This is one of the notable contents in the draft Decree amending and supplementing a number of articles of Decree No. 138/2020 on recruitment, use and management of civil servants and Decree No. 06/2023 on quality assessment of civil servant input.
Difficult to ensure feasibility, affecting recruitment
The Ministry of Home Affairs said that Resolution No. 26 of the 7th Central Conference of the 12th tenure has determined the policy of "unifying the quality assessment of civil servant input so that localities, agencies and units can select and recruit according to requirements and tasks; at the same time, research and decentralize assessment according to specific fields and regions".
Since then, the Law amending and supplementing a number of articles of the Law on Cadres, Civil Servants and the Law on Public Employees in 2019 has added regulations on conducting quality assessment of civil servant input, except for some cases as prescribed. The quality assessment of civil servant input is carried out according to a roadmap, ensuring publicity, transparency, practicality and efficiency. This matter is assigned to the Government for detailed regulations.
In February 2023, the Government issued Decree No. 06/2023 regulating the quality assessment of civil servant input, effective from April 2023. Accordingly, from August 1, 2024, civil servant recruitment agencies will only recruit civil servants who pass the assessment.
This Decree also abolishes regulations related to the organization of round 1 exams (general knowledge, foreign languages, and information technology) and the order and procedures for organizing round 1 exams, from August 1, 2024, as prescribed in Decree No. 138/2020 on recruitment, use, and management of civil servants.
Pursuant to Decree 06, the Minister of Home Affairs issued Circular No. 17/2023 stipulating the internal regulations and rules for organizing the quality assessment of civil servant input; presiding over and coordinating with relevant agencies and organizations to issue a list of documents used for building a question and answer bank to serve the quality assessment of civil servant input and documents directing the implementation.
At the end of November 2023, the Ministry of Home Affairs organized a technical test to assess the quality of the input quality of civil servants to evaluate the quality of the developed assessment questions; the suitability of the questions and answers to meet the assessment requirements according to the provisions of Decree No. 06...
The Ministry of Home Affairs said that more than 100 final-year students from Hanoi National University, Hanoi University of Science and Technology, and the National Academy of Public Administration (schools with extensive experience in organizing competency assessments and directly participating in building the question and answer bank for the assessment) registered to volunteer for this exam.
However, according to the assessment of the Ministry of Home Affairs, the implementation process has encountered some difficulties in organizational experience and procedures for implementing the policy of investing in equipment and facilities to serve the unified inspection of input quality.
The Ministry of Home Affairs stated that the scale and scope of the exam organization is relatively large, so the amount of work to be done is very large, requiring more time to ensure synchronization and consistency. The implementation of the work needs to be done step by step, with a roadmap and ensuring that it does not affect the recruitment of ministries, branches and localities.
Therefore, if the regulation from August 1 this year is maintained to only recruit civil servants who pass the assessment, it will be difficult to ensure feasibility, affecting the recruitment work of agencies, organizations, units and the rights of candidates.
Still recruiting civil servants according to current regulations
To resolve these difficulties and problems, the Ministry of Home Affairs has sent an official dispatch to the Ministry of Justice to seek opinions on amending regulations on implementing quality control of civil servant input.
With the agreement of the Ministry of Justice, the Ministry of Home Affairs reported to the Prime Minister and Deputy Prime Minister Tran Luu Quang for permission to amend the regulations.
Deputy Prime Minister Tran Luu Quang has directed the Ministry of Home Affairs to report and clarify the proposal for the Government to consider and decide, as a basis for ministries, branches and localities to unify implementation and research, propose amendments and supplements to relevant legal documents, ensuring consistency and synchronization in the application process.
On that basis, the Ministry of Home Affairs proposed that the Government allow the abolition of the regulation that "from August 1, 2024, civil servant recruitment agencies will only recruit civil servants who pass the assessment".
At the same time, a regulation is added allowing candidates who have passed the civil service entrance quality assessment within the time limit to not have to take the first round of the exam.
To promptly resolve some difficulties and problems in civil servant recruitment, the Ministry of Home Affairs proposed that the Government and the Prime Minister allow amendments and supplements to a number of articles of Decree No. 06 under simplified procedures.
According to the Ministry of Home Affairs, the removal of the above regulation is consistent with the provisions of the Law on Promulgation of Legal Documents and documents guiding their implementation, ensuring that competent agencies recruiting civil servants continue to fully exercise their recruitment authority as prescribed.
Agencies are proactive in developing recruitment plans, organizing recruitment and still organizing round 1 exams according to current regulations, regardless of the fact that candidates must have the results of the civil servant input quality assessment to be able to participate in the recruitment exam.
The Ministry of Home Affairs will continue to conduct quality assessment of civil servant input in accordance with the policy set forth in Resolution No. 26 of the Central Committee and the provisions of the Law amending and supplementing a number of articles of the Law on Cadres, Civil Servants and the Law on Public Employees, properly implementing the requirements of unified assessment according to the roadmap, ensuring publicity, transparency, practicality and efficiency.
