implementation of guidelines, policies, and foreign affairs activities of the Party and the State, directing people-to-people foreign affairs and foreign affairs at the local level according to regulations. The organizational structure of the Ministry of Foreign Affairs consists of 25 units.

According to Decree 29/2025/ND-CP dated February 24, 2025, the Ministry of Finance is a Government agency performing the state management function on: Socio-economic development strategies and plans; planning; development investment, business investment in Vietnam and business investment from Vietnam to foreign countries, investment promotion; state budget; state treasury; public debt; foreign aid to Vietnam and Vietnam's aid to foreign countries; taxes, fees, charges and other revenues of the state budget; state reserves; finance for extra-budgetary state financial funds; public assets; customs; accounting; auditing; prices; securities; insurance; bidding; enterprises, collective economy, cooperative economy, business households; economic zones; financial services and other services under the state management scope of the Ministry; statistics; Implement social insurance and health insurance policies, and represent the owner of state capital invested in enterprises according to the provisions of law. The Ministry of Finance has 35 units.

According to Decree No. 32/2025/ND-CP February 25, 2025, Vietnam Academy of Social Sciences is a government agency, performing the function of researching fundamental issues in social sciences; providing scientific arguments for the Party and State in formulating guidelines, strategies, planning, plans, and policies for rapid and sustainable development of the country to serve socio-economic development in the direction of socialism; advising on development policies in the field of social sciences; training human resources in social sciences according to the provisions of law. Vietnam Academy of Social Sciences has 26 units.

According to Decree No. 33/2025/ND-CP dated February 25, 2025, the Ministry of Construction is a Government agency performing the state management function on: Construction planning, architecture; construction investment activities; urban development; technical infrastructure; housing; real estate market; construction materials; road, railway, inland waterway, maritime, civil aviation transport nationwide; state management of public services in the fields of state management of the Ministry according to the provisions of law. The Ministry of Construction has 23 units.

According to Decree No. 35/2025/ND-CP dated February 25, 2025, the Ministry of Agriculture and Environment is a Government agency performing the function of state management in the following fields: agriculture; forestry; salt industry; fisheries; irrigation; disaster prevention; rural development; land; water resources; mineral and geological resources; environment; hydrometeorology; climate change; surveying and mapping; integrated management of marine and island resources and environmental protection; remote sensing; state management of public services in the fields under the Ministry's management. The Ministry of Agriculture and Environment has 30 units.

According to Decree No. 36/2025/ND-CP February 25, 2025, the Government Office has the function of providing general advice and coordination to help the Government and the Prime Minister organize general activities of the Government, lead, direct and operate the activities of the Government and the state administrative system from the central to the grassroots level, ensuring unity, smoothness and continuity of the national administration; controlling administrative procedures; ensuring information serving the leadership, direction and operation of the Government and the Prime Minister and providing information to the public in accordance with the provisions of law; ensuring material, technical and logistical conditions for the activities of the Government and the Prime Minister. The Government Office consists of 18 units.

According to Decree 37/2025/ND-CP dated February 26, 2025, the Ministry of Education and Training is a Government agency, performing the function of state management of preschool education, general education, vocational education, higher education, continuing education; vocational skills development; state management of Vietnamese language and ethnic languages; state management of public services under the state management scope of the Ministry. The Ministry of Education and Training has 18 units.

According to Decree No. 38/2025/ND-CP dated February 26, 2025, the Vietnam Academy of Science and Technology is a government agency, performing the function of basic research on natural sciences and technology development; providing scientific arguments for science and technology management and formulating policies, strategies, and plans for economic and social development; training highly qualified science and technology human resources according to the provisions of law. The Vietnam Academy of Science and Technology has 24 units.

According to Decree No. 39/2025/ND-CP dated February 26, 2025, the Ministry of Justice is a Government agency performing the state management functions of: Law making; law enforcement organization; civil judgment enforcement; judicial administration; judicial support; legal affairs; state management of public career services in the fields under the state management of the Ministry. The Ministry of Justice has 20 units.

According to Decree No. 40/2025/ND-CP, the Ministry of Industry and Trade is a Government agency performing the function of state management of industry and trade, including the following sectors and fields: Electricity, coal, oil and gas, new energy, renewable energy, energy saving and efficiency, chemicals, industrial explosives, mechanical industry, metallurgy industry, mining and mineral processing industry, consumer industry, food industry, supporting industry, environmental industry, high-tech industry (excluding information technology industry and digital technology industry); industrial clusters, small-scale industry, industrial promotion; domestic trade; import and export, border trade; logistics services; foreign market development; market management; trade promotion; e-commerce; trade services; international economic integration; competition, consumer rights protection; trade defense; public services in sectors and fields under the state management of the ministry. The Ministry of Industry and Trade has 22 units.

According to Decree No. 41/2025/ND-CP dated February 26, 2025, the Ministry of Ethnic Minorities and Religions is a Government agency performing the state management function in the following sectors and fields: Ethnic affairs; beliefs, religions and state management of public services in the sectors and fields under the state management of the Ministry according to the provisions of law. The Ministry of Ethnic Minorities and Religions consists of 13 units.

According to Decree No. 42/2025/ND-CP dated February 27, 2025, the Ministry of Health is a Government agency performing the state management function in the following areas: Preventive medicine; medical examination, treatment, rehabilitation; medical examination, forensic medicine, forensic psychiatry; mothers and children; population; prevention and control of social evils (except for drug addiction treatment and post-drug addiction treatment management); social protection; traditional medicine and pharmacy; pharmaceuticals and cosmetics; food safety; medical equipment; health insurance and state management of public services in areas under the state management of the Ministry of Health. The Ministry of Health consists of 20 units.

According to Decree No. 43/2025/ND-CP dated February 28, 2025, the Ministry of Culture, Sports and Tourism is a Government agency, performing the function of state management of culture; family; physical education and sports; tourism; press; radio and television; news agencies; publishing, printing, distribution; electronic information; grassroots information and foreign information nationwide; state management of public services in sectors and fields under the state management of the Ministry. The Ministry of Culture, Sports and Tourism has 25 units.

According to Decree No. 46/2025/ND-CP dated February 28, 2025, Voice of Vietnam (VOV) is a government agency, a national radio station, a key multimedia media agency performing the function of informing and propagating the Party's guidelines and policies and the State's laws; contributing to education, improving people's knowledge, serving the spiritual life of the people through radio programs, printed newspapers, and electronic newspapers. VOV consists of 21 units.

According to Decree No. 47/2025/ND-CP dated February 28, 2025, Vietnam Television is a government agency, a national television station, a key multimedia media agency, performing the function of informing and propagating the Party's guidelines and policies and the State's laws; contributing to education, improving people's knowledge, serving the spiritual life of the people through programs, television channels and types of press and media. regulating the functions, tasks, powers and organizational structure of Vietnam Television. Vietnam Television has 22 units.

New regulations on specialized agencies under the People's Committees at provincial and district levels, effective from March 1, 2025

The Government issued Decree No. 45/2025/ND-CP dated February 28, 2025 regulating the organization of specialized agencies under the People's Committees of provinces and centrally run cities and the People's Committees of districts, towns, provincial cities and centrally run cities.

In particular, Decree 45/2025/ND-CP stipulates that the departments are organized uniformly in localities, including: 1. Department of Home Affairs; 2. Department of Justice; 3. Department of Finance; 4. Department of Industry and Trade; 5. Department of Agriculture and Environment; 6. Department of Construction; 7. Department of Science and Technology; 8. Department of Culture, Sports and Tourism; 9. Department of Education and Training; 10. Department of Health; 11. Provincial Inspectorate; 12. Office of the People's Committee.

Decree 45/2025/ND-CP stipulates that specific departments are organized in a number of localities, including: 1. Department of Foreign Affairs; 2. Department of Ethnic Minorities and Religions; 3. Department of Tourism; 4. Department of Planning and Architecture established in Hanoi and Ho Chi Minh City.

Each province is organized with no more than 14 departments, except for Hanoi and Ho Chi Minh City, which are organized with 15 departments.

New regulations on management, use and exploitation of railway infrastructure assets

The Government issued Decree No. 15/2025/ND-CP February 3, 2025 regulating the management, use and exploitation of railway infrastructure assets.

This Decree regulates the management, use and exploitation of railway infrastructure assets invested and managed by the State, including: National railway infrastructure assets and urban railway infrastructure assets.

The Decree clearly states that all existing national railway infrastructure assets are assigned to national railway asset management enterprises without calculating the state capital component in the enterprise.

Increase the level of benefits and policies for militia and self-defense forces

The Government issued Decree No. 16/2025/ND-CP dated February 4, 2025 amending and supplementing a number of articles of Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Militia and Self-Defense Forces on the organization and building of forces and regimes and policies for Militia and Self-Defense Forces.

Accordingly, Decree No. 16/2025/ND-CP amends Clause 1, Article 7 of Decree No. 72/2020/ND-CP regulating the allowance level for the position of commander of the Militia and Self-Defense Forces.

According to the new regulations, Commanders and Political Commissars of Commune-level Military Commands; Commanders and Political Commissars of Military Commands of agencies and organizations are entitled to an allowance of VND 561,600 (the old regulation was VND 357,600).

Deputy Commanders, Deputy Political Commissars of Commune-level Military Commands; Deputy Commanders, Deputy Political Commissars of Military Commands of agencies and organizations; Battalion Commanders, Battalion Political Commissars; Naval Commanders, Naval Political Commissars; Naval Squadron Commanders, Political Commissars of permanent militia squadrons; Company Commanders, Political Commissars of mobile militia companies are entitled to an allowance of 514,800 VND (old regulation was 327,800 VND).

Deputy Battalion Commander, Deputy Battalion Political Commissar; Deputy Naval Commander, Deputy Naval Political Commissar; Deputy Naval Squadron Commander, Deputy Political Commissar of the permanent militia squadron; Deputy Company Commander, Deputy Political Commissar of the mobile militia company are entitled to an allowance of 491,400 VND (old regulation was 312,900 VND).

Company Commanders, Company Political Commissars; Squadron Commanders, Squadron Political Commissars; Mobile Militia Platoon Leaders, and Permanent Militia Platoon Leaders receive an allowance of 468,000 VND (old regulation was 298,000 VND)...

Amending detailed regulations on a number of articles and measures to implement the Law on Bidding

The Government issued a Decree 17/2025/ND-CP dated February 6, 2025 amending and supplementing a number of articles of the Decrees detailing a number of articles and measures for implementing the Law on Bidding.

Accordingly, Decree No. 17/2025/ND-CP amends and supplements a number of articles of Decree No. 23/2024/ND-CP dated February 27, 2024 of the Government detailing a number of articles and measures to implement the Law on Bidding on selecting investors to implement projects in cases where bidding must be organized according to the provisions of the law on industry and sector management; Decree No. 24/2024/ND-CP dated February 27, 2024 detailing a number of articles and measures to implement the Law on Bidding on selecting contractors; Decree No. 115/2024/ND-CP dated September 16, 2024 detailing a number of articles and measures to implement the Law on Bidding and the Law on Land on selecting investors to implement investment projects using land.

Regulations on ensuring performance of electricity purchase and sale contracts

The Government issued Decree No. 18/2025/ND-CP dated February 8, 2025 detailing a number of articles of the Electricity Law related to electricity trading activities and situations of ensuring electricity supply.

In particular, the Decree states that the electricity buyer is an electricity customer with an average electricity consumption of 1,000,000 kWh/month or more as registered in the electricity purchase contract, and is responsible for implementing measures to ensure contract performance before the electricity purchase contract takes effect. In case the average electricity consumption registered in the electricity purchase contract is lower than this level, but the actual average electricity consumption in the last 12 months is 1,000,000 kWh/month or more, the electricity buyer is responsible for coordinating with the electricity seller to amend and supplement the signed electricity purchase contract to add content on contract performance assurance and implement measures to ensure contract performance before the amended and supplemented contract takes effect. Every year, the electricity seller and the electricity buyer agree on the contract performance guarantee value in accordance with the average electricity consumption in the previous 12 consecutive months.

Amendments to regulations on tax management for enterprises with related transactions

The Government issued Decree No. 20/2025/ND-CP dated February 10, 2025 amending and supplementing a number of articles of Decree No. 132/2020/ND-CP dated November 5, 2020 regulating tax management for enterprises with related-party transactions.

In particular, Decree No. 20/2025/ND-CP amends and supplements Point d, Clause 2, Article 5 of Decree No. 132/2020/ND-CP on related parties as follows: d) An enterprise guarantees or lends capital to another enterprise in any form (including loans from third parties secured by the financial resources of the related party and financial transactions of a similar nature) on the condition that the total outstanding loans of the borrowing enterprise with the lending or guarantor enterprise is at least equal to 25% of the capital contribution of the owner of the borrowing enterprise and accounts for more than 50% of the total outstanding loans of all medium- and long-term debts of the borrowing enterprise.

The provisions in Point d above do not apply to the following cases:

d.1) The guarantor or lender is an economic organization operating under the provisions of the Law on Credit Institutions 2024 that does not directly or indirectly participate in the management, control, capital contribution, or investment in the borrowing enterprise or the guaranteed enterprise as prescribed in points a, c, d, e, g, k, l, and m of this clause.

d.2) The guarantor or lender is an economic organization operating under the provisions of the Law on Credit Institutions and the borrowing or guaranteed enterprise is not directly or indirectly subject to the management, control, capital contribution or investment of another party as prescribed in points b, e and i of this clause.

Implement the Automotive Support Industry Tax Incentive Program until December 31, 2027

The Government has issued Decree No. 21/2025/ND-CP dated February 10, 2025 amending and supplementing Article 9 of Decree No. 26/2023/ND-CP on Export Tariff Schedule, Preferential Import Tariff Schedule, List of goods and absolute tax rates, mixed tax, import tax outside tariff quota.

Accordingly, Decree No. 21/2025/ND-CP stipulates a preferential import tax rate of 0% for raw materials, supplies, and components that cannot be produced domestically for the production, processing (assembly) of priority support products for the development of the automobile manufacturing and assembly industry (referred to as automobile support industry products) until December 31, 2027 (stipulated in Decree 26/2023/ND-CP is until December 31, 2024).

Supplementing regulations on other legal capital sources for planning establishment, announcement and adjustment

The Government issued Decree No. 22/2025/ND-CP Amending and supplementing a number of articles of Decree No. 37/2019/ND-CP dated May 7, 2019 of the Government detailing the implementation of a number of articles of the Law on Planning, which has been amended and supplemented by a number of articles under Decree No. 58/2023/ND-CP dated August 12, 2023.

In particular, Decree No. 22/2025/ND-CP amends and supplements Article 3a on other legal capital sources for planning establishment, announcement and adjustment as follows:

1. Other legal sources of capital for planning establishment, announcement and adjustment include support resources from domestic organizations and individuals and foreign organizations and individuals as prescribed in Clause 2 of this Article.

2. Support resources from domestic and foreign organizations and individuals include funding; research results of agencies, organizations, experts; sponsorship of awards for organizations and individuals with planning ideas selected based on the results of the planning idea competition organized by the planning agency (if any); support for organizing conferences, seminars, training, research, surveys, training; planning products; documents serving planning are received, managed and used as follows:

a) Financial support resources from domestic agencies, organizations, individuals and foreign individuals are received, managed and used in accordance with the provisions of the law on state budget;

b) Support resources from foreign agencies and organizations are received, managed and used in accordance with the provisions of law on management and use of official development assistance (ODA), preferential loans and non-refundable aid not included in official development assistance from foreign agencies, organizations and individuals for Vietnam;

c) Support resources in the form of research results of agencies, organizations, and experts; sponsorship of awards for organizations and individuals with planning ideas selected based on the results of the planning idea competition organized by the planning agency (if any); support for organizing conferences, seminars, training, research, surveys, and education; documents serving planning are received, managed, and used in accordance with the provisions of the law on planning and other relevant laws;

d) For resources supported by products such as planning documents and planning adjustment documents, the sponsor decides on the implementation costs, the form of selecting a planning consulting organization, the form of selecting a planning consulting organization, etc.

Conditions for reliable service business

In Decree No. 23/2025/ND-CP On February 21, 2025, the Government issued regulations on electronic signatures and trusted services, clearly stating the regulations on conditions for doing business in trusted services.

According to the Decree, enterprises are entitled to register for one or more trusted services. When registering for any trusted service, enterprises must satisfy all the conditions specified in Clause 1, Article 29 of the Law on Electronic Transactions.

Increase administrative penalties for violations of consumer rights protection

Decree No. 24/2025/ND-CP dated February 21, 2025 of the Government amending and supplementing many regulations on administrative sanctions for violations of consumer rights protection.

In particular, Decree No. 24/2025/ND-CP stipulates increased penalties for administrative violations of consumer rights protection.

Specifically, for violations of consumer information protection, Decree No. 24/2025/ND-CP stipulates a fine of 20-30 million VND for the following acts: Collecting and using consumer information without the consumer's consent as prescribed; using consumer information inaccurately or inconsistently with the notified purpose and scope.

A fine of 30-40 million VND is applied to the following acts: Not having measures to ensure the safety and security of consumer information when collecting, storing, using, or not having measures to prevent violations of consumer information safety and security as prescribed.

If consumer information is transferred to a third party without the consumer's consent as prescribed, a fine of 30-40 million VND will also be imposed.

(According to Decree 98/2020/ND-CP, violations of consumer information protection are only subject to fines of 10-20 million VND).

Add criteria to identify low-income workers

The Government issued Decree No. 30/2025/ND-CP dated February 24, 2025 amending and supplementing a number of articles of Decree No. 07/2021/ND-CP dated January 27, 2021 stipulating multidimensional poverty standards for the period 2021 - 2025. In particular, Decree No. 30/2025/ND-CP supplements regulations on criteria and procedures for reviewing and identifying low-income workers under the National Target Program on Sustainable Poverty Reduction for the period 2021 - 2025.

New regulations on management of export and import of cultural products not for business purposes

The Government issued Decree No. 31/2025/ND-CP dated February 24, 2025. In particular, Decree No. 31/2025/ND-CP amends and supplements Article 7 of Decree No. 32/2012/ND-CP as follows: Export of cultural products not for business purposes: Individuals and organizations with exported cultural products that have been legally produced, published, disseminated and circulated in Vietnam when exporting only carry out customs procedures according to the provisions of the law on customs, except in cases where the law provides otherwise...

Regulations on management of diving vessels operating in tourism in Vietnam's seaport waters

The Government issued Decree No. 34/2025/ND-CP dated February 25, 2025 amending and supplementing a number of articles of Decrees in the maritime sector; including adding a separate chapter regulating the management of diving vessels operating in tourism activities in Vietnam's seaport waters.

In particular, the Decree clearly states that diving vessels are only allowed to operate in diving areas approved by the Vietnam Maritime Administration and assigned sea areas by competent authorities.

Method of determining the Salary Fund of employees and the Executive Board

The Government issued Decree No. 44/2025/ND-CP dated February 28, 2025 regulating the management of labor, wages, remuneration and bonuses in state-owned enterprises.

The Decree stipulates that the salary fund of employees and the Executive Board is determined according to the following methods:

1- Determine the salary fund through the average salary level;

2- Determine the salary fund through stable salary unit price. This method is only applicable to enterprises that have been in operation for at least the expected time of applying stable salary unit price.

Individuals with tax debts of 50 million VND or more are temporarily suspended from leaving the country.

The Government issued Decree No. 49/2025/ND-CP dated February 28, 2025 regulating the threshold for temporary suspension of exit.

The Decree stipulates the application of tax debt thresholds and debt periods in cases of temporary suspension of exit as follows:

1- Business individuals and business household owners who are subject to compulsory enforcement of administrative decisions on tax management have tax debts of 50 million VND or more and the tax debts have been overdue for more than 120 days.

2- Individuals who are legal representatives of enterprises, cooperatives, and cooperative unions that are subject to compulsory enforcement of administrative decisions on tax management with tax arrears of VND 500 million or more and the tax arrears have been overdue for more than 120 days.

3- Business individuals, business household owners, individuals who are legal representatives of enterprises, cooperatives, and cooperative unions that are no longer operating at the registered address and have tax arrears that are past the prescribed payment deadline and have not fulfilled their tax payment obligations after 30 days from the date the tax authority notifies them of the application of temporary exit suspension measures.

4- Vietnamese people leaving the country to settle abroad, Vietnamese people settling abroad, foreigners who have tax debts past the deadline for payment according to regulations and have not yet fulfilled their tax payment obligations before leaving Vietnam.

Amending regulations on electronic border procedures at land border gates

Prime Minister Pham Minh Chinh signed Decision No. 03/2025/QD-TTg dated February 12, 2025 amending and supplementing a number of articles of Decision No. 15/2019/QD-TTg dated March 28, 2019 on implementing electronic border procedures at border gates managed by the Ministry of National Defense.

Decision 03/2025/QD-TTg amends and supplements Point a, Clause 2, Article 5 on the location for performing electronic border procedures at land border gates. Accordingly, the person performing the procedure declares the electronic border dossier and receives confirmation of completion of the declaration of electronic border procedures at the land border gate using an electronic identification account created and authenticated in accordance with the law on electronic identification and authentication and the provisions of this Decision at any place with Internet access.

Compensation regime for members of the National Competition Commission applies from April 1, 2025

Deputy Prime Minister Le Thanh Long issued Decision No. 04/2025/QD-TTg on compensation regime for members of the National Competition Commission, competition litigants, experts, interpreters and witnesses.

According to the Decision, members of the National Competition Commission are entitled to a special allowance of VND 2,340,000/person/month.

Key administrative procedure reform plan for 2025

Permanent Deputy Prime Minister Nguyen Hoa Binh signed Decision No. 240/QD-TTg On February 4, 2025, the 2025 key administrative procedure reform plan was issued.

Deputy Prime Minister Bui Thanh Son signed Decision No. 245/QD-TTg February 5, 2025 approving the Plan for development and application of atomic energy for the period up to 2030, with a vision to 2050.

The general goal of developing and applying atomic energy by 2030 is that the legal system, policy mechanisms and state management agencies on atomic energy are completed in accordance with international practices; the system of research, application and training facilities in the field of atomic energy is streamlined, upgraded in terms of technical facilities and human resource quality, and operates effectively; a number of key projects have been approved and implemented on schedule; a number of areas of science, technology and application of atomic energy have strengths to reach advanced levels in the region.

Plan to innovate and improve the quality of vocational education by 2030, vision to 2045

Deputy Prime Minister Le Thanh Long signed Decision No. 247/QD-TTg On February 6, 2025, the Party Central Committee issued a Plan to implement Directive No. 21-CT/TW dated May 4, 2023 of the Party Central Committee Secretariat on innovation, development and improvement of the quality of vocational education to 2030, with a vision to 2045.

The plan sets out 11 key tasks and solutions to innovate, develop and improve the quality of vocational education by 2030, with a vision to 2045.

Specifically: 1- Strengthening propaganda and education, creating profound changes in awareness of the role, position and importance of vocational education by 2030, with a vision to 2045; 2- Perfecting the legal system, mechanisms and policies for innovation and development of vocational education; 3- Improving the effectiveness and efficiency of state management; assessing and inspecting the quality of vocational education; 4- Reviewing, arranging and reorganizing the system of vocational education institutions; 5- Accelerating the roadmap for vocational universalization for youth, workers, farmers and laborers; 6- Innovating the content, programs, training methods and training management organization; 7- Developing the team of teachers, experts, vocational trainers and managers in vocational education; 8- Improving the effectiveness of linkage and cooperation in vocational education between the State - Schools - Enterprises; 9- Strengthening resources and improving investment efficiency for vocational education; 10- Being proactive, positive, and improving the effectiveness of international integration in vocational education; 11- Scientific research, technology application, and innovation; career guidance, innovative startups.

Deputy Prime Minister Le Thanh Long signed the Decision 270/QD-TTg February 13, 2025 approved the "Pharmaceutical Industry Development Program to 2030, with a vision to 2045".

The general objective of the Project is to raise awareness of society and authorities at all levels about the position and role of the elderly; awareness and aspirations of cadres, members and the elderly about the Party's guidelines and policies and the State's laws on the elderly's participation in promoting digital transformation, green transformation, entrepreneurship and job creation in the new development stage.

National Strategy on Elderly People to 2035, Vision to 2045

Deputy Prime Minister Le Thanh Long signed Decision No. 383/QD-TTg February 21, 2025 approved the National Strategy on the Elderly to 2035, with a vision to 2045.

The strategy strives for the period 2025 - 2030 to have at least 50% of the elderly who have the need and ability to work have jobs; at least 100,000 elderly people receive career guidance and career transition training at vocational training facilities, social assistance facilities, and job service centers; at least 100,000 households with elderly people who have the need and are eligible to borrow capital to start a business, develop production and business with preferential interest rates.

Approval of the General Planning Task for the Construction of Chi Ma Border Gate Area

Deputy Prime Minister Tran Hong Ha signed Decision No. 393/QD-TTg February 24, 2025 approved the Master Plan for construction of Chi Ma border gate area, Loc Binh district, Lang Son province to 2045.

The general planning objective for the construction of the Chi Ma main border gate area, Lang Son province by 2045 is to build the Chi Ma main border gate area into a dynamic, effective, internationally developed economic zone, an important growth pole in the East of Lang Son province. The Chi Ma border gate area is an important economic, commercial, service and tourism area of ​​Lang Son province.

Prime Minister Pham Minh Chinh has just signed Decision No. 444/QD-TTg On February 27, 2025, the target of completing social housing in 2025 and the following years until 2030 was assigned for localities to add to the socio-economic development target. Accordingly, the target of social housing that localities must complete in the 2025 - 2030 period is 995,445 apartments.
