Recently, in Thach Phu commune, many houses built illegally on agricultural land and rice fields have been advertised for sale publicly in many different ways such as: hanging billboards, posting on social networking platforms, distributing leaflets, etc. These houses are all bought and sold in the form of "notarized documents".

It is not difficult for customers to contact and be introduced to these illegally built houses by brokers. Here, the houses are transformed and introduced as 100% newly built houses, near schools, markets, hospitals, prime locations... These houses have an area ranging from 30 - 80m2 , with all necessary functions. The selling price ranges from 370 million to 1.5 billion VND.

Mr. Nguyen Van T. (worker at Chang Shin Vietnam Company in Thach Phu commune) recently wanted to buy a house to live in with a budget of about 1 billion VND, so he contacted a broker to find out.

After making an appointment to see the house, Mr. T. was taken to the above houses for reference and consultation. When Mr. T. asked about the legal documents, he was told directly that the house was built on agricultural land and would be bought and sold by notarized documents.

Knowing that these illegal constructions would face many risks, Mr. T. had questions, but the broker said there was no problem: "You see people living there normally, so there's nothing to be afraid of. We've been taking customers to buy houses for a long time, so don't worry."

According to the reporter of Nguoi Dua Tin , many customers were taken by brokers to see houses that were being built illegally.

Specifically, the area is under construction of 11 houses on plot number 849, map sheet number 27, with a total area of ​​1138m2, of which rural residential land is 200m2 , perennial land is 938m2 . These houses have an area of ​​50 - 80m2 , built with 1 solid floor and 1 ground floor, selling price from 900 million - 1.5 billion VND.

When the customer was still hesitant, the broker continued to introduce more houses nearby with more affordable prices. Here, there are nearly 15 mini houses from 25 - 30m2 that have been completed.

All these houses are on map sheet number 14, map plots number 182, 180, 181, total area is 985m2 , rural land is 232m2 , rice land is 753m2 , price ranges from 370 - 500 million VND.

When asked about legality, documents, etc., most brokers try to avoid the issue, telling customers that these houses already have pink books and promise that the books will be separated in the future.

When customers want to see the book, these brokers find reasons for customers to pay a deposit, then take them directly to meet the owner to complete the procedure.

About 15 mini houses were built together on map sheet number 14, map plots number 181, 180, 182, in Thach Phu commune, Vinh Cuu district.

If they still cannot convince customers, these brokers will clearly explain to customers that these houses are built on agricultural land, rice fields and reassure customers with promises and commitments... The brokers also affirm that they have sold dozens of illegally built houses like this without any problems.

The People's Committee of the commune has assigned someone to handle it.

Mr. Phan Thanh Tuan, living in Thach Phu commune, said: “My house has a small plot of land next to it that has not been granted residential land yet. I only put up some corrugated iron sheets to clean the ground for parking, but the commune officials still came to remind me and asked me to remove it immediately. However, I don’t understand why, that place (the area where 11 houses were built on agricultural land) is still being built openly, no one said anything or asked me to remove it. In the past few days, I have seen home buyers coming in and out continuously. Surely, if we build something big, the people above will not know, but if we build something small like this, everyone will know.”

According to Clause 1, Article 6, Clause 1, Article 170 of the 2013 Land Law, residential land is intended for housing construction, and land for growing annual crops is intended for growing annual crops. People are not allowed to build houses on agricultural land.

In case the land user only has the right to use agricultural land and wants to build a house on this land area, he/she must first carry out the procedure to change the land use purpose from agricultural land to residential land. Thus, cases of using land for other purposes to build houses in Thach Phu commune, Vinh Cuu district, Dong Nai province are violations of the Land Law.

Brokers take clients to see illegally built houses.

Regarding the case of illegal constructions in Thach Phu commune, Vinh Cuu district, Dong Nai, Nguoi Dua Tin reporters contacted and reported the above situation to the Chairman of Thach Phu commune People's Committee - Mr. Le Nguyen Song Toan. Mr. Toan received the information and assigned the Vice Chairman of Thach Phu commune, Mr. Nguyen Quoc Phong, to handle it.

Regarding the issue of illegal and unlicensed construction in Dong Nai province, Mr. Nguyen Hong Linh, member of the Party Central Committee, Secretary of Dong Nai Provincial Party Committee, gave his opinion and requested that the Departments and branches actively inspect, promptly detect and prevent illegal and unplanned construction, not prolong the time, risk breaking the planning, affecting socio-economic development.

Mr. Linh emphasized: "Any Chairman of the People's Committee of a commune, ward or town who allows illegal construction to occur will be strictly handled. When illegal constructions occur, that official is either incompetent or has been disabled. If not replaced, he or she will no longer be able to demonstrate strictness of the law."
