The Ministry of Industry and Trade issued an official dispatch to relevant units to solicit comments on the draft Decree amending and supplementing the Government's Decree on industrial promotion.
Accordingly, in order to carry out the assigned tasks in the Government's and Prime Minister's work programs in 2024 on developing a draft Decree amending and supplementing Decree No. 45/2012/ND-CP dated May 21, 2012 of the Government on industrial promotion (Decree), submitting it to the Government for consideration and decision in December 2024, the Ministry of Industry and Trade has coordinated with relevant ministries, branches, agencies and units to develop a draft Decree, a draft Submission to the Government and related documents.
According to the Ministry of Industry and Trade, the completion of the law on industrial promotion has been closely directed and led by the Party, Government and Prime Minister to create new momentum to promote rural industrial development, contributing to comprehensively and synchronously promoting the process of industrialization and modernization of the country.
At the same time, after Decree No. 45/2012/ND-CP on industrial promotion was issued by the Government on May 21, 2012, up to now, rural industry across the country through industrial promotion policies has achieved certain results.
However, along with the socio-economic development of the country, the policies and orientations on industrial and handicraft development of the Party and the State have been significantly adjusted. Some contents/regulations on industrial promotion in Decree No. 45/2012/ND-CP need to be reviewed and evaluated to amend and supplement to suit the current situation due to some shortcomings.
To overcome the causes of the above shortcomings and limitations, it is necessary to amend and supplement Decree No. 45/2012/ND-CP in the direction of inheriting the relevant contents of the current Decree, at the same time amending and supplementing a number of contents to provide specific, easy-to-comply and easy-to-implement regulations; improve the quality and deepen the effectiveness of the impact of industrial promotion policies; determine the continuous responsibility of the central and local governments in the implementation process; create a clear change in quality, ensuring the overall consistency between the new Decree and other relevant legal documents.
According to the Ministry of Industry and Trade, the draft Decree is built on the viewpoint of ensuring full institutionalization of policies and orientations identified in Party documents and resolutions on industrial development, rural industrial development in general and industrial promotion in particular.
Focus on amending and supplementing some provisions of Decree No. 45/2012/ND-CP that are still contradictory, causing difficulties and obstacles, and urgently need to be amended to create conditions for the development of industrial and handicraft production in rural areas.
The provisions that need to be amended or supplemented must clearly define the content and amendment plan based on the evaluation and comments of state management agencies of the industry, field, localities, organizations and individuals involved; at the same time, ensure independence, stability, unity and inheritance of the contents when amending or supplementing. Ensure consistency and unity between legal provisions.
The Draft Decree consists of 4 articles, specifically as follows: Article 1, amends and supplements a number of articles of Decree No. 45/2012/ND-CP. Article 2, replaces a number of words and phrases in a number of articles, clauses and points of Decree No. 45/2012/ND-CP. Article 3, entry into force. Article 4, responsibility for implementation.
The draft decree also provides expected resources and conditions to ensure implementation. In particular, competent agencies and individuals are responsible for ensuring the number of competent and qualified cadres, civil servants and public employees in the total payroll assigned to perform the task of managing and directly implementing industrial promotion activities...
Implementation funding includes state budget sources according to current decentralization, capital of rural industrial establishments, capital combined from programs, projects, and other legally mobilized capital sources for investment and development of rural industry. The use of funding to ensure the implementation of industrial promotion activities must be in accordance with the purpose, content, regime and expenditure norms according to the provisions of law on financial expenditure regimes.
Localities and relevant state management agencies shall disseminate and propagate the contents stipulated in the Decree. Closely follow and promptly resolve difficulties and problems in the implementation of the Decree.
