Need special mechanism to preserve rare cultural heritage

On the morning of April 17, at the 32nd session, the National Assembly Standing Committee gave opinions on the Draft Law on Cultural Heritage Amendment.

Cultural heritage in many places has not been fully exploited.

Minister of Culture, Sports and Tourism Nguyen Van Hung said the draft law has 9 chapters and 102 articles, an increase of 2 chapters and 29 articles compared to the current law.

The revised Law on Cultural Heritage is necessary to institutionalize the Party and State's guidelines and policies on culture and cultural heritage in line with the current practice of managing, protecting and promoting the value of cultural heritage, promoting the attraction of socialized resources, public-private partnership, application of science and information technology, digital transformation to meet the requirements of conservation and sustainable, comprehensive development and international integration.

According to Mr. Nguyen Van Hung, on the basis of inheriting the relevant contents of the current law, the Draft Law on Cultural Heritage Amendment focuses on 3 policy groups approved by the Government in Resolution No. 159/NQ-CP.

Commenting, National Assembly Chairman Vuong Dinh Hue emphasized that cultural heritage must be considered a resource for preservation and promotion. The relationship between preservation and promotion of cultural heritage values ​​needs to be reviewed throughout this law in the spirit of development creation.

The National Assembly Chairman said that it is necessary to study and supplement policies and strategies for developing cultural industries, cultural markets, digitizing cultural heritage, and public-private cooperation in developing culture and cultural economics.

Mr. Vuong Dinh Hue noted that it is necessary to review the Law on Investment under the public-private partnership model, and some pilot policies for localities. This is to implement the policy of diversifying resources for cultural preservation and development. For example, in Hue, some relics can be both promoted and preserved if they have private resources invested according to the State's direction. However, in some localities, cultural heritage has not been fully exploited.

The National Assembly Chairman also wondered how to set a unit price so that the works can last forever, but with a normal investment level like other works, it is very difficult.

“The recent Law on the Capital City gives the authority to the Hanoi People’s Council to decide, but with regard to the projects of the Capital City only, what about the whole country now? I see many localities are very confused about this story. Should we study and supplement specific policies to preserve ethnic cultural heritage in mountainous areas, islands, and rare cultural heritage at risk of being lost?” – Mr. Vuong Dinh Hue said.

Should a Cultural Heritage Conservation Fund be established?

The draft stipulates the establishment of a Cultural Heritage Conservation Fund. This is a state financial fund outside the budget to support funding for a number of activities to protect and promote the value of cultural heritage that have not been invested in, supported or invested in inadequately by the state budget.

The fund's financial resources are formed on the basis of aid, sponsorship, support, and donations from domestic and foreign organizations and individuals and other legal financial sources outside the State budget.

In a preliminary review, Chairman of the Committee for Culture and Education Nguyen Dac Vinh informed that some opinions said that in Resolution No. 792 of 2019, the National Assembly Standing Committee requested the Government to review and evaluate the operational efficiency of financial funds of a number of laws.

In fact, when passing a number of laws, the National Assembly abolished a number of funds established under specialized laws, such as: Fund for supporting, treating and caring for people infected with HIV; Fund for supporting medical examination and treatment; Fund for preventing and combating the harmful effects of alcohol. Therefore, Mr. Nguyen Dac Vinh proposed to continue considering the establishment of a Fund for preserving cultural heritage.

Chairman of the Law Committee Hoang Thanh Tung proposed reviewing the draft law to ensure compliance with the State Budget Law. Clause 5, Article 88 of the draft law stipulates that “the use and exploitation of cultural heritage owned by the entire people to generate revenue for the State must comply with the provisions of this law and other relevant laws; a portion may be retained for direct use in protecting and promoting the value of cultural heritage”.

“We share the need for funding to ensure the management and promotion of cultural heritage values. But this is not in line with the State Budget Law. We cannot keep a portion of the revenue for spending,” the Chairman of the Law Committee analyzed.

As planned, the Draft Law on Cultural Heritage Amendment will be submitted to the National Assembly for first comments at the 7th session next May.
