On the afternoon of June 27, continuing the 7th Session, the National Assembly discussed in the hall the draft Law on Fire Prevention, Fire Fighting and Rescue.
Clearly define housing combined with production and business
Participating in the discussion, delegate Duong Khac Mai (Dak Nong delegation) said that "fire" has become a keyword that is not difficult to find on information sites and social networks.
“Fire, fire again and somewhere else is burning. Fire has many different causes and reasons, but the thing to say is that in many cases, when there is a fire, you don’t know where to run and you can’t run because you are surrounded by iron frames, also known as tiger cages,” said Mr. Mai.
Mr. Mai continued to emphasize: “If you cannot escape from a fire, it means you will die. This is a very sad reality that has happened recently in many places at many different levels.”
Faced with the above reality, the delegate expressed his agreement with the necessity of promulgating the Law on Fire Prevention, Fire Fighting and Rescue to meet the practical requirements of ensuring security and order; protecting human life, health, and property of the State, agencies, organizations, and individuals.

Comments on some specific contents on Fire Prevention for Housing (Article 17) - this is an issue of concern to many people, especially for types of housing in the city such as alleys and apartments where very serious fires and explosions have occurred recently.
However, Mr. Mai acknowledged that the draft Law does not have specific regulations on conditions for ensuring fire prevention and fighting, especially for houses combined with production and business. Therefore, the delegate suggested clarifying the conditions for ensuring fire safety for houses combined with business, and having a more specific and thorough impact assessment to ensure feasibility when implementing the Law.
Clause 2, Article 36 on Mobilization of forces, means and assets for participation in rescue and relief stipulates: “Means and assets of agencies, organizations, households and individuals mobilized for rescue and relief must be returned immediately after the rescue and relief are completed. In case the mobilized means and assets are damaged or houses and constructions are demolished according to the provisions of this Law, compensation shall be made according to the provisions of law”.
The delegate proposed to add Clause 4 "The Government shall specify the details of Clause 2 of this Article".

At the same time, delegate Duong Khac Mai proposed to review and study relevant regulations in the Law on Forces Participating in Protecting Security and Order at the Grassroots Level to have unified regulations for the Fire Prevention, Fire Fighting and Rescue Force according to Article 40 and Article 41 of the draft Law with regulations on forces, establishment and management of civil defense forces, fire prevention, fire fighting and rescue at grassroots and specialized levels.
Regarding the duties of civil defense forces, fire prevention, fire fighting, and rescue forces at the grassroots and specialized levels, Clause 3, Article 42 stipulates: "Participate in fire fighting, rescue, and rescue when requested."
Delegates proposed to remove the phrase "when requested" because Clauses 11, 12, 13, Article 3 of the draft Law stipulates: civil defense forces; fire prevention, firefighting, and rescue forces at the grassroots level; specialized fire prevention, firefighting, and rescue forces are forces established to perform fire prevention, firefighting, and rescue tasks, so they are naturally responsible for participating in the area under their responsibility.
Compared to many other laws, delegate Duong Khac Mai emphasized that the Law on Fire Prevention and Fighting has a fairly high level of stability, but in reality, "fire is not stable at all and is even uncertain". Therefore, stricter regulations are needed.
A separate chapter on escape is needed.
Delegate Pham Van Hoa (Dong Thap delegation) basically agreed with the Submission and the Inspection Report on the necessity of promulgating the Law on Fire Prevention, Fire Fighting and Rescue to overcome the limitations and shortcomings of the current Law; meet practical requirements, have strong enough regulations to prevent, deter, and propagate awareness of fire prevention, fire fighting and rescue.
Mr. Hoa emphasized that fire prevention, fire fighting, and rescue are the responsibility of all people, the entire political system, and the management responsibility of the State and specialized agencies.

However, the delegate suggested that the Drafting Agency study the contents that are clear and mature and propose to directly stipulate them in the law, limiting the assignment of detailed regulations to the Government and the Ministry of Public Security to ensure objectivity and clarity.
The delegate cited evidence that in Chapter 7, there are 9 articles, of which 8 are assigned to the Government for detailed regulations; 25/63 articles assigned to the Government and the Ministry of Public Security for regulations is relatively a lot.
Giving his opinion on the draft Law, delegate Nguyen Van Canh (Binh Dinh delegation) said that the explanation of terms includes provisions on fire prevention, fire fighting, rescue, and escape, but most of the victims died because they did not know how to escape when rescue forces had not arrived in time to organize an escape.
Mr. Canh said that escape is the act of individuals or groups of people moving by themselves to escape from an area where a fire or explosion or dangerous incident is occurring through an available escape route. Thus, escape is not included in the concept of fire prevention, fire fighting, rescue or relief.
Therefore, the delegates proposed that the Law should be divided into 5 main parts: fire prevention, fire fighting, escape, rescue, and salvage. The Law will supplement the explanation of the term escape and the name of the Law can be adjusted to the Law on Fire Prevention, Fire Fighting, Escape, Rescue, and Salvage.
The law also needs a separate chapter regulating escape; this chapter will regulate the responsibility of instructing people, students, and children on escape procedures in different spaces, locations, and circumstances to improve escape efficiency .
