The Ministry of Home Affairs has proposed that from the time the Law on Cadres and Civil Servants (amended) takes effect, commune-level cadres and civil servants will be under the payroll of provinces and centrally-run cities.

Unified management of cadres and civil servants

The Ministry of Home Affairs has completed the draft Law on Cadres and Civil Servants (amended). This draft is being consulted and is expected to be submitted to the National Assembly at its 9th session, taking place in May.

In this revision, the project provides regulations related to cadres and civil servants when organizing two-level local government (provincial and grassroots levels).

Notably, the draft law unifies the management of cadres and civil servants from the central to local levels, without distinguishing between commune-level cadres and civil servants and central and provincial-level cadres and civil servants, ensuring proper implementation of the Party's policy on interconnectivity in cadre work.

To ensure consistency with the two-level local government organization model, the draft stipulates that the authority of the district-level People's Committee and the chairman of the district-level People's Committee will no longer be specified in the draft law.

In addition, the draft law also provides transitional provisions to unify the management of the current communal-level cadres and civil servants with those in the political system. This is to ensure continuity in personnel work so as not to affect the normal operations of people and businesses when implementing the two-level local government model.

On that basis, the Ministry of Home Affairs proposed that from the time this amended law takes effect, commune-level officials and civil servants will be under the payroll of the province or centrally-run city.

This grassroots cadre group is also ranked according to the salary scale and level corresponding to the assigned job position if they meet the standards and conditions required by the job position.

Recruitment, employment and management shall be carried out in accordance with Government regulations. In case of non-qualification and non-conditions as required for the job position, the competent authority shall consider and decide to streamline the position in accordance with regulations.

Civil servants 'come in and go out'

Another notable point is that this amendment also provides regulations related to the management and use of cadres and civil servants as a basis for screening, restructuring, and improving the quality of the team when implementing the arrangement and streamlining of the organizational apparatus.

On that basis, the State will implement a mechanism for managing cadres and civil servants according to job positions, taking job positions as the center in the management and use of cadres and civil servants. At the same time, there will be strong innovations in recruitment, training, promotion, appointment, rotation, and evaluation of cadres and civil servants in a practical direction, based on specific products.

Along with that, the draft also adds regulations to distinguish between job positions that must be recruited and job positions that can be contracted to perform tasks, creating flexibility in the use of human resources.

The policy of attracting and promoting talented people, the mechanism of screening the team according to the principle of competition, with entry and exit, promotion and demotion are also clearly demonstrated, to resolve the situation of avoidance, pushing, procrastination, and the mentality that once in the government, one is safe. Thereby, contributing to ensuring the building of a team of experts, quality, with enough virtue and talent to serve better.
